Will of Stephen Kemsley

of Borden, Kent

First I direct all my just debts funeral expences and the costs and charges of proving this my Will to be paid by my Executor hereinafter named and as soon as may be after my decease
and I do hereby give and bequeath unto my daughter Mary Ann the Wife of George Webster of Deptford in the said County Waterman the sum of thirty pounds to be paid to her within twelve months next after my decease

Also I give and bequeath unto my housekeeper Ann Williamson my Mangle and so much of my household furniture and effects as in the judgment of my Executor will be sufficient for the comfortably furnishing of one room

And I hereby give and devise unto my brother Joseph Kemsley and the said George Webster all those my two Cottages or dwellings with the Land thereto belonging situate at Chestnut Street in Borden aforesaid and now in the occupation of Thomas Milles and William Brenchley upon trust

that they the said Joseph Kemsley and George Webster or the Survivor of them or the Heirs Executors or Administrators of such Survivor do and shall receive and apply the yearly rent thereof at their discretion for and towards the maintenance and bringing up of my natural daughter Frances Kemsley Williamson the child of my said Housekeeper and now of the age of fifteen months or thereabouts until she shall attain the age of twenty one years
and when and so soon as she shall attain that age then upon further trust absolutely to ----- and convey the same unto the said Frances Kemsley Williamson and to her Heirs and Assigns for ever
but in case the said Frances Kemsley Williamson shall not live to attain the said age of twenty one years then I give and devise the same unto my said brother Joseph Kemsley and to his Heirs and Assigns for ever charged nevertheless with the payment of fifteen pounds unto each of my two brothers Thomas Kemsley and John Kemsley within twelve months next after her decease

And all the rest residue and remainder of my Estate Property and Effects I direct to be converted into money and the produce thereof invested by my Executors in their own names in the National Saving Bank to accumulate at interest for the use and benefit of the said Frances Kemsley Williamson when she shall attain the age of twenty one years
but in case she shall die before she shall attain that age then I give and bequeath the same and the accumulation thereof unto the said Ann Williamson her Executors and Administrators

and whereas I have prepared another Cottage which I intended to have erected on a part of the said Land before devised Now I direct my Executors to complete the same and in case my residuary personal Estate shall be insufficient, do hereby empower them to raise by mortgage or other security charged on the said Cottage the funds requisite for that purpose

And I do hereby nominate and appoint my said Brother Joseph Kemsley and the said George Webster joint Executors of this my Will and I do hereby direct and declare that my said Executors and Trustees and each of them shall not be answerable or accountable the one of them for the other of them and by no means for involuntary losses and that they and each of them shall and may retain to and reimburse himself and themselves all their reasonable costs charges and expences to be occasioned by the due execution of this my Will and I hereby revoke all former wills

In witness whereof I the said Stephen Kemsley the Testator have to this paper which I declare to be and contain my last Will and Testament set my hand and seal the day and year first above written

Signed sealed published and declared by the said Stephen Kemsley the Testator as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have subscribed our names as witnesses hereto
Edward Chiles, Key Street, Robert Gouge, Richard Bathurst, Sittingbourne

Proved at London 11th January 1830 before the Worshipful Charles Cook doctor of Laws and Surrogate by the oath of Joseph Kemsley the brother one of the Executors to whom Administration was granted having been first sworn duly to administer power reserved of making the like grant to George Webster the other Executor
