I give and bequeath unto my daughter Mary King who at present resides with me all that my household messuages or tenements ground & appurts thereinafter belonging situate & being in Strond Street in the town & port of Dover aforesaid & now in my own occupation. To hold the same unto my said daughter Mary King & to her executors admons and assigns she & they paying for testament to my other trustees hereinafter named the sum of four hundred pounds within six months next after my decease.
Also I give & bequeath to my son Thomas King my gold watch
to my son John King my silver Tankard
& to my son Henry Rice King my silver pint pot to be
delivered immediately after my decease.
Also I give & bequeath unto my son Edward King all my wearing apparel of every kind & my
gold & silver studs to be delivered to him at such time and manner as my executors hereinafter
named shall think fit & proper.
Also I give & bequeath unto my daughter Mary King all &
every my household furniture books silver china & effects in & about my said
dwelling house with the residue & remainder of my estate to & for her own
purposes & benefit to be delivered to her immediately after my decease.
Also I give to my friends Mr Thomas Brown King of the Tower in the city of
London Mr Thomas Knocker of the town & port aforesaid Attorney at Law & Mr
John Barber of the same port of Dover gentleman a Gold Ring of the value of
two Guineas.
Also I give devise and bequeath unto my said daughter Mary King & to the said Thomas Brown King & Thomas Knocker & John Barber all the residue & remainder of my messuages grounds tenements & heredits parts purparts & shares of messuages grounds tenements & heredits together with my said messuages or tenements grounds & appurts hereinbefore given & bequeathed to my said daughter Mary King in order she does not pay the sum of four hundred pounds for the same within the said executors or trustees & also all & every my monies to the funds & other securities for money debts & the said residue & remainder of all other my property estate & effects whatsoever & wheresoever not available for ___ given bequeathed or disposed of together with the said sum of four hundred pounds in case my said daughter Mary King pays the same in manner aforesaid to hold all the same to my said daughter Mary King & to the said Thomas Brown King Thomas Knocker & John Barber & to their heirs executors admon & assigns __ upon the several trusts etc & for the ends interests & purposes hereinafter mentioned expressed & declared & commencing for same that is to say
upon trust that they my said trustees & the survivors & survivor of them & for their executors & admons of such survivor shall & do as soon after my decease as they conveniently can sell & dispose of the said rest & residue of all & every my said messuages land & tenements & heredits parts portions & share thereof together with the said messuages or tenements grounds & appoints now in my sole occupation in case my said daughter Mary King does not pay the sum of four hundred pounds for the same pertain the time hereinbefore limited & all other my property estate & effects hereinbefore given devised & bequeathed unto them my said trustees not consisting of monies or securities for money of such funds money & form as they my said Trustees & the survivors & survivor of them & the heirs executors & admon of such survivor shall think proper
& upon further trust that they my said trustees shall & do also as soon after my decease as may be called get in & receive all & every my debts except for debts due from my son Thomas King & Charles Wellard King hereinafter mentioned & monies upon securities & sell & dispose of my stocks and funds at such prices the same may be worth at the time of the sale thereof & I do hereby declare that the receipt & receipts of my said trustees & the survivors & survivor of them his or her heirs executors admons & assigns shall be a good & sufficient discharge to the purchaser & purchasers of such of my said messuages lands tenements & heredits estate my property estate & effects as may be sold & disposed of & for any other payments to my said trustees under & by virtue of this my will for so much money as in such receipt or receipts shall be accepted and acknowledged to be received & that such purchaser & purchasers or any or other of them or others making payments to my said trustees shall not be answerable or accountable for the misappropriation or misapplication of the monies so received or of any part thereof & by and out of the money arising & coming to the hands of my said trustees by the several means aforesaid upon trust in the first place to pay & discharge all & every my just debts funeral exs testimony expenses & upon trust to pay & apply
& I do herby give & bequeath unto Mr Joseph Luddington son of
my late wife Mary by her first husband the sum of one hundred pounds of
lawful money of the United Kingdom current in Great Britain to be paid to him or
his assigns as soon as my said trustees shall have received sufficient money to
enable them to pay the same
& upon further trust that they my said trustees
shall & do place out on Government or such other good & sufficient security &
securities at interest they may think proper for further sum of one hundred
pounds of like lawful money upon trust to pay & apply & I do hereby give &
bequeath the interest dividends & profits thereof unto Mary the wife of my said
son Charles Wellard King who is a daughter of my said late wife Mary by her
said first husband & her assigns for & during the term of her normal life
& from & immediately after her decease then upon trust & I do give & bequeath the same
sum of one hundred pounds or the Government or other securities upon which
the same may have been placed unto all & every the children of the said Mary the
wife of my said son Charles Wellard King equally to be divided between them
& as to the residue & remainder of all & every the monies arising by the several monies aforesaid & coming to the cause of my said trustees either or any of them under & by virtue of this my will upon trust & I do give & bequeath in the several proportions manner & form hereinafter mentioned & set forth remaining the same that is to say
I do give & bequeath one full sixth part thereof unto my said son
Thomas King & to his executors admons & assigns
I do give & bequeath one other full sixth part thereto unto my said son Charles Wellard King &
to his executors admons & assigns
I do give & bequeath one other full sixth part thereof
unto my said daughter Mary King & to her executors admons & assigns
I do give & bequeath one other full sixth part thereof unto my said son John King & to his
executors admons & assigns
I do give & bequeath one other full sixth part thereof
unto my said son Henry Rice King & to his executors admons & assigns
to be paid to my said sons & daughters as soon as maybe after my decease
& I do & give & bequeath the remaining full sixth part thereof upon the several trusts
intents & purposes to or for the use & benefit of my said son Edward King as
hereinafter declared & confirmed & in the case of the death without issue of any
or other of my said children during my life time then I do give & bequeath the
part & share or parts & shares of such of them so dying without issue unto the
survivors of my said children in equal proportions
& in case of the death of any or
other of my said children during my life time leaving issue of his her or their body
or bodies lawfully begotten then I do & give & bequeath the part & share or parts
of such of them so dying unto his & their issue in equal proportions such issue
taking only the part & share or parts & shares his her or their deceased payout or
payouts would have been entitled to if living
provided always & I do hereby direct
that the said sixth part or share of my said property & estate so given &
bequeathed to or for the use & benefit of my said son Edward King & all such
other part or parts thereof as shall under & by virtue of this my will now &
devised to him by survivorship shall be invested by my said trustees & the
survivors or survivor of them his or her heirs executors & admons in government
or such other good & sufficient security or securities at interest as they he or she
may think proper & in their his or her names or name & shall be contained so
invested in trust to pay & apply the interest dividends & proceed thereof unto my
said son Edward King by quarterly or in such other payments manner & form as
they my said trustees & the survivors or survivor of them his or her executors &
admons shall think proper for & during the term of his natural life the first
payment thereof to be made at such time as to their aim after shall soon meet
after my decease
but it shall happen that the interest dividends & proceed of the
said sixth part of my said property & estate so given & bequeathed to or for the
use of my said son Edward King & of such share part or parts thereof as shall
devised to him by survivorship at the time of my decease shall not amount to the
then annual sum of forty pounds then it is my will & mind that my said trustees &
the survivors or survivor of them and his or her heirs executors & admons shall
purchase & continue invested during the life time of my said son Edward King in
their his or her names or name in Government or such any other security as to
having shall deem proper so much money as will provide for him my said son
Edward the full share annual sum of forty pounds for discretionary thereof to be
deducted equally from the said four sixth parts of my said property & estate so
given & bequeathed to my said sons Thomas, Charles Wellard, John & Henry Rice
& from & immediately after the decease of my said son Edward have in trust & I
do & give & bequeath the part share & interest of my said property given &
bequeathed or otherwise coming to or for the use of my said son Edward under or
by virtue of this my will or the government or other securities upon which the
same may have given invested unto & amongst the survivors of my said children
& the issue of them then dead leaving issue such issue taking only the part &
share or parts & shares his her or their deceased parent or parents would have
been entitled to if living
provided also & if it shall happen that the said sixth part
of my said property & estate so given & bequeathed unto my said daughter Mary
King sixth other part or parts thereof as shall descend to her by survivorship at
the time of my decease does not amount to the full sum of eight hundred pounds
of lawful money aforesaid then it is my will & mind & I do give & bequeath such
sums & sums of money as may be wanting to make up the said sum of eight
hundred pounds to her my said daughter Mary King & to her executors admons &
assigns the deficiency thereof to be deducted equally from the said four sixth
parts of my said property & estate so given & bequeathed to my said sons
Thomas, Charles Wellard, John & Henry Rice
whereas my said son Thomas King
now is justly & truly indebted to me in the sum of three hundred & twenty seven
pounds of lawful money aforesaid with said sum I do direct shall be deducted
from & out of such part & share of my said property & estate he may become
entitled to under & by virtue of this my will and whereas I some time since
received the sum of sixty four pounds fourteen shillings & eight pence which was
due & owing to my said son Thomas King from & out of the estate & effects of my
late brother in law Thomas Harrison now I do declare that the gifts & bequests
herein contained to my said son Thomas King are upon condition that he deduct
& allow out of the said part & share of my said property & estate coming to him
the said sum of three hundred & twenty seven pounds & also release & discharge
all claims & demands the said sum of sixty four pounds fourteen shillings & eight
pence without any compensation for the same other than what or may become
entitled to under & by virtue of this my last will
& I do give & forgive my said son
Thomas all other sums of money as may stand indebted unto me for interest or
otherwise at the time of my decease
and whereas my said son Charles Wellard
King now is justly & truly indebted unto me in the sum of eight hundred pounds
of lawful money aforesaid which said sum I do also direct shall be deducted from
& out of such part & share of my said property & estate he may become entitled
to under & by virtue of this my will and whereas I also some time since received
the sum of sixty four pounds fourteen shillings & eight pence which was due &
owing to my said son Charles Wellard King from & out of the said estate & effects
of my said late brother in law Thomas Harrison now I do also declare that the
gifts & bequests herein contained to my said son Charles Wellard King are upon
condition that he deduct & allow out of the said part & share of my said property
& estate coming to him the said sum of eight hundred pounds & also release &
discharge all claims & demands to the said sum of sixty four pounds fourteen
shillings & eight pence without any compensation for the same other than what
he may borrow & entitled to under & by virtue of this my will
& I do give & forgive
my said son Charles Wellard King all other sums of money he may stand indebted
unto me for interest or otherwise at the time of my decease
and whereas I some time since purchased in the name of my said son John the sum of one hundred pounds in capital in the combine life annuities established in the year 1789 now I do hereby declare that for same was purchased for the use & benefit of my said son John & I do hereby give & bequeath the same to his & his assigns accordingly upon condition that he deduct & allow out of the said part & share of my said property & estate coming to him the sum of one hundred pounds of lawful money aforesaid without any further compensation for the said sum of one hundred pounds other than what he may be entitled to by virtue of that sum in the conline life annuities aforesaid
& it is my will & mind that having my said trustees & the survivors & survivor of them his or her heirs executors admons & assigns shall & may deduct & retain in their his or her hands out of my said property estate & effects all such costs charges damages & expenses they he or she shall as may be at or be put unto in & about the execution of the trusts hereby in law expressed or in any case relating hereto & that neither of them shall be answerable or accountable for any more monies than they he or she shall respectively actually receive under & by virtue of this my will nor for any loss that may happen to my said monies estate & effects or any part thereof so as the same happen without the wilful neglect or default nor shall the one of them answerable for the other or others of them or the acts deeds receipts defaults or disbursements of the other or others of them but each of them for his or her own acts deeds receipts defaults & disbursements
& I do hereby nominate constitute & appoint my said daughter
Mary King the said Thomas Brown King Thomas Knocker & John Barber executors
of this my will & hereby revoking & making void all other wills by me hereinbefore
made. I do declare this to be my last will & testament in witness whereof I the
said William King the testator have to the five first sheets of this my last will &
testament in six sheets of paper contained set my hand & to this sixth & last
sheet thereof my hand & seal the fifth day of May in the year of our Lord 1815 W
King signed sealed published & declared by the said William King the testator as
& for his last will & testament in the presence of us who at his request in his
presence & in the presence of each other do hereunto subscribe our names as
witnesses
