I James Knowlden of Cranbrook in Kent Butcher declare this to be my last Will and Testament

I bequeath my Policy of Assurance for Five hundred pounds in the Clerical Assurance Office and all additions thereto and all other My Personal Estate whatsoever and wheresoever unto my Brother in law George Oyler Thirkell of Brenchley and William Seamark of Maidstone their executors and administrators Upon trust that the said George Oyler Thirkell and William Seamark or the survivor of them or the trustees or trustee for the time being of this my Will shall as soon as conveniently may be receive and get in the money secured by such Policy and call in and convert into money such part of my said personal Estate as shall not consist of money and shall stand possessed thereof Upon trust to pay my funeral and testamentary expences and my debts

and after payment thereof to pay the sum of One hundred pounds to my Father James Knowlden
And upon trust to invest the residue of the said monies in the name or names of the said trustees or trustee in or upon any securities in England or Wales not being purely personal securities

And I declare that the said trustees or trustee to pay the annual income of the said trust funds my Wife until my son shall attain the age of twenty one years provided she shall continue unmarried and in case my said wife shall marry again during the minority of my said son and before he shall have attained the age of fourteen years Upon trust to pay such annual income to her for her sole and separate use for the maintenance of my said son until he shall have attained the age of fourteen years and from and after he shall have attained that age Upon trust to pay and apply the annual income of the said trust funds for or towards his maintenance and education until he shall attain the age of twenty one years and when he shall have attained that age Upon trust to pay and transfer the said trust funds and the income thereof to my said son his executors administrators and assigns

Provided always that the trustees or trustee for the time being of this my Will may at any time or times during the minority of my said son apply and part or parts not exceeding one half of the principal of the said trust funds for or towards the benefit of my said son or for the purpose of placing him out as an Apprentice

And I hereby declare that if my said child shall die under the said age of twenty one years then and in such case the trustees or trustee for the time being of this my Will shall stand possessed of the said trust funds or securities Upon trust to divide into two equal moieties and to pay and transfer one moiety of the said trust funds and securities to my said wife her executors administrators and assigns
And to pay or transfer the other moiety of the said trust funds and securities equally between the three children of my brother John Knowlden their respective executors administrators and assigns or such of the said children as shall be living at the time of the decease of my said son

I devise to my said trustees all estates vested in me as trustee or mortgagee subject to the equities affecting the same respectively I declare that the receipts or receipt of the trustees or trustee for the time being of this my Will for the money secured by the said Policy and for all such monies stocks funds or securities as shall be paid or transferred to them by virtue of my Will shall effectually discharge the said Insurance Office or any person or persons paying or transferring the same from all liability in respect of the application thereof
I declare that no trustee of this my Will shall be liable for losses occurring without his own default or neglect And that they shall be at liberty to retain and allow to themselves and to each other the expences of executing the trusts hereof
I declare that on the death refusal or incapacity of the said trustees hereby appointed or either of them or any trustee to be appointed under this Clause it shall be lawful for the competent or surviving trustees or trustee whether retiring from the office of trustee or not or the executors or administrators of the last deceased trustee to appoint a fit person or persons to supply the place of the deceased refusing or incapacitated trustees or trustee
And that the previous clauses so far as they concern my trustees hereinbefore named shall extend and be applied to the trustees or trustee for the time being of my Will

In witness whereof I have to the foot or end of this my Will set my hand this twenty sixth day of September one thousand eight hundred and fifty five James Knowlden Junr
