In the Name of God Amen I Henry Letley the Elder of the Parish of St. Margaret next the City of Rochester in the County of Kent, Victualler being in health of Body and of sound and Disposing Mind, Memory and Understanding Do Make Publish and Declare this my Last Will and Testament in manner following
In the first place I Commend my Soul to Almighty God the Creator thereof through the Merits of Jesus Christ my Saviour And my Body I Commit to the Earth to be decently Interred at the discretion of my Executrix and Executor hereinafter named And as to my Worldly Estate I Dispose thereof as followeth (that is to say)

I Give Devise and Bequeath All those my Five Twelfth parts of and in All that Leasehold Messuage or Tenement commonly Called or Known by the Name or Sign of the Bear and Ragged Staff And of and in the Outhouses, Stable, Yard, Backside and Ground thereto belonging with the Appurtenances Situate lying and being in the Parish of Saint Margaret next the City of Rochester aforesaid and now in my own Occupation Unto my Loving Wife Mary Letley and my only Son Henry Letley equally to be divided between them share and share alike as Tenants in Common and not as Joyntenants [Joint Tenants] and to their respective Executors, Administrators and Assigns

But Nevertheless It is my Will and Desire And I do hereby Order and Direct That my said Loving Wife Mary Letley (if she shall think fit) shall and may Continue and Live in the said Messuage or Tenement and Premises and Carry on the Trade or Business of a Victualler without any Controul or Disturbances of from or by my said Son Henry Letley his Executors, Administrators or Assigns She my said Wife Mary Letley paying unto my said Son Henry Letley his Executors, Administrators and Assigns a Proportionable part of the Rent for his Part and Share of and in the said Five Twelfth Parts of and in the said Messuage or Tenement and Premises

And in Case my said Loving Wife Mary Letley shall desire and be unwilling to Continue and Live in the said Messuage or Tenement and Premises and Carry on the said Trade or Business of a Victualler there And thereof shall Give One Calendar Months Notice in Writing unto my said Son Henry Letley
Then it is my Will and Desire That my said Son Henry Letley if he shall think fit shall and may Live and Continue in the said Messuage or Tenement and Premises and Carry on the Trade or Business of a Victualler there without any Controul or Disturbance of from or by my said Wife Mary Letley her Executors Administrators or Assigns He my said Son Henry Letley Paying unto my said Wife Mary Letley her Executors, Administrators and Assigns a Proportionable part of the Rent for her Part and Share of and in the said Five Twelfth Parts of and in the said Messuage or Tenement and Premises

Item All and every my Ready Money, Securities for Money, Debts, Creditts, Plate, Household Goods, Furniture, Implements of Household, Stock in Trade, Chattells and all other the rest and residue of my Personal Estate whatsoever and wheresoever which I shall dye Possessed of, Intitled unto or Interested in (my own Just Debts, Funeral Expences, Charges of Proving this my Will and other Incidental Charges being thereout First Paid and Satisfied) I Give and Bequeath unto my said Loving Wife Mary Letley and Son Henry Letley equally to be divided between them share and share alike and to their respective Executors, Administrators and Assigns

And I do Costitute and Appoint my said Loving Wife Mary Letley and Son Henry Letley Joynt Executrix and Executor of this my Last Will and Testament Hereby Revoking all former Wills by me at any time heretofore Made And I do Declare this to be and Contain and for my only Last Will and Testament

In Witness whereof I the said Henry Letley the Testator have to this my Last Will and Testament Contained in Two Sheets of Paper to each Sheet thereof Set my hand and Seal this Twenty Eighth day of February in the Year of our Lord One thousand Seven hundred and Forty Four

June 23rd 1740 Mary Letley Widow and Relict & Henry Letley the Son of the deceased Executors of the within written Henry Letley deceased were Sworn (as usual) Before me: Ralph Bishop, Surr. [Surrogate]

This Will was Proved at Rochester on the 23rd day of June in the Year of Our Lord 1748 Before me Rev[eren]d Ralph Bishop Clerk, Surrogate by the Oaths of Mary Letley Widow the Relict and Henry Letley the Son of the deceased and Executors within named to whom was granted administration being first sworne duly to Administer
