In the Name of God Amen I Elizabeth Ludwell of Charing in the County of Kent Widow being in good health of Body and of sound and disposing mind memory and understanding (thanks to Almighty God for the same) and being desirous to dispose of my Worldly Estate now in the time of my health do therefore hereby make my last Will and testament in manner and form following (that is to say)
First I resign my Soul to Almighty God who gave it hoping for remission of all my sins through the Merits Death and Passion of my blessed Saviour and Redeemer Christ Jesus, my Body I commit to the Earth to be buried in the parish church of Charing aforesaid in the Grave I have ordered and which I do direct shall be bricked and arched

Item I Give my large Silver Cup and Cover and my Silver Gilt Cup and Cover to the Ministry and churchwardens of Charing aforesaid for the time being for the use and benefit of the parish and parishioners of Charing aforesaid to be kept and used as Communion Plate and do desire that an Inscription may be first engraved therein signifying the Use thereof and that the same is my Gift to the said parish for the purpose aforesaid
Also I do hereby direct and order my Executors hereinafter named to provide and buy two proper and suitable Branches for Candles to be hung up in the Church of Charing aforesaid and I do Give the same to the Minister and churchwardens of Charing for the time being to be hung up and kept in the said church for the use thereof
And I do direct and order that a Sermon according to the form and practice of the Church of England be preached on every Christmas Eve by the Minister of Charing for the time being and I do direct and order that he be paid twenty shillings yearly for the same as my Gift and that there be also paid Ten shillings yearly to the Clerk of the said parish for the time being for his attendance and Service and that Forty shillings be also allowed and paid yearly to the Churchwardens of the said parish for the use of the said parish to wit Ten shillings part thereof for Candles to light up the Church on that Occasion and the remaining Thirty shillings to be by them laid out in bread and then distributed amongst such poor people of the said parish as they shall think most worthy to receive the same which Gift amounts together to the yearly Sum of three pounds and Ten shillings

And I do as far as I legally may charge my Farm, Barn and Lands called Nash Barn and the Fields called the Kiln Fields situate and being in the Parish of Charing aforesaid and now or late in the Occupation of Thomas Stanley and Thomas Amos or one of them And I direct and order that the person who shall be entitled to the said Farm and Lands by Virtue of this my Will shall within three months after my decease charge the same in a Legal and proper manner with the payment thereof accordingly And so as the payment thereof may be properly serviced for ever
And in case he shall refuse or neglect so to do or that by any other means such charge cannot or shall not be properly and legally charged and secured thereon then I do hereby Give and bequeath unto the Minister and churchwardens of the said parish of Charing for the time being the Sum of One hundred and fifty pounds to be by them placed out at Interest or properly secured for a perpetual Fund to raise and pay such Three pounds and Ten shillings yearly for ever

Also I do hereby give Two Thousand Five hundred pounds to and for the use and benefit of the parish and parishioners of Charing aforesaid as a Fund for raising Forty pounds a year for ever to be from time to time equally divided and distributed by the Minister and Churchwardens for the time being between Ten poor housekeepers not receiving Alms of the said parish and out of the Interest Surplus or produce of the said Two thousand Five hundred pounds to pay twenty five pounds a year to a fit and proper person to be appointed by the said Minister and Churchwardens of the said parish for the time being to teach the poor children Male and Female of the said parish reading Writing and Accounts
And the remaining part of the Interest of the said Two Thousand Five hundred pounds to be applyed by the said Minister and Churchwardens of the said parish in placing out poor Boys of the said parish Apprentices to Trades and I do hereby direct and order my Executors to see the said Two thousand Five pounds properly secured to answer and be a perpetual Fund for such my said Charitable bequests
Also I Give and bequeath to the Governors and Guardians of the Hospital for the maintenance and Education of exposed and deserted young Children the Sum of Five hundred pounds

Also I Give and bequeath to Barnaby Backwell of London, Banker and Francis Austin of Cliffords Inn, London, Gentleman the Sum of Five hundred pounds upon Trust and to the Intent they or one of them pay the same to the Governors and Trustees of the Lying Inn Hospital for marryed Women in Brownlow Street in Middlesex which said Sum of Five hundred pounds I desire may be applyed by them for the use of the said Charity

Also I Give and bequeath the Sum of Five hundred pounds unto the said Barnaby Backwell and Frances Austin to be by them paid and applyed to the Treasurer or Treasurers of the Hospital of Bethlem and Bridewell, [Moorhouse] London for and towards the better support and augmenting the Ward of Incurables in the said Hospital of Bethlem and the better support of the incurable patients therein or that they the said Barnaby Backwell and Francis Austin do otherwise at their discretion pay and apply the said Five hundred pounds to the said Ward of Incurables or the enlargement or improveing thereof

Also I Give and bequeath unto the said Barnaby Backwell and Francis Austin the Sum of Five hundred pounds to be by them paid and applyed to the Treasurer or Treasurers for the time being of an Hospital called or known by the name of Saint Lukes Hospital for Lunaticks and which Hospital is situate or near unto Moor Fields London And I do direct order and appoint the said Sum of Five hundred pounds to be applied for and towards the better support of the Hospital and the carrying on the Charitable designs and intentions thereof or in augmenting the said Hospital or that they the said Barnaby Backwell and Francis Austin do otherwise at their Discretion pay and apply such Five hundred pounds for the benefit and support of the said Hospital or of the patients to be so admitted therein or in the improvement or enlargement of the Buildings thereof

Also I Give and bequeath unto the said Barnaby Backwell and Francis Austin the further sum of Five hundred pounds upon Trust and to the intent that they or one of them do pay the same to the Treasurer or Treasurers for the time being of Society who now call themselves the Governor of Saint Georges Hospital near Hyde Park Corner which said Sum of Five Hundred pounds I will desire and appoint shall be applyed towards carrying on the Charitable designs of the said Society and the better to support the same or that they the said Barnaby Backwell and Francis Austin do otherwise at their discretion pay and apply such Five hundred pounds for the benefit and support of the said Charity and the patients thereof

Also I Give the like Sum of Five hundred pounds to them the said Barnaby Backwell and Francis Austin Upon Trust that they do pay the same to the Treasurer or Treasurers or other proper officer for the time being of the Society for the propogating of the Gospel in Foreign parts for the benefit of the said Society or Corporation and their charitable institution and the better to support promote and carry on the same or that they the said Trustees do otherwise at their own discretion pay and apply the same to and for the Benefit of the said Society or Corporation or their charitable Institution

Also I Give and bequeath the further Sum of Five hundred pounds to them the said Barnaby Backwell and Francis Austin Upon Trust that they do pay the same to the Governors or Treasurers of the Charity for the Relief of poor widows and Children of Clergymen to whom I Give the same or that they the said Trustees do at their own discretion pay and apply such last mentioned Sum of Five hundred pounds in the promoting or benefiting that Charity

Also I Give and devise to the provost and Scholars of the house or Hall of the Blessed Virgin Mary otherwise called Oriel College in Oxford and to their chief Successors for ever All and every my Messuage Farm and Lands situate lying and being in the parishes of Throwley, Eastling and Ospringe some or one of them in the said County of Kent now or late in the Occupation of Mathew Chapman his undertenants or assigns and also all the several peices or parcels of Wood or Woodground containing by Estimation __________ acres or thereabouts situate lying and being in Throwley, Eastling and Ospringe aforesaid some or one of them and now or late in my own hands or Occupation but now or heretofore esteemed to be part or parcel of the said last mentioned Farm and Lands with their and every for their Rights Members and Appurtenances Upon the several Trusts hereinafter expressed and declared (that is to say)
Upon Trust to pay and apply the profits of such Messuage Farm and Lands (save except the Wood and Woodgrounds) for and towards the maintenance of Two Exhibitioners to be elected or nominated within three months after my decease and after any Vacancy by the said Provost and four senior fellows present and their Successors for ever And my Will and desire is that in the Nomination of the said Exhibitioners my own Relations be first and principally regarded and chosen and next to them that such Candidates shall have the preference as shall be of the Town or parish of Charing aforesaid and after them such as shall be of the County of Kent
Upon Condition that such several Candidates shall be duly and properly qualifyed in respect to their Learning and Morals but if no such Candidate as is before mentioned shall offer and propose himself I will that such other Candidate as is best qualified in the above respects of what County soever he be shall be preferred and chosen moreover I would have no person elected into either of my said Exhibitions who have taken and [any] degree in the University nor enjoy the benefit of them any longer than for the term of Seven years
And my Will Order and Mind also is that neither of my Exhibitioners shall absent from the said College above the Space of sixteen weeks in any one year unless detained by severe Illness under the penalty of Forfeiting their exhibitions which the said Provost or his Deputy or in their absence the senior Fellow provost is desired to declare ....cant? And I do hereby order and give full power to the Provost and Senior fellow at the time of my decease to make such further propulations? herein as to them shall seem necessary and expedient and
Upon Trust to pay apply and distribute the Rents Issues Profits and produce of the said Wood and Woodgrounds and all benefit arising or to arise therefrom from time to time as the same shall be received to the poor Scholar or Scholars of the said House or College or Hall for the time being in such parts shares and proportions as the said Provost for the time being and the four Senior Fellows present and their Successors for ever shall think proper and best deserving And in Case the said Provost and Fellows shall think fit to give any preference or think that one or more of such Scholar or Scholars are less deserving then [than] another then to be equally divided between all such poor Scholars for the time being Share and Share alike for ever

Also I Give and bequeath to William Carter of Canterbury Doctor in Physick the Sum of One hundred pounds
Also I Give and devise my Messuage or house Farm and Lands in Ivychurch and New Romney by me purchased of Mrs. Gray and others with the Rights Members and Appurtenances unto my Godson William Carter, Son of the said Doctor William Carter and to the heirs and assigns of the said William Carter my Godson for ever
Also I Give to Sarah Carter, Daughter of the said Doctor William Carter my Silver Chaffing Dish and a pair of Silver Candlesticks and Snuffers and two half pint Silver muggs

Also I Give and bequeath the Sum of Two hundred pounds to Mr. Richard Pierce of the South Parade of Bath
Also I Give and devise my Messuage Farm and Lands in Westwell in the occupation of ________ Venner his Undertenants or Assigns to me purchased of Mr. Hendon to the said Richard Pierce and to his heirs and Assigns for ever

Also I Give and bequeath to my Godson Richard Mather Son of the Reverend Mr. Mather, Minister of Biddenham [Biddenden] in Kent the Sum of One hundred pounds
Also I give and devise to my Godson the said Richard Mather and his heirs for ever all and every my Two Messuages or Houses with the Lands and Appurtenances thereunto belonging situate lying and being in the Parish of Woodstock in the County of Oxford being all my Messuages or houses Lands and Tenements in Woodstock aforesaid

Also I Give and devise to Mary Smith, Widow, formerly Mary Knock and late Servant to my Sister Teale deceased One Annuity or yearly rent Charge of Five pounds for and during the term of her natural life, the said annuity to be paid half yearly by two equal payments free and clear of and from all Parliamentary or other Taxes or other Charges or deductions whatsoever and to be issuing going and paid and payable out of all and every my Messuage Farm and Lands Tenements and Hereditaments in Lenham in the said County of Kent now or late in the Occupation of Mr. Ford and out of my Woodlands in or near Lenham aforesaid belonging or reputed to be belonging or appertaining thereunto as part or parcel thereof, but now in my own occupation by even and equal portions on the two most usual Feast days or times of the Annunciation of the Blessed Virgin Mary and Saint Michael the Archangel, the first payment thereof to begin and be made on such of the said Feasts as shall first and next happen after my decease, with power for the said Mary Smith and her assigns to distrain for the said Annuity or Rent Charge or any part thereof and all the arrears thereof when and so often as the same shall be in Arrears and unpaid by the Space of Twenty one days next after the days or time on which the same ought to be paid as aforesaid

Also I Give and devise to the Churchwardens and Overseers of the parish of Sellinge in the said County of Kent for the time being all that my Annuity or yearly payment of one pound six shillings per Annum issuing out of a Messuage or Tenement with the Appurtenances situated in the said parish of Sellinge and now in the possession of ______ Gibson of Sellinge aforesaid To hold to the said Churchwardens and Overseers for the time being to be distributed amongst the poor of the said parish yearly at Christmas for ever

Also I Give and bequeath the sum of two hundred pounds to Ann Laker, Daughter of William Laker of Charing aforesaid Wheelwright, deceased and my least Silver Tankard, One of my small Silver Salvers, Four Silver Spoons, One mourning ring inscribed S. Godfrey (being the Godmother of the said Ann Laker) in a Cypher and two small Diamonds and left to me by the said S. Godfrey, One silver porringer and the Workt [worked] Bed and Furniture in the best Chamber up two pair of Stairs in my dwelling house in Charing aforesaid

Also I Give and bequeath unto Frances Harrison, Wife of George Harrison who now lives with me Four hundred pounds and Ten pounds for mourning and also one of my silver pint Muggs, Two silver Salts, One Silver Salver marked E.P., One Silver Egg pot the bed[d]ing and Furniture in the Chamber or Room up one pair of stairs over the kitchen in my dwelling house in Charing aforesaid

Also I Give and bequeath to Jane Coulter my Cook Maid the Sum of Two hundred pounds Upon Condition she marry Thomas Smith of Charing aforesaid my Tenant but if she the said Jane Coulter refuse to marry the said Thomas Smith then I only give her the Sum of One hundred pounds; and Ten pounds for mourning, One silver half pint Mug and the Blue Bed Beding and furniture in the Chamber up Two pair of Stairs there and the other One hundred pounds to the said Thomas Smith

Also I do order and desire my Executors to divide and give such of my Books and Linnen to the aforesaid Frances Harrison, Jane Coulter and Ann Laker and in such Shares parts and manner as they shall think most Proper and as shall in their Judgement be fitting for them
Also I Give and bequeath to Michael Botham of Castle yard, Holborn, London Gentleman the Sum of One hundred pounds
Also I Give to Margaret Smith, Sister of the said Thomas Smith my Tennant the Sum of Ten pounds
Also I Give to Edward Isteed of Dean Court in Westwell in the said County of Kent the Sum of Two hundred pounds
Also I Give and bequeath to Thomas Isted Son of the said Edward Isted the Sum of One hundred pounds

Also I Give and devise to John Gibson son of the said Gibson of Sellinge in the said County of Kent Gentleman, All those Five several pieces or parcels of Land called Chanceymarsh? situate at Minster in the Isle pf Sheppey and now or late in the Tenure or occupation of William Head his undertenants or assigns To hold to the said John Gibson his Heirs and Assigns for ever
Also I Give and devise to the said John Gibson a small parcell of Land situate in the parish of Smeath [Smeeth] in the said County of Kent and now or late in the possession of Thomas Watts To hold the said parcell of Land to him the said John Gibson his heirs and assigns for ever
Also I Give and bequeath to the said John Gibson my other silver Tankard, Two silver Salts, One Silver Punch Ladle and one of my small Silver Salvers

Also I Give and bequeath the Sum of Twenty pounds, One Silver Cup marked E.P., Two Silver Spoons and One Silver pepper Box to Mrs. Boughton, Wife of my Tenant Thomas Boughton of Lenham in the said County of Kent
And I also direct that my eleven old Silver Forks be sold by my Executors and the Money or produce thereof to be laid out in a Silver Cup which I also give the said Mrs. Boughton

Also I Give and bequeath to George Carter of Kennington in the said County of Kent Gentleman the Sum of One hundred pounds
Also I Give and Devise to the said George Carter all that Messuage or Tenement Farm Lands and Hereditaments called or known by the Name of Dean Court and now or late in the Tenure or occupation of Edward Isted his Undertenants or Assigns and all and every the Lands Woods and Woodgrounds thereunto belonging or appertaining as part and parcel thereof with their and every of their Rights Members and Appurtenances situate lying and being in the parishes of Westwell and Challock or one of them or in some other Parish or place near adjoining thereunto To hold the said Messuage or Tenement Farm lands Woods Woodgrounds Hereditaments and Premises unto him the said George Carter his heirs and assigns for ever

Also I Give and bequeath to all and every Tennant or Occupyers of my Houses Messuages Farm Lands Tenements or Estate to wit to such of them as occupy or hold of me Lands or Tenements of Twenty pounds a Year or upwards the last half years rent or income next proceeding my death of what the so respectively hold or occupy of me and to such of them as occupy or hold or me under Twenty pounds a year the whole years rent next proceeding my death and that were due at or before my death of what they so respectively hold such several Tenements answering bearing and paying thereto the Taxes and all other usual Outgoings and as signer thereof
And I do direct and order that if any of my late Tennants should have paid me in my Lifetime the whole or any part of such Rent or Rents that I have so given to them respectively that my said Executor shall and do return or repay to such Tennant of Tennants what they shall have so paid of what is by me given and bequeathed to them respectively as aforesaid
Also I Give a Ring of Twenty shillings to each of my Tennants Wifes and to my Two Maid Servants

Also I would have the whole of my Legacies and Gifts not otherwise particularly expressed paid out of my personal Estate but if (it) shall happen that at the time of my death that such of my personal Estate as is not specifically bequeathed shall fall short or be insufficient to answer and pay the whole of my Gifts Charitys and many Legacys that then and in such case I do hereby direct and order that my said personal Estate shall in the first place be paid and applied for or towards paying and satisfying the whole of the money by me hereinbefore given in charity and such of my said charitable Donations it being my intent and design that such of my said Charities or Charitable Donations shall not be any charge on my Lands Tenements and Real estate but be answered and paid out of my personal Estate only
And in case by such the Application of my personal Estate there should be any deficiency of my Assets to answer and pay my other Legacys then and in such Case I do charge all my Mannors Messuages Lands Tenements Hereditaments and Real Estate by me hereinafter given to Francis Tribe of Oxenden Street in the Liberty of Westminster, gentleman, with such Legacy only as shall not be deemed charity or Charitable Donations, they having been hereinbefore charged on my personal Estate only

Also I do hereby Give devise and bequeath unto the said Francis Tribe all and every my Mannor Messuages Houses Farms Lands Tenements Wood Woodgrounds Hereditaments and real Estate not hereinbefore by me particularly given and bequeathed whatsoever and wheresoever with their and every of their Rights Members and Appurtenances to have and to hold the said Mannor Messuages Houses Farms Lands Tenements Wood Woodgrounds Hereditaments and real Estate unto him the said Francis Tribe his heirs and assigns for ever to and for his and their own use and benefit Subject nevertheless to such Annuities as I have charged thereon and to the payment of such Legacys duly as I have hereinbefore charged thereon

And I do hereby also Give and bequeath all and every my Goods, Chattels, Plate, Linnen, Household Goods and Furniture not hereinbefore specifically given, pictures, Jewells, Ready Money, Security for Money, mortgages in Fee or for terms of years with the lands and premisses therein comprized and all my Estate and Interest therein comprized and all my Estate and Interest therein, stocks in the publick Funds and Companys, all my personal Estate of what nature, kind or quality soever (and not herein by me specifically given) unto the said Francis Tribe to and for his own use and benefit, my Debts, Charitable Donations, Legacys and Funeral expences being by my Executors first paid and discharged

Upon Condition nevertheless that he the said Francis Tribe shall take upon him the Sirname of Poole and that he and the heirs of his Body shall ever after use the Sirname of Poole
and upon further Condition that he the said Francis Tribe shall marry one of the Daughters of the said George Carter in case he the said George Carter shall be consenting thereto upon Application being made to him the said Francis Tribe within Three months after my decease but in case the said Francis Tribe shall refuse to marry one of the daughters of the said George Carter in case the said George Carter shall be Willing and Consenting thereto
then and in either of the said Cases I Give and devise to the said John Gibson Son of the said Gibson of Sellinge aforesaid all and every my said Mannor Messuages Houses Farms Lands Tenements Wood Woodgrounds Hereditaments and real Estate hereinbefore given and devised to the said Francis Tribe his heirs and Assigns To have and to hold the said Mannor Messuages Houses Farms Lands Tenements Wood Woodgrounds Hereditaments and real Estate for ever and to and for his and their own use and benefit Subject nevertheless to the said Annuities I have charged thereon and to the payment of such Legacys only as I have before charged therein

And I do also give and bequeath all and every my Linnen, Household Goods and Furniture not hereinbefore specifically given, pictures, Jewells, Ready Money, Security for Money, mortgages in Fee or for terms of years with the lands and premisses therein comprized and all my Estate and Interest therein comprized and all my Estate and Interest therein, stocks in the publick Funds and Companys, all my personal Estate of what nature, kind or quality soever to the said John Gibson to and for his own use and benefit and which I have before given to the said Francis Tribe (upon the Terms and Conditions before mentioned) my Debts Charitable Donations Legacys and Fuenral Expences being first paid and discharged by my executors

And I do hereby nominate and appoint the said George Carter and Michael Botham Executors and Trustees of this my last Will and Testament and hereby revoking all former Wills or Codicils do declare (this) to be my last Will and Testament

In Witness whereof I the said Elizabeth Ludwell have to this my last Will and Testament contained in or writ on Eight Sheets of paper set my hand and affixed my Seal to this last Sheet thereof this Twenty eighth day of September in the year of our Lord One thousand seven hundred and sixty one.

A Codicil to be added to and be part of the last Will and Testament of Elizabeth Ludwell of Charing Widow

I Give and devise to George Carter Esquire over and besides what I have given him in and by (my) said Will all that the house together with the Coachhouse, Stable, Garden with all and singular the Appurtenances thereunto belonging and wherein I now dwell for and during the term of his natural Life and from and after his decease then I Give and devise the said dwelling house, Coach house, stable, Garden and Appurtenances thereunto belonging unto Miss Martha Carter, second daughter of the said George Carter and to her heirs and assigns for ever

And Whereas I have in and by my said Will given and bequeathed to Richard Mather son of John Mather of Biddenden, Clerk my Silver Chaffing Dish now I do hereby revoke the said Bequest to the said Richard Mather and I do hereby give and bequeath the said Silver Chaffing Dish to the said Martha Carter

Item I Give and bequeath to George Carter Son of the said George Carter the Sum of One hundred pounds
Item I Give to Mary Botham Daughter of Michael Botham my Silver Causard over and besides what I have given her by my said Will
Item I Give to Elizabeth Laker who lives with Mr. Hugessen the Sum of One hundred pounds

Item I Give to Edward Isted over and besides what I have given him in and by my said Will All my Messuages or Tenement and Farm wherein _____ Venner now dwells situate and being at Westwell Leacon together with the Lands and Appurtenances thereunto belonging and therewith used by the said _____ Venner To Hold to the said Edward Isted his Heirs and Assigns for ever

And Whereas I have in and by my said Will given and devised to Richard Pierce of Bath another Messuage Tenement Farm and Lands situate and being at Westwell in the parish of Westwell and in the possession of _____ Venner his Undertenants or assigns now I do hereby revoke the said Devise in my said Will to the said Richard Pierce his heirs and assigns of the said Messuage Tenement Farm and Lands in the possession of the said _____ Venner his heirs or Assigns
and I do hereby Give and Devise the said Messuage or Tenement Farm and Lands in the possession of the said _______ Venner his Undertenants unto John Gibson Son of _____ Gibson in my said Will named over and above what Share Given to the said John Gibson his heirs and Assigns for ever

And I do also hereby declare that my said Will in Writing and this Codicil which I shall be added and deemed part thereof do contain my last Will and Testament
In Witness whereof I have to this Codicil set my hand and Seal this twelfth day of September in the third year of our Soveraign Lord George the third by the grace of God of Great Britain France and Ireland, King Defender of the Faith and in the year of our Lord One thousand seven hundred and sixty three

This Will was proved at London with a Codicil the twenty fourth day of January in the year of our Lord One thousand seven hundred and sixty five before George Harris, Doctor of Laws and Surrogate of the Right Worshipful George Hay, also Doctor of Laws, Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oaths of George Carter Esqr. and Michael Botham the Executors named in the the said Will To whom Administration of all and singular the Goods Chattels and Credits of the said deceased was granted, they having been first sworn duly to Administer.

Elizabeth was the widow of John Ludwall, M.D. of Oxford. Elizabeth's father, George Poole of Charing, Gentleman left his principal mansion house in Charing to his daughter on his death in 1720. See his Will: George Poole of Charing, 1720, PROB 11/576/14.
John Ludwell was buried at All Saints, Oxford in 1724. See his Will: PROB 11/597/70, Dr. in Physick of the University of Oxford, dated 1724.
Elizabeth Ludwell was buried at SS Peter & Paul, Charing, Kent on 18 Jan 1765.
Thomas Smith, otp., Bachelor & Jane Coulter, otp., Spinster, were married at Charing by Licence on 19th February 1765 by me John Agge Stock, Curate. Both signed their names. Witnesses were: William Trelint? & Thomas Woolley.
