I give and bequeath unto my friend William Elgar of Dover aforesaid Draper All and every my Moneys and Securities for Money and all other my Goods Chattels and Effects whatsoever and wheresoever that I shall be possessed of interested in or entitled unto at the Time of my Decease To hold all the same to him the said William Elgar and to his Executors and Administrators Upon trust
in the first place that he the said William Elgar his Executors and Administrators shall and do as soon after my Decease as it can conveniently be done sell and dispose of all and every my said Estate and Effects not consisting of Moneys or Securities for Money for the most Money and the best Price he can at the time of the sale thereof obtain for the same and the Monies arising thereby togetherwith all other my said Monies shall and do place out on Government Securities in the Funds of this Kingdom in addition to what I shall have there at the time of my Decease my just Debts Funeral and Testamentary Expences being first thereout deducted And the Interest Dividends and Proceeds arising thereby Upon Trust
to pay and apply to my Mother Elizabeth Maddern and her Assigns for and during the Term of her natural Life as the same shall become due and be received by him my said Trustee his Executors and Administrators
And from and immediately after the decease of my said Mother Then upon Trust and I do give and bequeath all my said Stocks Funds Estate and Effects unto my Brothers and Sisters Thomas Charles Cherry Martin and Elizabeth equally to be divided between them share and share alike and to their several and respective Executors Administrators and Assigns
Provided always and it is my Will and Mind that in case any or either of my said Brothers and Sisters shall happen to depart this Life before my said Mother Then I give and bequeath the part and share parts and shares of him her and them so dying unto the Survivor of them equally to be divided between them share and share alike as aforesaid and to their several and respective Executors Administrators and Assigns
And I do hereby declare that the said William Elgar his Executors and Administrators shall not be answerable for any more Monies than he or they shall actually receive by virtue of this my Will nor for any Loss that may happen of my said Monies Estate and Effects so as the same shall happen without his or their wilful neglect or Default And that he or they shall and may keep and retain to himself or themselves all such Costs Charges and Expences he or they may sustain or be put unto in the Execution of the Trusts hereby in him or them reposed
And I do hereby nominate constitute and appoint the said William Elgar sole Executor of this my Will hereby revoking all former and other Wills by me at any time or times heretofore made and declare this to be my last Will and Testament
In Witness whereof I the said John Maddern the Testator have to this my last Will and Testament set my Hand and Seal the fourth
Day of September in the Year of our Lord One thousand seven hundred and ninety nine John Maddern his Mark X
