I Richard Marshall of Sandherst in the County of Kent Yeoman doe ordaine and make this my Last Will and Testament this Twentieth day of Januarie In the yeare of our Lord one thousand sixe hundred fifty five, being sicke in bodye but whole in minde and perfect in remembrance (praised be given to the Almightie alsoe) in manner and forme followinge
First and principally I Comend my Soule to God wch gave it trusting assuredly to have full and free remission of all my sinnes in & through the meritts and mediation of Jesus Christ my Saviour and Redeemer Alsoe I will my bodie to be buryed in the Churchyard at the discrecon of myne Executors herein after named Nowe as concerninge all the Worldlie goodes wherewith it hath pleased God to blesse me with my will and minde is it shalbe disposed of as followeth

Imprimis I give and bequeath unto Richard Marshall my sonne one house and one barne together with certaine peeces or parcells of land lyinge in the parish of Sandherst aforesaid nowe in the tennor and occupacon of Richard Marshall unto him and his heires for ever
Item more I give unto my said sonne Richard twoe partes of three of what shall remaine upon sale of my stocke of moveable goods whereas the Legacies herein after given and charges expended about my funerall and other Expences in provinge this my Last Will and the Lament shalbe deducted
Alsoe more I give unto my said sonne Richard one joyned Cupbord standinge in the hall, one highe joyned stoole, one great joyned Chest in the hall Chamber, one Truncke there, one plaine Chest, one brandiron, one great iron pott, one brasse pott, one Cast brasse Stepnett with Letters in the handle, one great Brasse candlesticke
More I doe give and bequeath unto my said sonne Richard one gold Ringe
All wch said severall perticulars of household stuffe my will and minde is shalbe delivered to my said sonne when he shall accomplish the age of one and twentye yeares untill which time my Will & minde is that my Executors shall have the benefitts and profitts of his house and land herein to him given for and towardes his education and bringeinge up, and they to take paye to keepe in the same tyme the buildinges well repayred and the fences and inclosures about the land well made and mainteyned

Item I give unto John Marshall my sonne my house and land in the parish of Tyseherst [Ticehurst] in the County of Sussex, nowe in the occupacon of Richard Fowle and Richard Havenden unto him and his heires forever

And my will and minde is that if either of my said twoe sonnes shall depart this life before hee accompishe the age of one and twentie yeares That then I doe give and bequeath his porcon both house and lands, household stuffe or othr Legacies whatsoever unto his Survivinge brother to bee Delivered unto him at his age of one and twentie yeares by mine Executors hereafter named

More I give and bequeath unto my said sonne John the third part of the moneys wch shall remaine upon sale of such moveables as are herein not bequeathed and receipted of such debtes as shalbe due unto mee as or after my decease after such Legacies as shalbe given ot of them be discharged and expences as aforesaid deducted
More I doe give and bequeath unto my said sonne John Marshall one gold Ringe and one highe joyned stole, one Little joyned Chest in the Hall Chamber and my Chest in the Kitchin Chamber, one great brandiron, one brasse Candlesticke All which said severall perticulers of household stuffe my will and minde is shalbee delivered to my said sonne John when he shall accomplishe his age of one and twentie yeares by myne Executors hereafter named Untill whch tyme my Will and minde is that my Executors shall have the benefitt and profitt of his said house & land therein to him given for and towards his education & bringing up, they takinge care to sea the buildings dureinge the said time well repayred and the land well inclosed and fenced

Item I give and bequeath unto Elizabeth my daughter the sume of one hundred poundes of Lawfull money of England To be paid unto her by myne Executors herein after named when shee shall accomplishe the age of Twentie yeares or day of marriage which shall first happen
And my will and minde is that her said porcn shalbe by myne Exeuctors layd out upon land to be by them purchased in her name and assured to her and her heires for ever
And in case she shall happen to depart this life before she accomplishe her said age of Twentie yeares or before her day of marriage without heires of her Bodie Lawfullie begotten Then my wil and minde is that her portion whether remayninge in money or layd out upon land shalbe equally devided betwixt her twoe brothers Richard and John Marshall

And my will and minde is that myne Executors hereafter named shall have and enjoye the use of my said daughters portion untill the tyme Lymitted for payment thereof for and towards her education and bringing up
Alsoe my will and minde is that if in Case Richard and John Marshall my twoe sonnes shall happen to departe this naturall life without heires of their body Lawfully begotten then or before the accomplishment of one and twentie yeares of age Item? then my will and minde is That my daughter Elizabeth Marshall shall have and receive all their houses buildings and landes with the thappurtennces to her and to her heires for ever wch are before menconed household stuffe or other Legacies whatsoever To be delivered unto her at her age of Twenty yeares or day of marriage which shall first happen by mine Executors hereafter named

Item I doe give and bequeath unto my said daughter one joyned Chest in the Kitchen Chamber, one highe joyned Stoole and one Lowe Joyned Stoole and the Truckle bedstedle with the bed thereon and all thinges appertayninge unto them? to be furnished as the discretion of myne Executors hereafter named More one brasse posnett, one brasse kettle, one milk kettle, one Joyned Cradle

Item I give and bequeath unto Elizabeth my welbeloved wife dureing the terme that she remayneth my widowe the one halfe of the rentes and profitts of the house and landes which I have herein given to my sonne Richard Marshall And the third parte of the Rents and profitts of the house and Landes which I have herein given to my sonne John Marshall
And my will and minde is that my said wife shall beare proportionably her part both in keepinge repayred the buildings upon each of my sonnes lands dureing the time she shall enjoye the profitts and benefitts out of them herein before to her given, and likewise the halfe of the Parliament taxes which shalbe imposed thereon from by me so by me soe Longe as she shall enjoye the said yearely rentes and profitts before given unto her

More I give and bequeath unto Elizabeth my Wife the bedsteddle and the bed furnished whereon I nowe lye And likewise and [one?] equall part of all the Lynnen in the house herein not before given or be equallie devided betwixt her and my Three children herein before named by the direction of myne Executors herefter named

More I doe give unto my said Wife All the residue of my houshold Stuffe herein not before given Allsoe twoe Silver Spoones, one Seame of Wheate, eight Bushells of mault, Tenne bushells of oates, one hogge, one pigge, one Cowe which she pleaseth to chuse and foster to keepe her untill May tyde next ensueinge, three gallons of butter, tenne Nayle of cheese, all the wood and faggotts about house, all the fruite about house, one axe, one handbill, one hoade, one shovell, one flitoke of baron, all the Lambes wooll in the house, one Quarter of fleece wooll

Item I give will & bequeath unto Thomas Marshall my brother Twelve pence
Item I give unto Rich: Johnson my brother Twelve pence
Item I give and bequeath unto Sarah Johnson Tenne shillinges
All to be paid by myne Executor within one yeare next after my decease

Item I give and bequeath unto the poore of the parish of Sandherst twentie shillinges these to be paid nione moneth after my decease by mine Executors
Alsoe my minde and will (is) That if in Case my three Children Richard, John and Elizabeth Marshall shall happen to depart this naturall life without heires or heire of their bodye or bodyes Lawfully to be begotten or before their accomplishments of day or dayes of age or day of marriage which are herein Specified Then I give and bequeath unto Thomas Marshall my brother All such houss, lands, household Stuffe and other Legacies whatsoever to be delivered unto him by myne Executors at such time as they shall have departed this naturall life after all such Legacies as are herein given out of this my will be discharged and Expences as aforesaid deducted

Item my minde and Will is in Case that my brother Thomas Marshall should depart this natural life without heires of his bodye lawfullie to be begotten Then I will and bequeath & alsoe my minde and will is that then my Sister Johnsons children Thomas and George Johnson and twoe other Children shall have and receive all such houses landes (and) houshold Stuffe to be delivered unto them by myne Executors equally to be devided betwixt them fowre children And in Case any of those fowre Children happen to depart this naturall life Then my mind and will is that the Survivors or Survivor shall have that portion or portions equally to be devided First and principally all Legacies which are herein given and all charges and funerall expences whatsoever to be discharged and deducted as aforesaid

Whereas there did happen a disaster to the Register Booke of the parishe of Tysehurst I have therefore published and specified their severall ages my sonne Richard Marshall was borne in the yeare of our Lord one thousand sixe hundred thirty one July the sixth; my sonne John was borne in the yeare of our Lord one thousand sixe hundred fortie foure Aprill the eight day, & my daughter Elizabeth was borne in the yeare of our Lord one thousand six hundred fortie seaven Mary the Sixth day

This is the Last Will and Testament of me the said Richard Marshall made and declared the day and yeare first above written on three sheetes of paper whereof I doe make and ordeyne Thomas Fowle and John Potter of Sandherst joynt Executors hereby revoakinge all former Wills by me at any time made or declared

This Will was proved at London the eighteenth day of June in the yeare of our Lord God one thousand sixe hundred fiftye sixe before the Judges for probate of Wills and grauntinge administracons lawfully authorized by the oathe of Thomas Fowle and John Potter joynt Executors named in the last will and Testament of the said deceased To whome administracon was comitted and they beinge by vertue of a Commission first legully sworne trulie to administer.

Notes:
A “seame” of wheat was a measure of grain. There were 8 Bushells to a Seame – or a horse-load.
A Nayle of cheese – was again a measure – being about 8 pounds in weight.
