First I direct all my just debts and funeral and testamentary expences to be paid and satisfied as soon as conveniently may be after my decease
And I bequeath to my Wife Elizabeth during her Life an Annuity or clear yearly sum of thirty five pounds sterling the same to be paid by
equal half yearly payments and the first half yearly payment thereof to made at the end of the first half of a year which shall happen after my
decease
And I direct my Executors hereinafter named as soon as conveniently may be after my decease to set
apart and appropriate a sufficient sum of money the interest or dividends whereof will at the time of
such appropriation be sufficient to answer and pay the said Annuity
And subject thereto I bequeath all the Personal Estate to which I shall be entitled at my decease unto my Children Mary Sutton (Widow of John Sutton deceased); Thomas Marshall; Mark Marshall; Edward Marshall and Sarah the wife of Edward Stickells; and my son in Law and Nephew Thomas Sutton in equal shares as tenants in Common
Provided that the Sum of two hundred and eighty three pounds nineteen shillings which I have advanced to or for the benefit of my said Daughter Mary Sutton and the Sum of Five hundred and fifty four Pounds fourteen shillings which I have advanced to or for the benefit of my said Son Thomas Marshall and the sum of Seventy two Pounds twelve shillings which I have advanced to or for the benefit of my said Son in Law and Nephew Thomas Sutton shall be accounted for and paid or allowed by them respectively on the division of my estate
And I appoint my said Son Thomas Marshall and my said Son in Law and Nephew Thomas Sutton Executors of this my Will
And I devise to them all such real Estates (if any) as at the time of my decease shall be vested in me by way of mortgage Subject to the
Equities affecting the same
And I revoke all former Wills
In Witness whereof I have hereunder set my Hand this thirteenth day of December in the Year of our Lord One thousand eight hundred and forty three

The before registered Will of John Marshall deceased was proved the Twenty eighth day of February 1846 before the Reverend John Pechey Francis, Clerk, Surrogate to the Worshipful Sherrard Beaumont Burnaby, Doctor of Laws, Official General to the Reverend the Archdeacon of Canterbury, lawfully constituted by the Oaths of Thomas Marshall Son of the deceased and Thomas Sutton Nephew of the deceased the Executors named in the said Will They being first sworn duly to perform the same

John Marshall, aged 80, was buried at St. Mary the Virgin, Hastingleigh on 31 Dec 1845.
He married Elizabeth Austen 20 Sep 1818 at St. Mary the Virgin, Crundale, Kent.
