In the Name of God Amen the twenty seventh day of May one thousand eight hundred & forty
I William Martin of East Peckham in the County of Kent Yeoman being of sound mind and memory do make this my last Will and Testament in form and manner following
First at my decease I desire my body to be decently buried and the funeral expences to be paid from my property

Secondly I give and bequeath to my dearly beloved Wife the whole of my property and Effects until my Son William Martin arrives unto his twenty first year of his age with the exception of the conditions hereinafter mentioned when my Son aforesaid William Martin shall attain his fourteenth year of age the Ex[ecut]ors shall be empowered to draw from the aforesaid property the sum of thirty pounds in current Coin to put him an apprentice

Thirdly when my Son William Martin shall attain his twenty first year of his age he shall take possession of all my property with the exception of half the Effects which other half I give unto my beloved Wife for own use and my Son William Martin when he shall take full possession shall keep my Wife Ann Martin with provision and sufficient clothing or to allow her from my property 4 shillings weekly and every week during her natural life

I allow my Wife Ann Martin power to choose which she may please viz. to live with my Son William Martin or to demand the aforesaid four shilling weekly And at her decease, to bury her in a becoming manner
4ly If my Son William Martin shall die before he attain his twenty first year of age my said Wife Ann Martin shall retain and keep the whole of my property

If it shall happen that my aforesaid Wife Ann Martin and my Son William Martin shall both die before my Son William Martin arrives at his twenty first year of his age the whole of my property shall be equally divided between my Wife’s 4 children, vizt. Benjamin Beadle, Sarah Mills the Wife of Hezekiah Mills, Elizabeth Beadle & Mary Beadle

5ly My Son William Martin shall be provided by my Wife from my property with sufficient food and clothing until he is fourteen years of age & also clothe him during his Apprenticeship
6ly Should my Wife die before my Son William Martin attains twenty one years of his age, the half of the Effects shall be equally shared between her 4 aforesaid children when he attains his twenty first year

Lastly I do constitute and appoint John Wood of East Peckham Bricklayer and Hezekiah Mills Tanner of the aforesaid place Executors of this my last Will and Testament hereby revoking and annulling all and every other Will or Wills heretofore by me made do declare this to be my last Will and Testament

Signed sealed published and declared by the said William Martin as and for his last Will and Testament in the presence of us who at his request and in the presence of each other have subscribed our names as Witnesses thereto

In the Prerogative Court of Canterbury : In the Goods of William Martin, deceased
Appeared Personally William Diprose of East Peckham in the County of Kent Carpenter and made oath that he is one of the attesting Witnesses to the last Will and Testament of William Martin late of East Peckham in the County of Kent Yeoman deceased which will is now hereunto annexed and begins thus:
“In the Name of God Amen the twenty seventh day of May one thousand eight hundred & forty I William Martin of East Peckham in the County of Kent Yeoman”
and ends thus: “In Witness whereof I have hereunto set my hand the day and year above written” and is thus subscribed: “The mark of William Martin X”
and having now with care and attention viewed and perused the said Will and more particularly observed the before recited signature or mark thereto further made oath that he was present at the Execution thereof by the said Testator to wit on the twenty seventh day of May one thousand eight hundred and forty being the day of the date of the said Will and that there were also present Edward Scoones and John Draper his fellow subscribed Witnesses thereto and that the said Testator did then set and subscribe his said Mark at the foot or bottom of the said Will in manner and form as the same now appears and that such mark was made by the said Testator in the presence of this deponent and the said Edward Scoones and John Draper and that he then declared the same to be his will and requested this Dep[onen]t and the said Edward Scoones and John Draper to sign their names thereto as Witnesses which they accordingly did in manner and form as the same now respectively appear in the presence of the Testator and of each other

On Saturday the 10th day of October 1840 the said William Diprose was duly sworn to the truth of this Affidavit before me John Danbury, Surr[ogate] - Pres[en]t Fred. Clarkson, Not[ary] Pub[lic]

Proved at London 14th October 1840 before the Worshipful John Danbury, Dr. of Laws and Surrogate by the Oaths of John Wood and Hezekiah Mills the Ex[ecut]ors to whom Adm[inistrati]on was granted having been first sworn duly to administer. Exd.

Notes
William Martin, Bachelor and Ann Beadel, Widow, both o.t.p., were married after Banns on 1st May 1832 at St. Michael, East Peckham, Kent. Witnesses were: Thomas Saunders and Mary Saunders, by their marks (X), and William Durtnall.
