First I give unto and to the use of my Executors hereinafter named and their Heirs and Assigns all my messuages Lands and tenements hereditaments and Real Estate whatsoever and wheresoever with the appurtenances Upon Trust that they my said Executors or the Survivor of them or the Heirs and Assigns of such Survivor shall and do after my decease as conveniently maybe sell dispose of convey all my said my messuages Lands tenements hereditaments and Real Estate with the appurtenances in such parcels as they shall think fit and to and to the use of any person or persons and his her or their Assigns forever for the best price or prices that can be reasonably got for the same and shall and do receive and give a Receipt for the purchase monies thereof. And my will is that the Receipt or Receipts of my said Trustees or the Survivor of them his Heirs or Assigns shall at all times be good and effectual acquittances and discharges to the purchaser or purchasers of my said Real Estate or any part thereof for the purchase monies for which such Receipt or Receipts shall be given. And that from and after such Receipt or Receipts shall be given the purchaser or purchasers of my said Real Estate or any part thereof shall not be accountable or answerable for any loss misapplication or non application of such purchase monies or any part thereof.
And I appoint the Reverend HARVEY of the Parish of St. Lawrence in the Isle of Thanet in the said County Clerk and JOHN ELGAR the Elder of the Parish of Wingham Yeoman Executors of this my last Will and Testament.
I give and bequeath unto my Son JOHN MATSON and my Daughter JUDITH wife of the said RICHARD HARVEY the sume of two hundred pounds of lawful money of Gt. Britain apiece to each of them.
Also I give to the said JOHN ELDER this Executors Administrators and Assigns to his and their own use and benefit all my Leases Term and Terms of years and Interest whatsoever of and in the several messuages parsonages Titles Lands tenements and premises whatsoever which I now hold of the Right Honourable Earl COWPER and Mrs COSNAN Of Wingham aforesaid or either of them to hold to the said JOHN ELGAR from the tenth Day of October next after my decease under and subject to the Rents Covenants and Agreements from thenceforth on my part to be paid and performed. And my desire is that the said JOHN ELDER shall and may take and buy all the stock both living and dead which shall be on the said farms and premises at my decease he paying for the same within such convenient time as my said other Executor shall approve of, the value thereof to be ascertained by the appraisement of proper persons to be for that purpose appointed by my said Executors.
And as for concerning the amount of such appraisement and all the Rest and Remainder of my Monies Securities Stocks in the Public Funds plate linen household furniture effects goods chattels and Personal Estate whatsoever and wheresoever (after payment of my just Debts and Funeral Charges) together with the Monies to arise by the sale of my Real Estate I give and bequeath the value and every part thereof to my said Son JOHN MATSON and my three Daughters the said JUDITH HARVEY MARY wife of ROBERT KEELER and ANN Wife of BENJAMIN SAYER equally to be divided between them share and share alike.
And my Will further is that it shall and may be lawful to and for my said Executors and Trustees to deduct and reimburse themselves out of the monies that shall come to their Hands by virtue of this my Will all such losses costs charges and expenses as they or either of them shall sustain pay or be put to in or about the Execution of the said Trusts or anyway concerning this my Will. And that they or either of them shall not be answerable or accountable for any loss or damage which shall or may happen to the said Trust Monies and Premises without their respective willful default or any Bank or Banker or other person with whom such monies or any part thereof shall be deposited for safe custody or any person or persons employed by or acting under them.
Neither shall one of them my said Executors be answerable or accountable for the other of
them or for the Receipts Payments Acts and Defaults of the other of them (notwithstanding their
joining in Receipts for conformity but each of them for his own Receipts Payments and Acts) and defaults only.
And I do hereby revoke all former Wills by me made.
In Witness whereof I have to each of these two sheets of paper (which together contain my Will) set my Hand and Seal this tenth Day of May in the twenty fifth year of the Reign of Our Sovereign Lord George the third by the Grace of God of Gt. Britain France and Ireland King Defender of the Faith and so forth and in the year of Our Lord 1785. JUDITH MATSON
