Will of Elijah Mockett

of Thanet St. Peter, Kent

First I give and devise unto my Sister Elizabeth Sampson Widow for the term of her life All that my Messuage or Tenement and the outhouses buildings yard garden and one acre of land thereunto belonging with the appurtenances situate lying and being at or near Reading Street in the said Parish of Saint Peter the Apostle and now in several tenures or Occupations of her my said Sister and of her Son John Sampson or of their respective Assigns

And from and after her decease I give and devise the same Messuage or Tenement Land and Premises with the appurtenances unto my son Elijah Mockett if he shall survive the said Elizabeth Sampson for and during the term of his natural life
And from and after his decease I give and devise the same Messuage or Tenement Land and premises with the appurtenances unto my son John Mockett his Heirs and Assigns for ever.

Also I give and devise unto my son Elijah Mockett and his assigns for and during the term of his natural Life All that my Messuage or Tenement and Farm and the outhouses buildings yard garden orchard and Lands thereunto belonging containing by estimation nine acres more or less with the appurtenances situate and being in the said Parish of Saint Peter the Apostle at or near a certain place there called Rumfield Gap and now in the tenure or occupation of Henry Strivens or his assigns
And also all those my two messuages or tenements and the gardens thereunto belonging with the appurtenances (except a certain piece or parcel of arable land containing by estimation three acres thereunto adjoining hereinafter devised to my son John Mockett and his heirs) situate at or near Fair Street in the said Parish of Saint Peter the Apostle and now or late in the several tenures or occupations of Stephen Young and the Widow Gibbons or of their respective assigns

And from and after his decease I give and devise the same Messuages or tenements and land except as aforesaid with the appurtenances unto my said son John Mockett his heirs and assigns for ever
he and they paying within three calendar months next after the death of the said Elijah Mockett the sum of one hundred and fifty pounds a piece of lawful money of Great Britain to his sisters Elizabeth the wife of Edward Boys and Mary the wife of the Reverend Henry Lloyd if they shall be living at the death of my said son Elijah Mockett but not otherwise

I give and devise to Elizabeth Kerby Widow for the term of her life All that my messuage or tenement wherein she now dwells with the appurtenances situate in or near Saint Peter�s Street in the said parish of Saint Peter the Apostle and from and after her decease I give and devise the same messuage or tenement with the appurtenances to my said son John Mockett his heirs and assigns for ever

And I give and devise All that my messuage or tenement and Farm and the outhouses buildings yard garden orchard and lands thereunto belonging with the appurtenances situate lying and being at or near Beards Hill in the said Parish of Saint Peter the Apostle now in my own occupation and which I purchased of John Church Brazier and Mary Huggett Widow respectively
And all that my piece or parcel of Arable Land with the appurtenances lying and being at or near Fair Street aforesaid in the said Parish of Saint John the Apostle and now in my own occupation adjoining to the messuages and premisses there hereinbefore devised to my son Elijah Mockett for his life
and all other my messuages lands tenements hereditaments and Real Estate whatsoever and wheresoever not herein before devised or disposed of with all and singular the appurtenances thereof respectively unto my said son John Mockett his heirs and assigns for ever

Provided always nevertheless and I do hereby subject and charge my said messuage or tenement farm and lands at or near Beard�s Hill aforesaid to and with the payment of one Annuity or yearly rent charge of Twenty four pounds of lawful money of Great Britain (clear of taxes and all other deductions whatsoever) into the hands of my said son Elijah Mockett (but not to any person or persons to whom he shall assign the same) for and during the term of his natural life by equal quarterly payments on Lady Day [Midsummer Day] Michaelmas Day and Christmas Day according to the Old Stile the first of which payments shall be made on such of these days as shall first happen after my decease

And if the said annuity or any part thereof shall be behind and unpaid by the space of thirty one days next after any of the said Days of payment thereof Then I give full power and authority to my said son Elijah Mockett his executors and administrators to enter into and upon the said Messuage Farm and Lands charges therewith as aforesaid and to distrain for all arrears of the same annuity and the distress and distresses then and there to be found to dispose of as the law directs in case of distress for rent in the said annuity and all costs and charges of every distress shall be fully paid and satisfied

And whereas I am now possessed of a Security from the Commissioners of the Pax? and Pavement of the Town of Margate for the payment? of the sum of Three Hundred Pounds with interest for the same at the rate of five pounds per centum per annum Now I do hereby give and bequeath the said security and all monies at my decease due and to become due in respect thereof unto my said son John Mockett his Executors and Administrators to his and their own use and benefit
Provided always and upon this Condition that he my said son John Mockett his executors and administrators shall at all times after my decease well and truly pay or cause to be paid to my niece Sarah Mockett and her assigns during her life the same annuity or yearly sum of nineteen pounds as I am now bound to pay to her or them for her life and in the same proportions and manner and shall fully indemnify my other executors and my .... Real Estates and every part thereof respectively from the payment of the same And from all costs and charges to be occasioned by the non-payment thereof

And as for and concerning all the residue of my monies securities for money stocks in the Public Funds household furniture plate linen effects goods chattels and Personal Estate whatsoever after and subject to the payment of all my just debts (except my Bond for the payment of the aforesaid Annuity to the said Sarah Mockett) and of my Funeral Charges I give and bequeath the same to my said sons Elijah Mockett and John Mockett my said daughter Elizabeth Boys and my said daughter Mary Lloyd equally to be divided between them share and share alike

Nevertheless my will is that my said son John Mockett shall be at Liberty if he shall so think fit to purchase and take all my household furniture plate and household linen at a fair valuation thereof to be made by two indifferent persons the one to be named by him and the other by my other executors

And I do appoint my brother in law Nicholas Pegden of Margate aforesaid Gentleman Edward Boys of Salmstone Grange in the said Isle of Thanet Gentleman and my said son John Mockett Joint Executors of this my last Will and Testament
And I do hereby give to each of them my said Executors the sum of Ten Pounds for their trouble in the Execution of this my Will

And I do hereby revoke all former Wills by me made In Witness whereof I have to each of these three sheets of paper (which together contain my Will) set my Hand and seal this Sixteenth day of September in the thirty fifth year of the Reign of our Sovereign Lord King George the third And in the year of our Lord One thousand seven hundred and ninety five. Signed and sealed by the Testator Elijah Mockett and by him published and declared as his last Will and Testament in the presence of us who here subscribe our names in his presence and at his request

Whereas in and by my above Will I have given and devised unto my son Elijah Mockett and his assigns for and during the term of his natural life a messauge or tenement in Reading Street in case he shall survive my sister Elizabeth Sampson and also a messuage or tenement and farm at Rumfield Gap and my two houses at fair Street with the appurtenances Now I do hereby revoke and make void the devise to my said son Elijah Mockett

And I do hereby give and devise the said messuage at Reading Street after the death of the said Elizabeth Sampson and my said messuages at Rumfield Gap and Fair Street with the appurtenances unto the above mentioned Nicholas Pegden and Edward Boys and the survivor of them and the heirs and assigns of such survivor during the natural life of my said son Elijah Mockett In Trust by? and out of the rents and profits of the said messuages lands and hereditaments to keep the said premises in good and tenantable repair and to account and pay the neat produce of the rents and profits of the said messuages lands and tenements unto the said Elijah Mockett during his natural life And my will is that the clear surplus of the rents and profits shall be paid only to the said Elijah Mockett into his own hands

And I do hereby will and declare that in case he shall assign or make over his interest therein to any person or persons whomsoever in any pretence whatsoever then the devise hereinbefore made thereof to the said Nicholas Pegden and Edward Boys shall cease and be void And from and immediately after such assignment I do give and devise the same messuages lands and hereditaments unto my son John Mockett his heirs and assigns for ever in the same manner as he will be entitled to the same by virtue of the above Will after the death of my said son Elijah Mockett

And whereas by my above Will I have given and bequeathed the residue of my personal Estate and effects to my sons Elijah Mockett and John Mockett and my daughters Elizabeth Boys and Mary Lloyd equally to be divided between them share and share alike Now I do hereby revoke and make void the said bequeat so far as relates to the said Elijah Mockett
And I do give the said residue of my said Personal Estate to my said son John Mockett and my said daughters Elizabeth Boys and Mary Lloyd (subject to the option given to my said son John Mockett to purchase any part thereof) they the said John Mockett Elizabeth Boys and Mary Lloyd paying unto my said son the sum of four shillings per week during his natural life such sum to be paid and payable at the dwelling house of my said daughter Elizabeth Boys every Monday morning into the hands of the said Elijah Mockett only and to be void in case he shall assign or make over the same to any person or persons whomsoever

And I give and bequeath to my grandson John Boys the sum of fifty pounds and to my grandson Mockett Henry Lloyd the like sum of fifty pounds and to each of my Executors named in my said Will the sum of twenty pounds for their trouble in lieu of the legacy of ten pounds given by my said Will
And I do in all other respects confirm my said Will to which I desire this may be considered as a Codicil

Witness my hand and seal this twenty second day of October one thousand seven hundred and ninety six. Knight Doctor of Laws Official General to the Archdeacon of Canterbury lawfully constituted by the oaths of Nicholas Pegden Edward Boys and John Mockett the son the Executors named ...
