I leave and bequeath unto my dear wife Ann Morphett the Household Furniture Plate China and Linen which shall be in my dwelling House at the time of my decease
I also leave direct and bequeath unto my said dear Wife and unto Edward Winser of
Tenterden aforesaid Grocer and Thomas Morphett of the same place Grazier
my Executors and Executrix hereafter named All the Estate and Effects whether
Real personal or otherwise whereof I shall die possessed Upon the Trusts
nevertheless and to and for the intents and purposes hereafter mentioned (that
is to say)
In Trust that they my said Executors shall and will permit and suffer
my said wife Ann Morphett to use occupy and possess the same and receive
and take the rents Issues and profits thereof for and during her natural life
and from and after her decease then I give devise and bequeath the same unto my
two Daughters Ann and Mary Morphett and any other Child or Children which I
the said John morphett may have at the time of my decease to be divided
between them share and share alike
But in Case of death of my said Wife
before my said Children shall have respectively attained the ages of twenty one
years then I give devise and bequeath the said Estate and effects unto the said
Edward Winser and Thomas Morphett and the survivor of them upon Trust that
they the said Edward Winser and Thomas Morphett or the Survivor of them
shall and will take and receive the Rents Issues and Profits thereof and pay and
apply the same towards the Maintenance and Education of my said Children
during their Minority and the Surplus thereof (if any) to be paid and divided
between my said Children when they shall have respectively attained the age of
twenty one years
And I do hereby nominate and appoint my said wife Ann morphett and the said Edward Winser and Thomas Morphett Executrix and Executors of this my Will and hereby annulling all other and former Wills by me heretofore made I declare this to be my last Will and Testament
In Witness whereof I have to this my Will contained on one sheet of paper set my hand and
seal this twenty fifth day of April One thousand eight hundred � The Mark of the
said X John Morphett Junr. (Seal) � Signed Sealed Published and Declared by
the said Testator as and for his last will and Testament in the presence of us
who in his presence and in the presence of each other have subscribed our
names as witnesses thereto the Testator being unable to subscribe his name
affixed his Mark thereto �

This Will was proved at London the twenty sixth day of March in the year of our Lord One thousand eight hundred and two before the Right Honourable Sir William Wynne Knight Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oaths of Ann Morphett Widow the Relict of the deceased Edward Winser the Younger and Thomas Morphett the Executors named in the said will to whom Administration of all and singular the Goods Chattels and Credits of the said deceased was granted having been first sworn by Commission duly to Administer
