In the Name of God Amen I Amy Mourilyan Widow and Relict of Samuel Mourilyan late of the Town and Borough of Deal in the County of Kent Mariner do make publish and declare this my last Will and Testament in manner and form following (that is to say)

I Give and bequeath the Sum of Five pounds of Lawfull Money of Great Britain unto the Maid Servant that shall be in my service at the time of my decease
I also give and bequeath the Sum of Five pounds apiece of Like Lawful Money to my Executors herein after named

Also I Give devise and bequeath all and every of my Messuages Lands Tenem[en]ts Heredit[ament]s Moneys, Securities for Money, Household Furniture, Goods, Chattels, Rights, Credits and Real and personal Estate whatsoever and wheresoever Subject to the payment of all my Just Debts, Legacys and Funeral Expences unto my two Sons Samuel Mourilyan and John Mourilyan and the Survivor or longer Liver of them and the Heirs Executors adm'ors and Assigns of such Survivor or longer Liver of them To and for his and their own proper Use and behoof forever in case they or either of them shall live to attain the full age of twenty one years whilst they shall both Live to and for their equal use behoof and benefit

but if they shall both die under the said Age of twenty one years then and in that case

I Give and bequeath the Sum of Eight hundred pounds of Lawfull Money of Great Britain (being Four hundred pounds apiece) bequeathed to them my said two Sons on their attaining the Age of Twenty one Years by my said Late Husband Samuel Mourilyan (If I have or shall have or be Intitled unto any Rights or Power to Give and bequeath the same and not otherwise) unto
Elizabeth and Margaret the two Daughters of my late Husbands Brother John Mourilyan;
Thomas the Son and Mary and Susanna the two Daughters of my late Brother Thomas Mourilyan;
and Joseph the Son and Elizabeth and Mary the two Daughters of my said late Husbands Brother Joseph Mourilyan
,
equally to be divided between them share and share alike

And all my Messuages , Lands, Tenements, Heredit[ament]s, Moneys, Securities for Money, Household Furniture, Goods, Chattels, Rights, Credits and Real and personal Estate whatsoever and wheresoever Charged and Chargeable with the said several Legacies or Sums of Five pounds and Eight hundred pounds in case the same shall be deemed part of my Estate and payable according to the Tenor of this my Will and my said just Debts I Give devise and bequeath unto
my Four Brothers Robert Hayman, Lancelot Hayman, Thomas Hayman and William Hayman
and my two Sisters Elizabeth Chambers of Faversham Widow and Susanna the Wife of William Verrier of the said Town and Borough of Deal
and Richard Son of my said Sister Elizabeth Chambers

their several Heirs Executors Adm'ors. and assigns for ever equally to be divided amongst them share and share alike as Tenants in Common and not as Joint Tenants

And I do hereby Nominate and Appoint my said Brothers Lancelot Hayman and Thomas Hayman and my said late Husbands Brother Joseph Mourilyan Executors of thus my Will
And my true Intent and Meaning is that my said Executors shall not be any ways answerable Chargeable accountable with or for any Involuntary Loss or deficiency of my said Moneys and Estate or any part thereof nor one for another nor for the Acts deeds defaults Receipts payments and disbursements of another of them

And I do hereby revoke all former Wills by me at any time heretofore made
In Witness Whereof I the said Amy Mourilyan the Testatrix have to this my Last Will and Testament contained in three sheets of paper set my hand and seal in manner following (that is to say) my hand to the first two sheets thereof and to this last sheet my hand and Seal this twenty second day of March in the Eleventh Year of the Reign of our Sovereign Lord George the third by the Grace of God of Great Britain France and Ireland, King, Defender of the Faith and so forth and in the year of our Lord One thousand Seven hundred and Seventy one

Signed sealed published and declared by the said Amy Mourilyan the Testatrix as and for her last Will and Testament in the Presence of us who have subscribed our Names as Witnesses hereunto in her presence and at her request

This Will was proved at London the twenty sixth day of August in the year of our Lord One thousand Seven hundred and Seventy One before the Right Worshipful George Hay Doctor of Laws, Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oaths of Lancelot Hayman and Thomas Hayman the Brothers of the deceased and two of the Executors named in the said Will to whom administration was granted of all and singular the Goods Chattels and Credits of the said deceased they having been First sworn by Commission duly to administer
Power reserved of making the like Grant to Joseph Mourilyan the other Executor named in the said Will when he shall apply for the same

Notes:
Samuel Mourilyan, Widower of Deal, married Amy Hayman, Spinster of Deal at St. Leonard, Deal on 15th July 1758. Witnesses were: Robert Hayman, Elizabeth Longley.
Samuel Mourilyan of Deal had been married previously to Susanna Longley of St. Lawrence (in the Isle of Thanet, Kent) by Licence on 16th February 1750(1) at Christ Church Cathedral, Canterbury. Susanna Mourilyan’s death/burial has not been found anywhere.
The only children found are of the Amy’s marriage, christened at St. Leonard, Deal:
Samuel, 30 Oct 1759; and John, 25 Nov 1760.
