In the Name of God Amen The twenty fourth day of February in the year of our Lord according to the Church of England as it is Computed One thousand seven hundred Twenty Eight
I William Savage of the Parish of Chatham in the County of Kent Bricklayer being Elderly and Infirme in body but of sound mind memory and understanding (praise be therefore given to Almighty God for it) and I now considering the frailty of all Flesh and the uncertainty of this Transitory Life do make and ordaine publish and declare this to be my last Will and Testament in manner and forme following (That is to say)
First and most principally I Commend my Soul to Almighty God my Creator that gave it hoping that through the Meritts Death and Passion of my ever blessed Saviour Jesus Christ to obtaine full and free pardon and forgiveness of all my Sins and to Inheritt everlasting Life and my Body I Committ to the Earth to be decently buryed according to the direcons [directions] and appointment of my Executors and Trustees hereinafter named and as for touching and concerning the disposition of all and Singular my Temporall Estate which it hath pleased Almighty God to bestow upon me I give devise bequeath and dispose thereof as followeth my debts and Funerall Expences whatsoever they be being first paid and discharged

Imprimis to my two daughters Elizabeth Wife of James Tapley of Gillingham in the said County Shipwright and Martha the Wife of Richard Edwards of Chatham aforesaid Shipwright and to my two Granddaughters Susanna Brissenden of Chatham aforesaid Spinster and Mary Brissenden of Chatham aforesaid Spinster I give devise and bequeath all those my Three Freehold messuages or Tenements adjoining or being near together with their severall Yards Backsides Gardens Ground and appurtenances thereunto belonging or therewith commonly letten used Occupyed or Enjoyed Scituate lying and being in the said parish of Gillingham in Westcourt or Brompton Street there or in one of them and now or late in the Tenure or Occupation of the Widow Powell Robert Chapman and ... blank ... King or one of them their or one of their assignse or assigns undertenant or undertenants

To hold unto them the said Elizabeth Tapley Martha Edwards Susanna Brissenden and Mary Brissenden as Tenants in Comon and not as Joynt Tenants (they from time to time maintaining and keeping the said severall Messuages or Tenements in good and sufficient Repair and to Committ no Wast thereon) To be divided between them in maner and forme following (that is to say)

One full and undivided third part (the whole to be divided into three parts) of the said Messuages or Tenements and Premises the Rents and Profitts thereof I give devise and bequeath unto my said Daughter Elizabeth Tapley during her naturall Life and from and after her decease Then to my Three Grandchildren Martha Tapley William Tapley and James Tapley her Children as Tenants in Common nd not as Joynt Tenants and to their heirs and assignes for ever
But if any of them shall happen to depart this Life before they attaine the age of one and Twenty years or having lawfull Issue Then my Will is That such share or shares proportionally shall goe to the Survivors or Survivor of them and to his her or their heirs and assigns for ever

One other undivided third part of the said Messuages or Tenements and Premisses the rents and profitts thereof I give devise and bequeath to my said Daughter Martha Edwards during her naturall Life and from and after her decease then to my Grandchildren William Edwards and Elizabeth Edwards her two Children as Tenants in Comon and not as Joynt Tenants and to their heirs and assignes for ever But if either of my said two Grandchildren shall happen to depart this Life before either he or she shall attaine the age of one and Twenty years or have lawfull Issue Then my Will is that such share or proportion shall goe to the Survivor of them and to his or her heirs or assignes for ever

The Third and last undivided third part of the said Messuages or Tenements and premisses the Rents and profitts thereof I give devise and bequeath unto my said Two Grandaughters Susannah Brissenden and Mary Brissenden Daughters of my Daughter Mary Brissenden of Chatham aforesaid Widow deceased their heirs and assignes for ever
But if either of them shall happen to depart this Life before they attaine the age of One and Twenty years or have lawfull issue Then my Will is That such share and proportion shall goe to the Survivor of them and to the heirs of such Survivor

Item I will and direct that the alley way and well with their appurtenances as they are now and have been heretofore used in Common by the severall Tenants and Occupyers [Occupiers] of the severall Messuages or Tenements aforesd. [aforesaid] shall always in like manner be continued to be used in Common and the Charges of repairing maintaining keeping and amending the same shall be paid and borne according to the number of tenants of Each or such person in whose hands the said Messuages or Tenements and premisses shall happen into in an equall proportion

Item to my two said Grandaughters Susannah Brissenden and Mary Brissenden I give devise and bequeath all that my one other Freehold Messuage or Tenement lately used as a Publick Victualling House and called or known by the Name or Signe of the Bull-head with the yard Backside and Garden and their Appurtenances thereunto belonging or therewith commonly letten used Occupyed and Enjoyed Scituate lying and being in the said Parish of Chatham in a Street there commonly called or known by the name of Queen Street * and now or late in the Tenure or Occupation of Elizabeth Emms Widow her assignee or assigns Undertenant or Undertenants

To hold to them the said Susanna Brissenden and Mary Brissenden as tennants in Common and not as Joynt tenants They from time to time Maintaining and keeping the said Messuage or Tenement and premisses in good and Sufficient repair, and to committ no wast thereon, the rents and profitts thereof to be divided between them share and share alike and their heirs and assigns for ever But if either of them shall happen to depart this Life before they attaine the age of one and Twenty years or have Lawfull Issue Then my Will is That such share and proportion shall goe to the Survivor and to the heirs and assigne of such Survivor

Item to my said two Daughters Elizabeth Tapley and Martha Edwards and my two Grandaughters Susanna Brissenden and Mary Brissenden I give devise and bequeath all that my one other Freehold Messuage or Tenement now used as a Publick Victualling House commonly called or known by the name or Signe of the Golden Fleece * and all those an all those other four small Messuages or Tenements with their severall yards Backsides and Gardens and Outhouses and Stable thereunto severally belonging
And also all that one peece or parcel of pasture Land adjoining to the back part of the said severall Messuages or Tenements with their and every of their appurtenances thereunto belonging or therewith letten used Occupyed and Enjoyed Scituate lying and being in the parish of Gillingham aforesaid Fronting the Highway leading up to Beaken Hill and now or late in the severall tenures of Occupations of George Cowwood (½ line blank) their Assignee or assignes undertenant or undertenants To hold unto them the said Elizabeth Tapley Martha Edwards Susanna Brissenden and Mary Brissenden as Tenants in Common and not as Joynt Tenants they from time to time maintaining and keeping the said severall Messuages or Tenements in good and Sufficient Repair and committ no wast thereon to be divided between them in three parts in manner and forme following (that is to say)

One full and undivided third part the whole to be divided into three parts of the said Messuages or Tenements Lands and premisses the rents and profitts thereof I give devise and bequeath unto my said Daughter Elizabeth Tapley during her naturall Life and from and after her decease then to my three Grandchildren Martha Tapley William Tapley and James Tapley her Children as Tenants in Common and not as Joynt Tenants and to their heirs and assignes for ever But if any of them shall happen to depart this Life before they attaine the age of one and Twenty years or have lawfull issue Then my Will is that such share or shares proportionably shall goe to the Survivors or Survivor of them and for his her or their heirs and assignes for ever

The other full and last undivided third part of the severall Messuages or Tenements Lands and premisses the rents and profitts thereof I give devise and bequeath unto my two said Grandaughters Susannah Brissenden and Mary Brissenden their heirs and assignes for ever But if either of them shall happen to depart this Life before they shall attaine the age of one and Twenty years of have lawfull issue Then my Will is That such share and proportion shall go to the Survivor of them and to the heirs and assignes of such Survivor

Item unto my said Two daughters Elizabeth Tapley and Martha Edwards and to my said two Grandaughters Susannah Brissenden and Mary Brissenden I give devise and bequeath all that One Leasehold Messuage or Tenement now divided into four Small Messuages or Tenements lately called or known by the name or Signe of the Bull head with a Shed or lodge thereunto belonging and their severall outhouses yards backsides and Gardens Ground and appurtenances to them severally belonging and appertaining Scituate lying and being in the Parish of St. Margaretts Rochester and now or late were in the several Tenures or Occupations of the Widow Downes James Moucon? John Jury and (blank) Graycroft Widow and me the said William Savage some or one of us our Some or one of our assignee or assignees undertenant or undertenants which I hold by Lease from the Brethren of St. Bartholomews Hospitall

To hold unto my said two Daughters Elizabeth Tapley and Martha Edwards and my said two Grandaughters Susanna Brissenden and Mary Brissenden as Tenants in Common and not as Joynt Tenants they from time to time maintaining and keeping the said severall Messuages or Tenements and premisses in good and Sufficient repair and to committ no wast thereon To be divided between them in maner and forme following (that is to say)

One full and undivided third part (the whole divided into three parts of the said Messuages of Tenements Shed and Premisses) the rents and profitts thereof I give devise and bequeath unto my said Daughter Elizabeth Tapley during her natural Life and after her decease Then to my said Grandchildren Martha Tapley William Tapley and James Tapley her Children as tenants in Comon and not as Joynt tenants and to their Executors or Administrators for ever But if any of them shall happen to depart this Life before they attaine the age of one and Twenty years or have lawfull issue Then my Will is that such share or shares proportionably shall goe to the Survivors or Survivor of them and to his her or their Executors Administrators or Assignes for ever

One other full and undivided third part of the said severall Messuages or Tenements Shed and premisses the rents and profits thereof I give devise and bequeath unto my daughter Martha Edward during her naturall Life and after her decease Then to my Two Grandchildren William Edwards and Elizabeth Edwards as Tenants in Common and not as Joynt Tenants and to their Executors and Administrators for ever But if either of them shall happen to depart this Life before they attaine the age of one and Twenty years or have Lawfull issue Then my Will is That such share or proportion shall goe to the Survivor and to his or her Executors Administrators or assgines for ever

The third and last full undivided third part of the said severall Messuages or Tenements Shed and premisses the rents and profits thereof I give devise and bequeath unto my two Grandaughters Susannah Brissenden and Mary Brissenden their Executors Administrators and assignes for ever as Tenants in Common and not as Joynt Tenants But if either of them shall happen to depart this Life before they attaine the age of one and Twenty years or have Lawfull issue Then my Will is That such That such share and proportion shall goe to the Survivor of them and to her Executors Administrators or Assignes for ever

And my Will is that a new Lease or Leases of the premisses aforesaid be from time to time according to the to the usuall time Course Practice and Method that such and the like Leases be renewed be only endeavoured for and Obtained of the Patron and Governor of the Brethren of the said Hospitall and that the yearly Rent reserved on the said Lease to the said Brethren of the Hospitall aforesaid be well and truly paid

Item unto my Two Daughters Elizabeth Tapley and Martha Edwards and my said two Grandaughters Susanna Brissenden and Mary Brissenden I give devise and bequeath all that my one Leasehold Messuage or Tenement with the Outhouses Yards Backsides Garden and Ground with the appurtenances Scituate lying and being in the parish of St. Margaretts aforesaid (Rochester) and now or late in the Tenure of Occupation of (blank) Edwards which said Messuage or Tenement and premisses is held by Lease From Richard Lee Esquire deceased for nine Hundred and (blank) years To hold unto my said two daughters Elizabeth Tapley and Martha Edwards and my two Grandaughters Susanna Brissenden and Mary Brissenden as Tenants in Comon and not as Joynt tenants they maintaining and keeping from time to time the said Messuage or Tenement ad premisses in good and sufficient repair and committing no wast thereon the whole to be divided between them in manner and forme following (that is to say)

One full and undivided third part (the whole divided into three parts of the said Messuages of Tenements and Premisses) the rents and profitts thereof I give devise and bequeath unto my said Daughter Elizabeth Tapley during her natural Life and after her decease Then to my said Grandchildren Martha Tapley William Tapley and James Tapley her Children as tenants in Comon and not as Joynt tenants and to their Executors or Administrators for ever But if any of them shall happen to depart this Life before they attaine the age of one and Twenty years or have lawfull issue Then my Will is that such share or shares proportionably shall goe to the Survivors or Survivor of them and to his her or their Executors Administrators or Assignes for ever

One other full and undivided third part of the said severall Messuages or Tenements and premisses the rents and profits thereof I give devise and bequeath unto my daughter Martha Edward during her naturall Life and after her decease Then to my Two Grandchildren William Edwards and Elizabeth Edwards as Tenants in Common and not as Joynt Tenants and to their Executors and Administrators for ever But if either of them shall happen to depart this Life before they attaine the age of one and Twenty years or have Lawfull issue Then my Will is That such share or proportion shall goe to the Survivor and to his or her Executors Administrators or assgines for ever

The third and last full undivided third part of the said severall Messuages or Tenements and premisses the rents and profits thereof I give devise and bequeath unto my two Grandaughters Susannah Brissenden and Mary Brissenden their Executors Administrators and assignes for ever as Tenants in Common and not as Joynt Tenants But if either of them shall happen to depart this Life before they attaine the age of one and Twenty years or have Lawfull issue Then my Will is That such That such share and proportion shall goe to the Survivor of them and to her Executors Administrators or Assignes for ever

Item unto my said two daughters Elizabeth Tapley and Martha Edwards and my said two Grandaughters Susanna Brissenden and Mary Brissenden I give devise and bequeath all that One Messuage or Tenement with the two Orchards Outhouses Barn Yards Gardens Backside ground and Appurtenances to the same belonging or appertaining Scituate lying and being in the Parish of Gillingham aforesaid and now is or late was in the tenure possession or Occupation of (blank) Robottom and also all those five other Messuages or Tenements with the Outhouses Stable Yards Gardens Backsides Ground Appurtenances to them severally belonging or appertaining Scituate lying and being in the Parish of Raynham [Rainham] in the said County of Kent and now or late were in the severall tenures possession or Occupations of (blank) Scott (no other names given) or one of them their or one of their assignes or assignees undertenant or undertenants to hold unto them the said Elizabeth Tapley, Martha Edwards, Susanna Brissenden and Mary Brissenden as tenants in Common and not as Joynt tenants they from time to time maintaining and keeping the said severall Messuages or Tenants [Tenements?!] and premisses in good and sufficient repair and to committ no waste thereon to be divided between them in manner and forme following (that is to say)

One full and undivided third part (the whole divided into three parts of the aforesaid Six Messuages of Tenements and Premisses) the rents and profitts thereof I give devise and bequeath unto my said Daughter Elizabeth Tapley during her natural Life and after her decease Then to my said Grandchildren Martha Tapley William Tapley and James Tapley her Children as tenants in Comon and not as Joynt tenants and to their Executors or Administrators for ever But if any of them shall happen to depart this Life before they attaine the age of one and Twenty years or have lawfull issue Then my Will is that such share or shares proportionably shall goe to the Survivors or Survivor of them and to his her or their Executors Administrators or Assignes for ever

One other full and undivided third part of the aforesaid Six Messuages or Tenements and premisses the rents and profits thereof I give devise and bequeath unto my daughter Martha Edward during her naturall Life and after her decease Then to my Two Grandchildren William Edwards and Elizabeth Edwards as Tenants in Common and not as Joynt Tenants and to their Executors and Administrators for ever But if either of them shall happen to depart this Life before they attaine the age of one and Twenty years or have Lawfull issue Then my Will is That such share or proportion shall goe to the Survivor and to his or her Executors Administrators or assgines for ever

The third and last full undivided third part of the aforesaid Six Messuages or Tenements and premisses the rents and profits thereof I give devise and bequeath unto my two Grandaughters Susannah Brissenden and Mary Brissenden their Executors Administrators and assignes for ever as Tenants in Common and not as Joynt Tenants But if either of them shall happen to depart this Life before they attaine the age of one and Twenty years or have Lawfull issue Then my Will is That such That such share and proportion shall goe to the Survivor of them and to her Executors Administrators or Assignes for ever

All which said Six severall Messuages or Tenements Land and Premisses Scituate in Gillingham and Reynham [Rainham] aforesaid were Mortgaged to me by John Gascoyne of Reynham (sic) aforesaid Tallow Chandler deced [deceased] for the Principal Sume of two Hundred pounds of Lawfull money of Great Brittain which said two Estates when redeemed my Will is that all such moneys paid in be divided between my said two daughters Elizabeth Tapley and Martha Edwards and my two Grandaughters Susanna Brissenden and Mary Brissenden in three parts in manner and forme following (that is to say)

To Elizabeth Tapley one third part to Martha Edwards one other third part and to Susanna Brissenden and Mary Brissenden the third and last third part if they shall be then living But if they or any of them be dead then such third part to goe to their particular heirs Executors Administrators or Assignes for ever

Item all and Singular the rest of my Personall Estate be the same consisting in ready money Rings Plate Debts due to me on Book and Securities Household stuff Goods and Utinsells [Utensils] and Implements of Household or if of any other nature or kind whatsoever not herein before or after bequeathed I give devise and bequeath thereof in manner and forme following (that is to say)

All and Singular my Household Goods Utensils and Implements of Household I give devise and bequeath to be divided between my two daughters Elizabeth Tapley and Martha Edward and my two Grandaughters Susanna Brissenden and Mary Brissenden in three parts – to Elizabth Tapley one Third part to Martha Edwards one third part and Susanna Brissenden and Mary Brissenden the last third part

And as for touching and concerning all and Singular my ready money Rings Plate Jewells Book Debts and other Debts whatsoever I give devise and bequeath to my Seven Grand Children to be equally divided between them share and sahre alike to be paid to them when they attaine the age of one and Twenty years or Day of Marryage which may first happen and in the meantime to be put out at Interest on the best Security that can be gott as it comes into the hands of (my) Executors But if either of my said Grandchildren shall happen to depart this Life before they attaine the age of one and twenty years or day of Marryage Then my Will is that such share and shares proportionably shall goe to the Survivors or Survivor of them as herein before is directed and appointed

And whereas I have by this my present Will given devised and bequeathed unto my said Daughter Martha the wife of Richard the one third part of all my Freehold and Leasehold Estate for and during her naturall life yet my Will is that my Executors do receive and take all such rents due and to be due from time to times and take care and keep the said severall Estates in good repair and the Surplusage to pay to the severall proprietors Excepting that which will be due and grow due to my said daughter Edwards my Will and desire is shall be paid into the hands of my Trustees and they will be pleased to pay the same into her Hands as they can see her necessity shall be requiring

Item to my Grandaughter Elizabeth Emms of Chatham aforesaid Widow if she shall happen to become poor and Indigious and not Capable to Support and Subsist herself Then my Will is and I doe hereby give devise and bequeath One annuity or yearly rent Charge of Five pounds of lawfull money of Great Brittaine clear of all Taxes Assessments Impositions and Charges whatsoever for and during her naturall Life or day of Marryage (that is to day) after she is become so poor and Indigeous and not before to be paid her by such person or persons or by such Surviving person or persons who shall or may have the Rights and Propertyes and that doe or may receive the rents and profitts of all and Singular the aforesaid Freehold and Leasehold Estates

And in Case the said Annuity or yearly Rent Charge of five pounds shall be behind and unpaid to her the said Elizabeth Emms in part or in all for the Terme of one whole year after it shall become due as aforesaid That then it shall and may be Lawfull to and for my said Grandaughter Elizabeth Emms or her Assignes to enter into all or any of the said Messuages or Tenements Lands and Premisses herein before menconed or into any part or parcell of them and he same to hold with their and every of their appurtenances and to receive and take the Rents Issues and Profitts thereof untill she shall be fully Satisfyed contented and paid the said Annuity or Yearly Rent Charge aforesaid with the arrearages thereof if any there be due and all Costs and Charges wtsover [whatsoever] accruing thereupon

And I doe hereby appoint and ordaine my very good Friend Benjamin Moorcock of Chatham aforesaid Appothecary and James Saunders of St. Margarett’s (Rochester) aforesaid the Elder to be Guardians and Trustees of this my said last Will and Testament heartily desiring that they will be pleased to take care and assist and see that my Executors hereinafter named do in all Poynts [points] fulfill my said Will more particular that all the Messuages Tenements Lands and Premisses herein before mentioned in all points to be kept in good and sufficient repair both Freehold and Leasehold and Mortgaged Estates and that no commission of Wast be Committed thereon during the Minority of my said Grandchildren that the same may happily come into their possession accordingly as my said Will directs and requires
And my Will and desire is that my Executors do not any thing but what shall be with their good liking and approbation and for their trouble and Charge which of necessity they must be att upon this affair my Will and desire is that they are duly and gratefully satisfyed as also my Executors the like by my said Executors out of the said assetts which will fall into their hands

And I doe hereby nominate and appoint James Tapley aforesaid my Son in Law and Edward Hammond of Gillingham aforesaid Bricklayer to be my Sole Executors of this my said last Will and Testament hereby revoaking and making null and voyd all other and former Wills and Testaments by me heretofore made Spoken Published and declared

In Witness whereof to this my said last Will and Testament contained in Six sheets of Paper I have sett to my marke with my own hand and the seal the same to every sheets thereof the day and year first before written

Be it known unto all Men by these presents That whereas I William Savage of Chatham in the County of Kent Bricklayer hath made and declared my last Will and Testament in Writing bearing date the twenty fourth day of February which was in the year of our Lord according to the Computation of the Church of England One Thousand seven hundred Twenty Eight

I the said William Savage by this present Codicill or Schedule that Whereas in the said Will I have given and bequeathed unto Elizabeth Emms of Chatham aforesaid Widow an Annuity of yearly rent Charge of Five pounds of Lawfull money of Great Brittaine clear of all Taxes and Charges for and during her naturall Life or day of Marryage but not to be paid to her untill she should become very poor or Indigeous
And whereas I have since maturely considered the matter my Will is That the said Elizabeth Emms have the said Annuity or yearly Rent Charge or sume of Five pounds paid lett her condition be what itt will the first payment to be made and begin in one whole year after my decease and so to be continued on yearly and every year during her naturall Life and to be recovered as the said Will directs and appoints

And I do hereby Confirme my said Will (that is to say) so far forth as doth not relate to this Codicill or Schedule be and be adjudged to be part and parcell of my said last Will and Testament and that all things herein contained and mentioned be faithfully and truly complyed with and duly performed as fully and amply in every respect as if the same were s declared and sett down in the very body of my said last Will and Testament

In Witness whereof I have hereunto sett to my mark with my own hand and the Seal the same this second day of July in the third year of the reigne of our Sovereigne Lord George the Second by the grace of God of Great Brittaine France and Ireland King Defender of the Faith etc. Anno Dini 1729.

Notes:
William Savage married Ann Shaw on 24th August 1680 at St. Mary, St. Marylebone, London.
Daughters: Martha 27 Sep 1681; and Elizabeth 3 Apr 1685 – both were baptised at St. Martin-in-the- Fields, London. Daughter Mary Savage’s baptism has not been found.
Elizabeth Savage married James Tapley 5 May 1707, St. Martin-in-the-Fields. Both were of Chatham.
Their children (christened Gillingham):
25 Jan 1710 Edward (Bu. 26 Sep 1711 St. Mary, Chatham); 23 Feb 1712 Martha; 3 Mar 1719 William.
James Tapley’s christening has not been found.
Martha Savage married Richard Edwards on 6 Jan 1714 at St. Mary, Chatham. Their children (William and Elizabeth)’s christenings have not been found in Kent or London.
Mary Savage of Chatham married Robert Brissenden, Bricklayer on 4th August 1700 at All Saints, Frindsbury.
William Savage was probably born during the Commonwealth. His baptism isn’t found in Kent but may have been in London.

* “The Bull” was situated on the corner of Queen Street at 115 High Street, Chatham and is now a retail premises.
* The Golden Fleece was in the High Street, Gillingham.
