In the name of God Amen the Fourteenth day of June in the yeare of our Lord God One Thousand Six hundred Seaventy and nyne and in the one and thirtieth yeare of the Raigne of our Soveraigne Lord Charles the Second by the grace of God of England Scotland France and Ireland, King Defender of the Faith &c.
I Charles Seager of Tunstall in the County of Kent Gent[leman] being sicke and weake in bpdy but of sound disposeing minde and memory (thankes be to Almighty God for the same) and not knowing how it may please Almighty God to take mee out of this mortall Life doe therefore for the quieting of my minde and setling my Estate which God of his mercy hath afforded mee make and ordaine this my last will & Testam[en]t in manner and forme followinge (That is to say)
First and principally I surrender up my Soule into the hands of Almighty God my Creator beleiveing to be saved by and through the only meritts and Satisfaccon of Jesus Christ my onely Saviour and Redeemer And my body I comitt to the Earth from whence it came to bee decently interred and buryed by and at the discrecon of my Executors hereafter named

Item I give & bequeath unto the poore of the parish of Tunstall aforesaid the Sume of Tenn Shillings of Lawfull money of England to bee paid and distributed to and amongst them by my Executors hereafter named in such manner as they shall thinke fitt Item I give and bequeath unto my Loveing wife Mary Segar All my plate whatsoever and alsoe the sume of One hundred pounds of Lawfull money of England
And my minde and Will is that my said Wife (if she thincke fitt) shall have and take such and soe much or many of my Lynnen Bedds Bedding household stuffe Cattle and other p[er]sonall estate as she shall best like and make choise of not exceeding in value the sume of One hundred pounds for and in leiu of or towards satisfaccon of the said One hundred pounds soe to her by mee given as aforesaid
And in Case such of my said psonall estate as my said wife shall soe like and make choyce of as aforesaid shall not be of the reall value of One hundred pounds That then what the same shall be short or of Less value then one hundred pounds shall bee made up and paid to her my said wife in ready moneyes

And all the residue and remainder of my Lynnen, Woollen, Bedds, bedding, Brasse, pewter, Household stuffe, Cattle, Corne, Implem[en]ts of Husbandry, goods, Chattells and psonall estate whatsoever (my debts Legacies and Funerall expences being first paid and satisfied) my Will and minde is shall bee apprized at the reall and true worth and value of the same And that the same apprizem't shall be divided into Five equall partes whereof
two partes I give and bequeath unto my Sonne Charles Segar to bee paid unto him att his age of one and Twenty yeares,
One other Fifth parte thereof I give and bequeath unto my Sonne Henry Segar to bee paid unto him alsoe at att his age of One and Twenty yeares,
One other Fifth parte thereof I give and bequeath unto my Sonne William Segar to bee paid unto him at att his age of One and Twenty yeares,
And the other Fifth parte thereof I give and bequeath unto my Daughter Jane Segar to bee paid unto her at att his age of Eighteene yeares or day of marriage wch shall first happen

And as for Touching and Concerning all those my two severall third partes (the whole being in three partes to be divided) of and in all that the Mannor of Borden (or by whatsoever other name or names the same is or heretofore hath been Called or knowne) with the rights members and appurtenncs thereof in the said County of Kent
And of and in all that Capitall Messuage or Manor house commonly called or knowne by the name of Borden Hall or by whatsoever other name or names the same is or heretofore hath been called or whether called by any name or names or not Scituate in the parish of Borden aforesaid and the Maulthouse barnes stables Dovehouses outhouses gardens orchards yards backsides and all those severall peices or parcells of Land arrable Meadowe pasture and wood conteyning altogether in the whole by estimacon Two hundred and Twelve acres more or lesse with their and every of theire appurtenncs) in Borden aforesaid to the said Mannor and Capitall house or one of them belonging or apperteyning or therewth used or enjoyed and Late in the occupacon of Ralph Hayward gent or his Assignes or Undertennants
And alsoe of and in Two other Messuages or Tenements with the backsides gardens and appurtenncs to them severally belonging scituate lyeing and being in Borden aforesaid and late in the severall tenures of occupacons of Ralph Hayward gent, Mathew Sturgion and Elizabeth Thurbarne widdow some or one of them their some or one of their assignes or Undertennants

And alsoe of and in all that the Rectory or Parsonage of Borden aforesaid and all and every the Messuages glebe Lands tithes and pocons [portions] of Tithes Comodities Hereditaments and appurtenncs whatsoever to the said Rectory or Parsonage belonging And alsoe all that the Advowson and right of patronage and prsentacon of and in to the Vicaridge of the Church of Borden aforesaid wth the rights members and appurtenncs thereof
And alsoe as for touching and concerning all and every other my Messuages Lands Tenements Annuities and Hereditaments whatsoever Scituate lyeing and being ariseing comeing renewing increaseing or groweing due or becomeing payable in the severall parishes of Borden and Tunstall aforesaid or either of them or else where in the said County of Kent and all and every my Revercon and Reverccons [Reversion and Reversions] remainder and remainders and estate whatsoever of and in whatsoever Mannor Messuages Lands Rectoryes Tenemts and Hereditaments are Scituate lyeing and being in Borden and Tunstall aforesaid or either of them or else where in the said County of Kent with their appurtenncs I give and devise the same in manner and forme following (that is to say)

two full individed Fifth partes thereof (the whole in Five partes being to bee divided) with thappurtenncs I give and bequeath and devise to my said Sonne Charles Segar and to his heires and assignes for ever,
One other full individed Fifth partes thereof (the whole in Five partes being to bee divided as aforesaid) with thappurtenncs I give bequeath and devise to my said Sonne Henry Segar and to his heires and assignes for ever,
One other full individed Fifth partes thereof (the whole in Five partes being to bee divided as aforesaid) with thappurtenncs I give bequeath and devise to my said Sonne William Segar and to his heires and assignes for ever,
And the other full individed Fifth partes thereof (the whole in Five partes being to bee divided as aforesaid) with thappurtenncs I give and bequeath to my said Daughter Jane Segar and to her heires and assignes for ever

And if it shall happen that if either or any of my said sonnes Charles Segar, Henry Segar and William Segar shall happen to dye and departe this life without any issue of his or their respective body or bodyes Lawfully begotten and before he and they respectively shall have attained his or their respective age or ages of One and Twenty yeares and that the said Jane Segar my said Daughter shall survive him them or any of them soe dyeing as aforesaid Then I doe hereby chardge every the said severall and respective Fifth partes last menconed of him or them so dyeing as aforesaid with the payment of her my said Daughter Jane Segar (she soe surviveing as aforesaid) of the Sume of One hundred pounds of Lawfull money of England

And my minde and will is that shee my said Daughter Jane Segar shall and may enter into and have hold and enjoy and receive and take to her owne proper use the rents issues and profitts of the same severall and respective Fifth partes of such of my said Sonnes as shall dye and depart this life as aforesaid untill shee the said Jane shall thereby or otherwise be fully payd and satisfied aswell the respective Sume or Sumes of One Hundred pounds wth the payment whereof I have hereby before Chardged the same their said severall Fifth partes respectively as aforesaid As alsoe all such respective Chardges Damages and expences as she shall severally susteyne expend or be put unto in those severall behalfes respectively

Provided further and my minde and Will is That if my said Daughter Jane Segar shall departe this naturall life before she be Legally married to any person whatsoever That then the Estate share and Fifth parte of my Lands and Tenemts herein before given and devised unto my said Daughter Jane Segar as aforesaid shall bee equally divided betweene my said Sonnes Charles Segar, Henry Segar and William Segar and the Survivor and Survivors of them and his or their heires

And my minde and will is that my said loveing Wife Mary Segar shall have the education and bringing upp of my said Daughter Jane Segar untill she attaine her age of One and Twenty yeares or day of marriage which shall first happen and in the meane wise my said Wife to receive the rents benefitt and profitt of my said Daughters Estate by mee given and devised to her as aforesaid to beare and pay the Chardges of her educacon and maintenance

Item my minde and Will further is and I doe hereby give and devise unto my said Loveing wife Mary Segar and her assignes One Annuity or yearly rent of Tenn pounds of Lawfull money of England to be had received and taken out of all those my said two severall third partes (the whole being in three partes to be divided) of and in all that the Mannor of Borden and of and in all that Capitall Messuage or Mannor house comonly called or knowne by the name of Borden Hall and the Lands and Prmisses thereunto belonging To have and to hold receive perceive take and enjoy the said Annuity or yearly rent of Tenn pounds to the said Mary and to her assignes imediatly from and after my decease for and dureing the terme of her naturall Life payable yearlie at the Feasts of St. Michael the Archangell and the Annuntiacon of the blessed virgin Mary by even and equall porcons, the First payment thereof to beginne att such of the said Feasts as shall next happen and bee after my decease

And if it shall happen the said Annuity or yearlie rent of Tenn pounds to be behind or unpaid in parte of in all by the space of One and Twenty daies next after either of the said feasts on which as aforesaid the same ought to be paid That then it shall and may be Lawfull to and for the said Mary and her assignes into the said Mannor Messuage Lands and prmisses thereunto belonging and apperteyning and every or any parte thereof to enter and distreyne and the distresse and distresses then and there had and taken Lawfully from thence to take drive and carry away and the same impound detaine and keepe untill she and they shall be well and Truely satisfied and paid the aforesaid Annuity or yearlie rent of Tenn pounds and all arrears thereof together wth their reasonable Costs and Chardges in that behalf susteyned

Item I make and ordaine my said Loveing wife Mary Segar and my said Sonne Charles Segar full and only Executors of this my Last will and Testament hereby revoakeing and makeing void all former wills and Testam[en]ts by mee at any time heretofore made and declare this to be my Last will and Testament
And I doe hereby desire nominate and appoint my Loveing freinds Mr. Thomas Lake of Newington and Mr. Anthony Stringer of Borden to bee Overseeres of this my Last will and Testamt to each wch Thomas Lake and Anthony Stringer I give the Sume of Forty shillings to buy them rings in remembrance of mee

In Witnesse whereof I the said Charles Segar to every sheete of paper of this my Last will and Testament conteyning Five sheets of paper have sett my hand and (to) the last sheete thereof have affixed my Seale dated the day and yeare first above menconed
