I SAMUEL SHEPHERD of Great Mongeham in the County of Kent Esq. do make and ordain this my last Will and Testament in manner and form following.
That is to say I hereby revoke all former Wills and Testaments by me hereto for made and published.

And of this my last Will and Testament do constitute and appoint my Son-in-Law THOMAS SMITH Gent. and my Daughter ANN his Wife Executors.

And I do give and bequeath to the said THOMAS SMITH and ANN his Wife and to the Survivor of them and to the Heirs of such Survivors all my Messuages Lands Tenements and Hereditaments and all my Real Estate in Trust that they the said THOMAS SMITH and ANN his Wife or the Survivor of them or the Heirs of such Survivor do and shall as soon after my decease as the same can conveniently be done sell and convey all my said Messuages Lands Tenements and Hereditaments either together or in parcels as to them shall seem most advantageous and to such person or persons as shall offer to become purchasers as at the discretion of them the said THOMAS SMITH and ANN his Wife or the Survivor of them or the Heirs of the Survivor and pay the Moneys arising from such sale or sales into the Hands of my Brother GEORGE SHEPHERD of Portsmouth in the County of Southampton Gent. and JOHN SMITH of Westwood in the said County of Kent Gent. for the uses hereinafter mentioned.

I give and bequeath to the said THOMAS SMITH all my Books as well as those at Faversham as at Mongeham or elsewhere.

And all the Rest and Residue of my Personal Estate ofwhat nature or kind soever it may consist after the payment of my Debts and the expenses of my Funeral I give and bequeath to the said GEORGE SHEPHERD and JOHN SMITH or the Survivor of them or the Executors or Administrators of such Survivor to be applied to the uses and for the purposes hereinafter mentioned.

That is to say the said GEORGE SHEPHERD and JOHN SMITH or the Survivor of them or the Executors or Administrators of such Survivor of them do and shall place out at Interest in Government or other Securities with the Approbation of my said Executors or the Survivor of them such Securities to be taken in the names of the said GEORGE SHEPHERD and JOHN SMITH or in the name of the Survivor of them All the money to be raised by the sale of my said Messuages Lands and Hereditaments and all the Rest and Residue of my said Personal Estate as soon as the same shall be converted into money and pay and apply the Interest and Dividends which shall from time to time become due on such Securities to the uses and for the purposes following that is to say.

First that they pay to my Sisters SUSANNA and SARAH SHEPHERD and to the longest liver of them by Quarterly payments the yearly sum of thirty seven pounds and sixteen shillings.

And likewise the yearly sum of ten pounds and ten shillings half yearly to ELIZABETH SHEPHERD the Widow of JONATHAN SHEPHERD my late Brother deceased in discharge of certain Bonds or Obligations heretofore entered into by me for the payment of the said Annuities to the said SUSANNA SARAH and ELIZABETH.

And that they pay the Remainder of such Interest and Dividends to the said THOMAS SMITH and ANN his Wife and to the Survivor ofthem.

And from and after the decease of the Survivor of them the said THOMAS SMITH and ANN his Wife that they the said GEORGE SHEPHERD and JOHN SMITH or the Survivor of them or the Executors or Administrators of such Survivor do assign and transfer the Securities and pay the Principal Moneys and Interest due thereon to such child or children Male or Female of the said THOMAS and ANN his Wife in such proportions as the Survivor of them the said THOMAS and ANN shall by any Deed or Writing or by his or her last Will direct and appoint.

And in default of such direction or appointment that my said Trustees shall pay and distribute such Principal and Interest in equal proportions to and amongst all the children of the said THOMAS and ANN who shall be living at the time of the decease of the Survivor of them the said THOMAS and ANN.
And in case there shall be only one child if there is then living to pay the same to that one child.

But in case there be no Issue of the said THOMAS and ANN who shall be living at the time of the decease of the Survivor of them the said THOMAS and ANN in that case then my will is that the said Trustees the said GEORGE SHEPHERD and JOHN SMITH do pay and distribute the said Principal and Interest in equal proportions to and amongst to all the children Male or Female of my Sons JOHN SHEPHERD Esq. and JULIUS SHEPHERD Gent. who shall be living at the time of the decease of the Survivor of them the said THOMAS and ANN.

In Witness whereof I the said SAMUEL SHEPHERD have to this my last Will and Testament being all of my own handwriting and of which there are two parts but both of the same Tenor and Purport have set my Hand and affixed my Seal this 22nd Day of July 1768. SAMUEL SHEPHERD
