Also All that my Messuage with the Barns, Stables, Lands and Premises thereto belonging with the Appurtenances situate in the Parish of Eastry or Elsewhere in the County of Kent containing by Estimation Forty Acres more or less now in the Occupation of Thomas Kite or his Assigns I give and devise the same unto my Executors hereafter named In Trust for them to Sell and dispose thereof for the most Money that can be got for the same and the money arising by the Sale thereof I direct shall be added to my Personal Estate to be disposed off with that as hereafter mentioned And I do hereby confirm all and singular the same Premises unto the Purchaser or Purchasers thereof as touching my Personal Estate including the Moneys arising by the Sale of the Premises aforesaid I dispose thereof as follows
I give and bequeath unto my Brother Samuel Solly, Collector of Piscataqua in New England in America the Sum of Eight hundred Pounds Sterling to be paid him by my Executors hereafter named out of my Personal Estate within Twelve Months next after my decease Exclusive of all Accounts which now are or at the time of my decease may be depending or standing open between us and of the Ballance or Ballances due to him on such Accounts
But if my Brother Samuel Solly should happen to dye before me and leave any Child or Children
lawfully begotten living at the time of my decease Then I give and bequeath the sum of Four hundred
Pounds Sterling to be divided and Shred between them Share and Share alike if more
than one and if but one then wholly to such one
And if there should be no Child or Children living as aforesaid then I give and Bequeath the last mentioned sum of Four hundred Pounds
Sterling unto my Sister Katherine Hunt of Sandwich aforesaid Widow
But if she should likewise be Dead Then I give and bequeath the said last mentioned sum of Four hundred Pounds Sterling unto all and every the Children of my said Sister Katherine Hunt which shall be living at the time of my decease equally to be divided between them Share and Share alike if more than one and if but one then wholly to such one
Also I give and bequeath unto my Sister in Law Anne Solly of Walthamstow in the County of Essex Widow and Relict of my Brother Richard Solly deceased the sum of Fifty Pounds Sterling to be paid her in manner aforesaid within twelve Months next after my decease for Mourning
Also I give and bequeath unto my Cousin John Solly, Son of my said late Brother Richard Solly the sum of one hundred and Fifty Pounds Sterling to be paid him in like manner within twelve Months next after my decease, which said Sum and Sums of money which may be due to him from me on any Account or Accounts which are now or at the time of my decease may be depending or standing open between us
But is the said John Solly shall happen to dye before me or before his said Legacy becomes due and payable to him as aforesaid, Then I
give and bequeath the Legacy so given to him as aforesaid unto my said Sister Katherine Hunt
And if she should likewise be dead before the said Legacy becomes due and payable to her Then I give and bequeath the same unto all
and every the Children of my said Sister Katherine Hunt which shall be living at the time of my decease equally to be divided between them
Share and Share alike if more than one and if but one then wholly to such one
Also I give and bequeath unto each of my Cousins Isaac Solly, Samuel Solly and Edward Solly
(three other of the Sons of my late Brother Richard Solly deceased) the Sum of Three hundred
Pounds Sterling apeice if they shall respectively living at the time of my decease
to be paid to them respectively in manner aforesaid within Twelve Months next after my decease
But if either of them my said Cousins shall dye before their said Legacy of Legacys respectively
become due or payable then I give and bequeath the Legacy or Legacys of him or them so dying unto
my said Sister Katherine Hunt
And if she should be likewise dead Then I give and bequeath such Legacy or Legacys last mentioned unto all and every the Children of my
said Sister Katherine Hunt equally to be divided between them Share and Share alike if more than one and if but one then wholly to such one
Also I give and bequeath unto my Sister in Law Sarah Solly of Favesham in the said County of Kent Widow and Relict of my late Brother Thomas Solly deceased the sum of Fifty pounds Sterling to be paid her in manner as aforesaid within twelve Months next after my decease for Mourning
Also I give and bequeath unto my Cousins John Solly, Thomas Solly, Richard Solly and Isaac Solly
Sons of my late Brother Thomas Solly the sums of four hundred Pounds Sterling apeice when they shall several attain their respective
Age and Ages of Twenty one years, payable in manner as aforesaid
But if either of them shall happen to dye before they respectively attain their said Age and Ages of Twenty one Years as aforesaid then I
give and bequeath the Legacy or Legacys of him or them so dying unto the Survivors or Survivor of them equally to be divided between them
share and share alike if more than one and if but one then wholly to such one
And if all of them my said Cousins the Sons of my said late Brother Thomas Solly deceased shall be dead before the said Legacy or Legacys become due and payable as aforesaid then I give and bequeath the said Legacys so given to them unto my said Sister Katherine Hunt But if she should then be likewise dead Then I give and bequeath the same last mentioned Legacys unto all and every the Children of my said Sister Katherine Hunt which shall be living at the time of my decease of more than one and if but one then wholly to such one to be divided as aforesaid
Also I give and bequeath unto my Sister in Law Sarah late Wife of my Brother John Solly deceased but now the Wife of ....... Waterman * the sum of Fifty Pounds Sterling to be paid to her alone whose receipt shall be a sufficient discharge to my Executors within twelve Months next after my decease for Mourning
Also I give and bequeath unto my Cousin John Bennet Solly one of the Sons of my late Brother John
Solly deceased the sum of Fifty Pounds Sterling to be paid him in like manner within twelve Months next after my decease
But if the said John Bennet Solly shall dye before his said Legacy becomes due and payable to him then I give his said Legacy to my Sister
Katherine Hunt aforesaid If she shall be living when the same becomes payable If not then I give and bequeath this
same Legacy unto all and every the Children of my said Sister Katherine Hunt which shall be living
when the same becomes payable equally to be divided between them as aforesaid if more than one and it but one then wholly to such one
Also I give and Bequeath unto Richard Solly one other of the Sons of my said late Brother John
Solly deceased the Sum of Three hundred Pounds Sterling to be paid him in like manner within twelve Months next after my decease
But if the said Richard Solly the said Son of my late Brother John Solly deceased shall dye before his said Legacy becomes due and payable
Then I give and bequeath his said Legacy unto his two Brothers my Cousins Benjamin Solly and Edward
Solly two other of the Sons of my said late Brother John Solly deceased when they shall respectively
attain their age and ages of twenty one years equally to be divided between them
And in case either of them the last mentioned Benjamin Solly and Edward Solly shall dye before such Legacy becomes due and payable unto them as aforesaid Then I give this same last mentioned Legacy unto the Survivor of them the said Benjamin Solly and Edward Solly to be paid him in manner foresaid and in case the said Benjamin Solly and Edward Solly shall be both dead before the said Legacy becomes due and payable then I give this last mentioned Legacy unto my said Sister Katherine Hunt aforesaid If she shall be living when the same becomes payable If not then I give and bequeath this same Legacy unto all and every the Children of my said Sister Katherine Hunt which shall be living when the same becomes payable equally to be divided between them as aforesaid if more than one and it but one then wholly to such one
Also I give and bequeath unto each of them my said Cousins Benjamin Solly and Edward Solly the two other Sons of my said late Brother John Solly deceased the sum of Four hundred Pounds Sterling apeice to be paid unto Isaac Solly one of my Executors hereafter named within twelve Months next after my decease In Trust for (the) said two Cousins last mentioned Benjamin Solly and Edward Solly and to be paid to them as they shall respectively attain their age and Ages of Twenty one years
Also I give and bequeath unto my Aunt Anne Bax of St. Bartholomew’s Hospital near Sandwich the
Sum of Twenty Pounds Sterling to be paid her in manner aforesaid within one Month next after my decease
Also I give and bequeath unto each of my said Aunt Baxes own Children that shall be living at the
time of my decease the sum of Ten Pounds Sterling apeice to be paid to each and every of them as aforesaid within one Month next after
my decease
Also I give and bequeath unto my Kinsman Thomas Minter of Ash next Sandwich aforesaid and his
present Wife who was the Widow of my Uncle Stephen Solly deceased the Sum of twenty Pounds Sterling apeice to be paid to each of them
in like manner within one Month next after my decease for Mourning
Also I give and bequeath unto each of the Children of my sad late Uncle Stephen Solly that shall be
living at the time of my decease the Sum of Twenty Pounds Sterling apeice to be paid
to each of them in like manner within one Month next after my decease
Also I give and bequeath unto my Cousin Richard Solly of Sandwich Draper and also to Mary his Wife the Sum of Ten Pounds Sterling
apeice to be paid them in manner aforesaid within one Month next after my decease for Mourning
Also I give and Bequeath unto Captain Stephen Long of Sandwich aforesaid And also to Mary Long
his Daughter the sum of Ten Pounds Sterling apiece to be paid them in like manner for Mourning
Also I give and bequeath unto my Cousin Ambrose Rose and Anna his Wife of Rowling [a few miles
from Sandwich] the Sum of Ten Pounds Sterling apiece to be paid them in like manner for Mourning
Also I give and bequeath unto my Cousin William Henry Solly of Sandwich aforesaid and also to
Christian his Wife the Sum of Ten Pounds Sterling apiece to be paid them in like manner for Mourning
Also I give and bequeath unto my Friend John Bax of Ash aforesaid the Sum of Ten Pounds Sterling to be paid him in like manner for
Mourning
Also I give and bequeath unto my late Servant Martha Hurst of Ramsgate in Kent Spinster the Possession of my Dwelling House and Premises and also the Shop together with all the Counters, Shelves, Drawers and other necessarys and utensils therein and also in the Warehouse as they are now or may at the time of my decease be Fixed or standing therein to be delivered to her by my Executors within ten days next after my death And I give and bequeath unto her the said Martha Hurst the further Sum of Fifty Pounds Sterling for her Long and faithfull Services to me to be paid to her in manner aforesaid within ten days next after my decease
Also all the rest and residue of my Real and Personal Estate whatsoever and wheresoever and of what
nature, kind or quality whatsoever the same shall or may consist of and not hereinbefore by me
disposed of or given, devised or bequeathed, my just debts and my Funeral Charges and the Charges
of probate of this my Will being thereout first paid and Satisfied, I give devise an bequeath the same
and every part thereof unto my Executors hereafter named and to their Heirs Executors
Administrators and Assigns as and for their own proper Real and Personal Estates for ever
To hold the same as Tenants in Common and not as Joint Tenants and to (be) equally divided between them Share and Share alike
Also I do hereby Nominate, Constitute and appoint my said Cousins Isaac Solly, Samuel Solly and
Edward Solly, Sons of my said late Brother Richard Solly deceased Joint Executors of this my last Will and Testament
Lastly I do hereby revoke, anull and make void all former and other Wills and Testaments by me at any time heretofore made, spoken,
Published and declared and do hereby declare this and this only to be and contain my last Will and Testament
In Witness whereof I the said Isaac Solly the Testator have to this my last Will and Testament
contained in Four Sides of Paper to each side thereof set my hand and Seal this Twenty ninth day of
January in the Twenty third year of the reign of our Sovereign Lord George the Second by the Grace
of God of Great Britain, France and Ireland, King, Defender of the Faith and so forth, and in the year
of our Lord One thousand seven hundred and Forty nine

This Will was Proved at London the Fifth day of April in the year of our Lord One thousand seven
hundred and Fifty five before the Worshipful George Harris, Doctor of Laws and Surrogate of the
Right Honourable Sir George Lee, Knight, also Doctor of Laws, Master Keeper or Commissary of the
Prerogative Court of Canterbury, lawfully constituted by the Oaths of Isaac Solly and Edward Solly
two of the Executors named in the said Will to whom Administration was Granted of all and singular
the Goods, Chattles and Credits of the said deceased having been first Sworn duly to Administer
(Power reserved of making the like Grant to Samuel Solly the other Executor named in the said Will when he shall apply for the same.
