and I direct all my just Debts Funeral and Testamentary expences to be
paid and satisfied and after payment thereof I give and devise to William Smith
who now resides with me and to my Kinswoman Susanna his wife their heirs and
assigns All that my messuage or tenement garden outhouses edifices buildings
heredits and premises thereunto belonging and appertaining
And also all those six small closes or pieces or parcels of Meadow or pasture land adjoining thereto
containing by estimation three acres more or less and also the right of Common
adjoining thereto all which said messuage or tenement lands heredits and
premises are situate lying and being in the Parish of Alkham aforesaid and now
in the occupation of myself and the said William Smith To hold the same unto
and to the use of the said William Smith and Susanna his Wife their heirs and
assigns absolutely for ever
Subject nevertheless to the payment thereout by the said William Smith of the following legacies namely
To my kinswoman Susanna the wife of Daniel Baker of the Town of Folkestone in the said County Plumber
and Glazier the sum of one hundred pounds of sterling money
and to William Elvey of the Town and Port of Dover in the said County Tailor the sum of
nineteen pounds and nineteen shillings
which said Legacies I direct to be paid and payable within six months next after my decease
Also I give and bequeath unto the said Susanna the Wife of the said William Smith all my household furniture and implements of household linen and china to and for her own absolute use and benefit
Also I give unto my Godson John Smith my watch & all my plate and books to and for his own absolute use and benefit
and as to all the Rest Residue and Remainder of my estate and effects both real and personal and of what nature or kind soever the same may be or consist of whether freehold copyhold or otherwise I give devise and bequeath the same unto and To the use of William Spain and John Spain my kinsmen both of Folkestone aforesaid Carpenters their heirs and assigns to hold the same unto and To the use of the said William Spain and John Spain their heirs and assigns for ever equally to be divided between them share and share alike as Tenants in common and not as joint Tenants
and I do hereby nominate constitute and appoint the said William Smith & William Spain joint Executors of this my Will hereby revoking and making void all former and other Wills and Testamentary papers by me at any time or times heretofore made and do declare this only to be and contain my last Will and Testament
In Witness whereof I the said John Spain the Testator
have to this my last Will and Testament contained in two sheets of Paper put my
hand and seal (to wit) my hand to the first sheet and my hand and seal to this
second and last sheet and my seal at the top where the said sheets are affixed
together this twenty third day of July in the Year of our Lord one thousand eight
hundred and thirty seven John Spain
