I give, devise and bequeath all and Singular my Real and Personal Estates and Effects whatsoever unto and to the use of my Friend
James Ridout his Heirs, Executors, Adm[inistrat]ors and assigns respectively upon the trusts following (that is to say)
In Trust to make Sale and dispose of, get in and convert into money my said Estate and In Trust to sell and dispose of all my said
Real Estate either together or in parcels by Public Auction or Private Contract to any person or persons whomsoever for the most money
that can be obtained for the same
and for facilitating such Sale I do hereby declare that such receipt or receipts of the said James Ridout his Heirs or Assigns shall be a good discharge and good discharges to the purchaser or purchasers of my said Real Estate or any part thereof and to his, her and their respective Heirs, Executors, Adm'ors and Assigns for so much of the purchase money for which such receipt or receipts shall be given And that after such receipt or receipts, such purchaser or purchasers his, her or their Heirs, Executors, Adm'ors and Assigns shall not be accountable for any loss, misapplication or nonapplication of the money in such receipt or receipts to be expressed to be received
And I do hereby direct that the said James Ridout his Heirs, Executors Adm'ors shall out of the monies to arise by such Sale of my Real Estate and with the Rents thereof until such Sale and out of the monies to be produced from my Personal Estate in the first place pay my just debts, Funeral and Testamentary Expences and the Legacies hereinafter bequeathed and stand possessed of the Residue of such monies and Rents upon the trusts following (that is to say)
As to one equal half part thereof In Trust to invest the same upon Government or Real Securities at Interest and to alter and transpose
such Securities as occasion shall require
and In Trust during the life of my Sister Mary Smith, Widow, to pay unto or permit her and her assigns to receive the Interest
and Annual Proceeds thereof as the same shall become due and be received and after her decease as to one equal half part of the monies
so to be invested
In Trust for Henry George Eltenton, Edward Walter Eltenton, Charles William Eltenton, Ann Morgan Widow and Mary Elizabeth the wife
of _____ formerly Mary Elizabeth Eltenton Spinster in equal shares as Tenants in Common and to their respective Executors, Adm'ors
and Assigns
Provided always that if the said Mary Elizabeth the wife of ______ formerly Mary Elizabeth Eltenton Spinster shall not be heard of by my Executors hereinafter named or either of them within seven (years?) after my decease, then her share of the said Trust Monies shall be In Trust for her Brothers and Sister the said Henry George Eltenton, Edward Walter Eltenton, Charles William Eltenton and Ann Morgan in equal shares as Tenants in Common for their respective Executors, Adm'ors and Assigns
And as to the other equal half part of the said monies so to be invested, the same shall after the decease of my said Sister be upon
the trusts following (that is to say)
As to two equal fourth parts thereof In Trust for the said James Ridout his Executors, Adm'ors and Assigns
as to one equal fourth part thereof In Trust for Thomas Ridout the Elder his Executors, Adm'ors and Assigns
and as to the remaining equal fourth part thereof for Jane the Wife of William Baskerville her Executors, Adm'ors and Assigns
And as to the remaining equal half part of the said Residue of the monies to arise from my said Real and Personal Estate and Effects the
same shall be as to one equal half part thereof In Trust for
Elizabeth Stroud, Widow of my late Husband’s Brother Henry Stroud
my Nephew in Law John Stroud, Son of the said Elizabeth Stroud
and my Great Nephew in Law Thomas Stroud, Son of Henry Stroud the Younger deceased
in equal shares as Tenants in Common and for their respective Executors, Adm'ors and Assigns
And as to the other equal half part thereof In Trust for
____ Hewit the Widow of William Hewit late of Lambeth in the County of Surrey deceased and all and every her Child and Children by the
said William Hewit who shall be living at my decease
in equal shares as Tenants in Common and for their respective Executors, Adm'ors and Assigns
And I give and bequeath the following Legacies to the several persons hereinafter named
To Thomas Bowering, Mary Bibbey, Thomas Woodward and Eleanor Atwood the wide of Edward Atwood the Sum of Twenty pounds of lawful
money of Great Britain apiece
and to Mary Billings, William Simmons, Elizabeth Moses Hubbard, Catherine Williams and Mary Ann Durban the sum of fifteen Pounds
of like lawful money apiece
and to Thomas Eltington Gibbons the Sum of Five pounds of like money
And I direct that the receipt or receipts of the said Elizabeth Moses Hubbard or of her appointees or assigns shall (notwithstanding
any Coverture she may be under) be a sufficient discharge to my Executors for the said Legacy or Sum of money hereby bequeathed to her
And I appoint the said James Ridout together with John Durban and Sarah Kebble Executors of this my Will and I give to each of
them the Sum of Ten pounds as an acknowledgement for their trouble
And I declare that the said James Ridout shall not be answerable for involuntary losses and that he shall be allowed and may retain all
his Costs Charges Damages and Expences to be occasioned by the due Execution of the trusts of this my Will
and I hereby revoke all my former Wills
In Witness whereof I the said Catherine Stroud the Testatrix have to the first two sheets of this my
last Will and Testament in three sheets of paper contained set my hand and to this third and last sheet
thereof my hand and seal this Nineteenth day of April in the Year of our Lord one thousand Eight hundred and twenty six
