I Roger SUTTON the eldre of the parishe of Hawkynge hole of mynde and of good remembrance make my testament yn man[ne]r and former foloweng
First I bequeathe my soule to almyghty god our lady and to all the co[m]pany yn hevyn my bodye to be buried yn the church yard of hawkyng /

It[e]m I bequeith to the high ault[er] there for my tythes & oblacant forgoten iijs iiijd
It[e]m to ev[er]y light in the said church the crosse light the light on the beme yn the channcell the light of saynte margaret to the light of our ladye & to eche of theym a busshell of barley or els iiijd
It[e]m to the high ault[e]r of Alkh[a]m iijs iiijd
It[e]m to the highe ault[e]r of Folkeston a weddre shepe

It[e]m to ev[er]yone of my god chilldren a busshel of barley or els iiijd
It[e]m to Elenor my daught[er] when she commythe to the age of xvj yeres v mark[es]
It[e]m if the said Elenor dye w[ith]yn age of xvj yere I will that Isabell the wif of Thomas Rogers of Eastrye have xxs
And Elizabeth s[er]vant? to John Colly of Alkh[a]m xxs of the v marke to the sayd Elenor before bequeithed

This is the last will of me Roger Sutton the eldre made the daye & yere before namyd /
And on a feoffment by me made to Ingram Woollet John Jolle Will[ia]m Marshe now lyveng w[ith] John Stephen[s] of Sott... Thomas Uden & Ingram Jekyn late ded

First I will my feoffe[es] suffre Margerye my wif to have & occupye the chambre that I dwell yn fre com[m]yng & goyng at all tymes w[ith] y[ts] garden plott[es] next it a hemp spott & she to by the hemp seyde & the farmers to sowe it /
Also fyve loades of lawfull wood ev[er]y yere /
Also the quern[es] to grynde her mallt the oven to bake her brede yn the well to washe at at (sic) all tymes w[ith]out any lett or nay of my farmer[s] or theym that shalbe farmer[es] hereafter as long as she kepith her sole wedowe /
Also the jusement? pasteryng & feedyng of one cowe wynter & som[mer]
And these thyng[es] I charge myn executors that they see? theym p[er]formed
Also I will she have out of my land[es] yerely while she ys wedowe xxvjs viijd to be payed to her at (iiij?) usuall times of the yere yerely & iiij seymes of whete & iiij seymes of barley as long as she remayn[th?] sole & nott maryed /

It[e]m if the saide Margerye do marye theym Then I will shee have xli payed as foloweth that is to saye w[ith]yn viij wekes after the daye of hir mariage fyve marke that same daye xij month v mark and xij moneths after that other v mark yn full payment of the said xli /

It[e]m I will that my feoffe[es] shall infeoffe Nicholas my son[n]e when he com[m]ythe to the age of xxj yeres yn all my land[es] & tenement[es] to hym his heyres & assignes
It[e]m & if the said Nicholas dye wythyn age of xxj yeres or w[ith]out heyres of his bodye lawfully begoten Then I will that my land[es] & tenement[es] remayne hole to Roger Sutton his heires & assygnes for (ever?) payeing
to Giles his brodre (brother) v mark
And to Will[ia]m Sutton his brodre v mark
And to Elenor my daughter othre v marke

Also if Roger dye w[ith]out heires of his bodye lawfully begoten after the Decease of Nicholas or before That then I will that Will[ia]m his brodre shall inherytt all my land[es] or the heires of his bodye lawfully begoten /

Also I charge myn executors that they suffre not my farmers nor (men?) that shalbe farmer[es] hereafter to make no str(epe?) no wast of no man[ner] of wood[es] growyng uppon my said land[es] /
Also I will if myn executors lacke any money to p[er]forme this my last will that then they shall sell vj acres of my land[es] (c?)allyd heydo(m?) And as muche woode as shallbe expedient & by the syght of my ov[er]sears /
Also I will that my feoffe[es] delyver astate of the said v acres of land to myn executors accordying to theyr sale when so ev[er] they shall sell it

The witnesse of this is S[i]r John Canturbury parson of hawkynge Will[ia]m Nethersole Walter Sayer Will[ia]m At Regge & John Jack[es]

Also I make & ordeyne myn executors Richard Page (or Paye�) & Roger Sutton the youngar /
And they to have for theyr labours xiijs iiijd
& Mr Evereng? & John Lussyngton to be my ov[er]sears of this my last will & they to have for theyr labour[es] xiijs iiijd

also I will theyr be don[e]? at my forthefare v mass[es] w[ith] placebo and dirige
And to be spent yn bredd & drinke xxd
And at the moneths day v mass[es] w[ith] dirige
And to s... among pore people halfe a seyme of whete & halfe a seyme of (barley crossed out) mallt
And at my xij months mynd iij mass[es] w[ith] dirige & to be spent a busshell of whete & a busshell of mallt & x yeres aftre ev[er] yere iij mass[es] w[ith] dirige
And ev[er]y yere a busshell of whete And a busshell of mallt duryng the x yeres
Also I will there be (spent?) ev[er] yere on the ascention thursday a busshell of whete & a busshell of mallt to the people at the p(assyon) to be theru[nto] refresshed
And the same to be done ev[er]y yere for ev[er] & to aryse of & out of my tenement[es] & land[es] for ev[er] more /

Also I will that if my executors do sell any woode that then they shall make the closure & so kepe it saffe unto my heyre cometh at the age as is afore whersye?
Also if Nicholas my son[ne] dye or he c[um]? to the age of xxj yeres & w[ith]out heyres of his bodye lawfully begoten Then I will that Roger Sutton shall suffre my executors to occupye and stand yn full strenght tyll they have fulfilled & discharged all my will my dett[es] & my bequeiths or on he do entre to the said tenement[es] & land[es] /

Also if my executors do sell haydem? that then Roger Sutton shall by it before another may & w[ith]yn the pric � ... /

Notes
Giles SUTTON may be the brother to Roger who died around 1545. If so his purchase of land from Nicholas SUTTON is further evidence of a link between the two Roger SUTTONs.
Roger SUTTON the younger: executor
Details match that of the Roger SUTTON whose will was proved in 1545: in both wills references are made to Roger SUTTON having brothers named Giles and William, Giles being named first and presumably the elder of the two. His appointment as executor suggests he was over 21 and whilst related to the testator was not his son.
