Will of Mary Thompson

of Rochester, Kent

I give and bequeath unto my daughter Elizabeth the now or late wife of Richard COLLINS of the Strand in the County of Middlesex Siversmith my Granddaughter Mary COLLINS and my Grandson Richard COLLINS / daughter and son of my said daughter Elizabeth COLLINS / or unto such of them as shall be living at the expiration of three calendar months next after my decease but not otherwise the sum of fifty pounds stock new four per cent Bank annuities now standing in my name in the books of the Governor and Company of the Bank of England And I do hereby declare that the aforesaid legacies are so in severally bequeathed to my said daughter Elizabeth COLLINS and my Granddaughter Mary COLLINS for their separate use to be at their own disposal and free from the control of any husband with whom they may have already or may at any time hereafter intermarry And I do hereby further declare that neither of the said three legacies shall be a vested legacy until the expiration of three calendar months next after my decease And I do further declare that neither of the xxxx three legacies above bequeathed shall be paid to any other person or persons or by any order or authority whatever but to the three before named legatees in their own proper person whose respective receipts and discharges only shall be a sufficient release to my Executors hereinafter named

and I give and bequeath unto John VINALL of Brompton in the Parish of Gillingham in the said County Gentleman late master Bricklayer in His Majesty's said Dock Yard of Chatham and William HAYLER of Chatham aforesaid Watchmaker and Silversmith the sum of two guineas each for a ring as a small token of my great respect for them

And as to all the Rest Residue and Remainder of my goods chattels monies and securities for money stock in the Public funds rights credits and all other my personal estate and effects whatsoever and wheresoever and of what nature kind or quality the same may be or consist not hereinfore specifically disposed of after payment of just debts and funeral and testamentary expences and the aforesaid legacies I give and bequeath the same and every part thereof to my Daughter Mary the wife of George ELY of the said City of Rochester Esquire absolutely for her own separate use and benefit and to be at her own disposal free from the control of her said husband and that her receipt shall be a sufficient discharge and release in all cases

And I do hereby nominate constitute and appoint the said John VINALL and William HAYLER Executors and my said daughter Mary ELY Executrix of this my will and thereby revoke and make void all former and other will and wills by me at any time heretofore made and do declare this present writing to be and contain my full and whole last will and testament In Witness whereof I have hereunto set my hand seal this thirteenth day of November one thousand eight hundred and thirty four -- Mary Thompson SS -- Signed sealed published and declared by the said Mary Thompson the testator as and for her last will and testament in the presence of us at her request in her presence and in the presence of each other have hereunto subscribed our names as witnesses thereto

PROVED at [PCC] London 18th December 1841 before the Worshipful John Daubeny Doctor of Laws and Surrogate by the oaths of William HAYLER and Mary ELY widow the daughter two of the Executors to whom Administration was granted having been first sworn only to administer power of making a like Grant to John VINALL the other Executor when he shall apply for the same.
