Will of John Tucker

of Hougham, Kent

Imprimis I give and devise unto my loving wife Anne Tucker all that my Messuage or Tenement with the Meadow Ground and appurtenances thereunto belonging situate lying and being in the said parish of Houffham otherwise Hougham now in the occupation of Thomas Rogers or his assigns to hold the same unto my wife Anne for and during the term of her natural life
And from and after her decease I give and devise the said Messuages or Tenement Land and premises with the appurtenances unto my Nephew Stephen Tucker son of my brother Thomas Tucker and to his heirs and assigns for ever

Item I give and devise unto my said Wife Ann Tucker all that small Meadow (which I purchased of my brother William Tucker) containing by estimation half an acre more or less situate lying and being in the parish of Huffam otherwise Hougham and now in my own occupation to hold the same unto my said wife Anne for and during so long time of the term of her natural life as she shall keep her self a widow and unmarried
And after the decease of my said wife Anne or her Marriage with any other person then and immediately after such death or marriage (which shall first happen) I give and devise my said meadow unto my said nephew Stephen Tucker and to his heirs and assigns for ever

Item I give and devise unto my said nephew Stephen Tucker all that my small Messuage or tenement with the appurtenances and ground thereunto belonging situate lying and being in the said parish of Huffam otherwise Houghham now in the occupation of John Wiles or his assigns to hold the same unto my said nephew Stephen Tucker and to his heirs and assigns for ever

Item I give and devise unto my said nephew Stephen Tucker all that my Messuage or tenement and land thereunto belonging containing by estimation three acres more or less situate lying and being in the said parish of Huffham otherwise Hougham and now in my own occupation of to hold the same unto my said nephew Stephen Tucker and to his heirs and assigns for ever
he my said nephew Stephen Tucker and his heirs paying out of the said last mentioned Messuage or tenement land and premisses unto my sister Mary Tucker and assigns for and during the term of her natural life clear of all taxes and deductions whatsoever one annuity or yearly rent charge of three pounds of lawfull [money] of Great Britain on the two most usual Feasts or days of payment in the year (that is to say) on the Annunciation of the blessed Virgin Mary and St Michael the Archangle by even portions to be paid half yearly the first payment thereof to be made and paid upon the first of the aforesaid Feasts or days of payment in the year which shall first happen and come by after the decease of me the said John Tucker

And if it shall happen the said annuity or yearly rent charge of three pounds to be behind and unpaid in part or in all by the space of twenty one days next over or after either of the said Feasts on which as aforesaid the same ought to be paid That then and so often my mind and Will is that it shall and may be lawfull to and for my said sister Mary Tucker and her assigns into the said last mentioned Messuage or Tenement land and premises or into any part or parcel thereof to enter and distrain and the distress and distresses then and there found had and taken lawfully from thence to leave drive bear and carry away and to the same to withhold impound detain and keep until such time the said annuity or yearly rent charge of three pounds and every part thereof and all arrearages thereof and all costs and charges in that behalf sustained shall be to the said Mary Tucker and her assigns well and truly satisfyed contented and paid

Item I give and devise unto John Tucker of the Town and Port of Dover in the said County (now apprentice to a cordwainer) son of my nephew John Tucker late of Houffam otherwise Hougham aforesaid labourer deceased all that my Messuage or Tenement land and premises unto thereunto belonging containing by estimation three acres more or less situate lying and being in Swingfield Street in the said County of Kent and now in the occupation of the Widow of Edward Curling or his assigns To hold the same unto the said John Tucker Cordwainer and his heirs paying out of the said last Messuage or tenement land and premisses unto my said wife Ann Tucker and her assigns for and during the term of her natural life clear of all taxes and deductions whatsoever one annuity or yearly rent charge of three pounds of lawfull money of Great Britain on the two most usual Feasts or days of payment in the year (that is to say) on the Annunciation of the blessed Virgin Mary and St Michael the Archangel by even and equal portions half yearly to be paid the first payment thereof to be made and paid upon the first of the aforesaid Feasts or days of payment in the year which shall first and next happen and come after the decease of me the said John Tucker

And if it shall happen the said annuity or yearly rent charge of three pounds to be behind and unpaid in part or in all by the space of twenty one days next over or after either of the said Feasts on which as aforesaid the same ought to be paid That then and so often my mind and Will is that it shall and may be lawfull to and for my said wife Ann Tucker into the said last mentioned Messuage or Tenement land and premises or into any part or parcell thereof to enter and distrain and the distress and distresses then and there found had and taken lawfully from thence to leave drive bear and carry away and the same to withhold impound detain and keep until such time the said annuity or yearly rent charge of three pounds and every part thereof and all arrearages thereof and all costs and charges in that behalf sustained shall be to my said wife Ann Tucker well and truly satisfied contented and paid

Lastly all the rest and residue of my real Estate and all also all and every my personal Estate whatsoever and wheresoever and of what kind or quallity so ever the same shall exist and be at the time of my decease after my debts and funeral charges and expences are paid and satisfyed I give devise and bequeath unto my said wife and to her heirs Executors administrators and assigns for ever
whom I do hereby make constitute and appoint sole Executrix of this my last Will and Testament hereby revoking all former Wills by me at any time heretofore made

In Witness whereof I the said John Tucker to this my last Will and Testament contained in three sheets of paper affixed together to the first and second sheet have set my hand and to this last sheet my hand and seal dated the nineteenth day of January in the thirteenth year of the Reign of our Sovereign Lord George the second by the Grace of God of Great Britain France and Ireland King Defender of the Faith etc. And in the year of our Lord one thousand seven hundred and thirty nine � John Tucker � Signed sealed published and declared by the said John Tucker the Testator to and for his last Will and Testament in the presence of us who at his request and in whose presence we have subscribed our names as witnesses hereto

The before registered Will of John Tucker deceased was proved the 13 day of May 1740 before the Rev�d William Gostling Clerk lawfull Surrogate to ...
... by the oath of Ann Tucker relict of the deceased and sole Executrix named in the said Will to whom administration of the goods chattles and credits of the said deceased was committed she being sworn well and truly to perform the same.
