I give and devise unto my Niece Mary Ann Farmer Widow
Daughter of my Brother Edward Tyler deceased one of my Freehold Messuages or
Tenements bearing the number 127 with the appurtenances or whatsoever thereunto
belonging situate on the East side of White Cross Street in the parish of St Luke�s in
the County of Middlesex and in the occupation of John Allen his undertenants or
Assignees.
And also all that my Freehold Messuage or Tenement with the
appurtenances thereunto belonging situate in Gloucester Court in the parish of St
Luke�s aforesaid in the occupation of ... [thus in the original] Spencer his
undertenants or assignees to have and to hold the said two Messuages or Tenements
with their several appurtenances thereunto belonging unto the said Mary Ann Farmer
her Heirs and Assignees for ever.
Also I give and devise unto Mary Humphrey of
Edenbridge aforesaid Daughter of Edward Humphrey of Edenbridge aforesaid
Shoemaker all my two other Freehold Messuages or Tenements bearing the numbers
126 and 128 with the appurtenances whatsoever thereunto respectively belonging
situate on the said East side of White Cross Street aforesaid in the occupation of Sarah
Gold and ... [thus in the original] Matthews their or some of their undertenants or
Assignees to have and to hold the said two Messuages or Tenements last mentioned
with their appurtenances unto the said Mary Humphrey her Heirs and Assignees for
ever.
Also I give and devise unto the said Mary Humphrey all my Freehold
Messuages or Tenements with the Garden Land and Appurtenances whatsoever
thereunto belonging situate in Edenbridge aforesaid and now in my own occupation to
have and to hold the same to that the said Mary Humphrey her Heirs and Assignees for ever
provided always nevertheless if the said Mary Humphrey shall happen to die
or depart this life before she does marry then and in that case only and after her death
happening in that single state I give and devise the said three Messuages or
Tenements last mentioned with the Garden Land and several Appurtenances thereunto
respectively belonging to my Sister-in-Law Catherine Spencer Widow and my Four
Nephews and Nieces namely William Tyler, Edward Tyler James Tyler John Tyler
and Catherine Hobbs Sons and Daughters of my Brother Edward Tyler aforesaid
deceased to have and to hold to them the said Catherine Spencer William Tyler
Edward Tyler James Tyler John Tyler and Catherine Hobbs their Heirs and Assignees
for ever as tenants in common and not as joint tenants.
Also I give devise and
bequeath unto my said Sister-in-Law Catherine Spencer William Tyler Edward Tyler
and Catherine Hobbs all those my four Leasehold Messuages or Tenements with their
several appurtenances and the Lease or Leases by which to hold the same situate on
the West side of White Cross Street aforesaid in the occupation of Moriss Read and
Co Thomas Davies Gillingship and Edmund Sinclair their or some of their
undertenants or Assignees to hold the said Leasehold Messuages or Tenements with
their several appurtenances unto the said Catherine Spencer William Tyler Edward
Tyler and Catherine Hobbs their Executors Administrators and Assignees for and
during all the rest residue and remainder of all the term or terms of years in the said
Lease or Leases which shall be to come and unexpired at the time of my decease
subject nevertheless to one annuity or yearly sum of thirty pounds.
And I do give and devise unto my Niece Mary Ann Farmer Widow aforesaid one annuity or yearly sum of thirty pounds of lawful money of Great Britain to be chargeable and charged on and issuing and payable out of my four Leasehold Messuages or Tenements hereinbefore given and devised to my said Sister-in-Law Catherine Spencer William Tyler Edward Tyler and Catherine Hobbs and paid and payable by them the said Catherine Spencer William Tyler Edward Tyler and Catherine Hobbs their Heirs Executors Administrators and Assignees to the said Mary Ann Farmer her Heirs Executors Administrators and Assignees yearly and every year during all the rest residue and remainder of the term or terms of years as shall be to come and unexpired of the said Lease or Leases at the time of my decease the first payment to begin and be made at the end of twelve months next after my decease.
Also I give and bequeath unto my Friend John Budgen of Plumstead in the County of Kent aforesaid Gentleman three hundred pounds or Stock in the new four per cent reduced Irish Annuities transferable at the Bank of England to hold to him the said John Budgen his Executors and Administrators upon Trust for the purposes hereinafter mentioned (that is to say) upon trust in the first place to pay and discharge all my funeral expenses whatsoever and from and immediately after payment thereof then upon further trust to divide and pay the then remainder of the said three hundred pounds Stock to and amongst each of the Relations of my late Wife Mary Tyler deceased as he or they in their discretion shall think proper and in such sums or portions as he or they shall think fit to pay the same.
Also I give and bequeath unto Mary Humphrey in the said
Four Per Cent reduced Irish Annuities transferable at the Bank of England for her own
use and benefit only.
Also I give and bequeath unto my Nephews George Tyler and
Thomas Tylers [sic] Sons of my Brother George Tyler deceased and my Nephew
Thomas Bouton each the sum of twenty pounds of lawful money of Great Britain to
be paid to them by my Executors and Executrixes by two instalments of ten pounds
each at the end of six months after my decease and the other ten pounds each at the
end of twelve months next after my decease.
Also I give and bequeath unto Edward
Humphrey aforesaid the sum of twenty pounds of like lawful money to be paid to him
by me Executors and Executrixes at the end of six months next after my decease.
Also I give and bequeath unto my Brother William Tyler the sum of thirty pounds of like
lawful money to be paid to him by my Executors and Executrixes at the end of twelve
months next after my decease.
Also I give and bequeath unto Edward Humphrey
aforesaid the sum of twenty pounds of like lawful money to be paid to him by my
Executors and Executrixes at the end of six months next after my decease.
Also I give and bequeath unto my Maid Servant Mary Mills the sum of five pounds of like lawful
money to be paid to her at the end of six months next after my decease.
Also I give and bequeath unto my said Nephew Edward Tyler my gold watch.
Also I give and bequeath unto my said Nephew William Tyler my silver tankard.
Also I give and bequeath unto my Niece Mary Ann Farmer aforesaid my two large silver tablespoons
and two silver butter boats.
Also I give and bequeath unto my Niece Catherine Hobbs my two silvercandlesticks
Also I give and bequeath unto Martha Cortois of
Woolwirth in the said County of Kent my silver coffee pot the said several specific
legacies to be delivered to the several legatees by my Executors and Executrixes as
soon as convenient after my decease.
Also I give and bequeath unto Mary Humphrey aforesaid all the residue and remainder of my household furniture linen woollen apparel plate liquors and other furniture whatsoever which I shall be possessed of at the time of my death such pieces of plate which I have hereinbefore otherwise specifically ordered and disposed of together also with all my notes and money whatsoever which I shall have in my dwelling house at the time of my decease to have and to hold the said household furniture notes and money to her the aforesaid Mary Humphrey for her own use and benefit.
And as to all the rest residue and remainder of my Estates whatsoever wheresoever of what nature or kind soever and after payment of the expenses of the probate of this my will all my just debts legacies and Executors and Executrixes expenses I give and bequeath for the same unto my Niece Mary Ann Farmer aforesaid and the said Mary Humphrey share and share alike for their own use and benefit.
And it�s my desire to be buried at Maresfield in the same vault with my
dear Wife. And lastly I do make constitute and appoint my Friend John Budgen
aforesaid my Niece Mary Ann Farmer aforesaid Mary Humphrey aforesaid and John
Simmons of Old Street aforesaid appraiser joint Executors and Executrixes of this my
said last Will and Testament and do revoke and make void all and every other Will by
me at any time heretofore made. In witness whereof I have to this my said will
contained in four sheets of paper set my hand to the three foregoing sheets and to this
fourth and last sheet my hand and seal the day and year in the first sheet first written.
