In the name of God Amen The third daie of Maie in the yeares of the raigne of our moste gracious Soveraigne Lord James by the grace of God of England France and Ireland Kinge Defender of the Faith etc. the eight of Scotland the three and fortieth and in the yeare of our Lord God one thousand six hundreth and tenn
I Edmund Waghorne of Pensherst in the county of Kente Yeoman beinge sicke in bodie but of perfecte mynd and remembrance (thankes therefore be given to Almighty God) doe ordaine and make this my presente last will and testament in manner and frome followinge
And first and principally I give and comend my soule into the handes of Almighty God whoe gave it trustinge that by the merittes pretious [merits precious] death and blood shedinge of Jesus Christ his deare and only sonne my alone Saviour and redeemer the same shalbe presented Spott before the Throne of his Majesty And my Bodie to the earth from whence it came in sure hope of resurrection in life eternall

Item I give and bequeath to Daniell Waghorne my brother who I make ordaine and appointe to be myne Executor of this my last will and testamente nyne poundes and tenne shillinges which I nowe have in my Custody and keepinge and also twenty shillinges in the hands of one Thomas Carpenter which he oweth unto me and all other debtes which are due and owinge unto me by any other parson or parsonne whatsoever
And alsoe I give and bequeath unto my saide Executor All my Tymber Woode and tann that is nowe felled or cutt in and uppon Hookes Woode

Item I give and bequeath all the residue of my moveable goodes unto Susan Moyse and Thamar Ashdowne my sisters after the decease of John Waghorne my Father and then equally to be devided betwene them

And I make and ordaine to be myne overseer of his my laste will and testamente my welbeloved neighbour and Freinde Robert Marchant the Younger of Witheham [Withyham, East Sussex] to see the same proved my debtes and legacies paide and funerall Expences Discharged by my said Executor
and I give him for his paines over and above his chardges in and aboute the same five shillings

This is the laste Will of me the said Edmund Waghorne made and declared the yeare first above written concerninge they order and disposicion of all my landes tenementes and hereditamentes within the severall parishes of Pensherst Tunbridge and Bitborrowe [Bidborough] within the said County of Kente

and first I give and bequeath unto Daniell Waghorne my brother all my mansion howse called Swayland together with the barnes buildinges and other edifices thereunto belonginge or appertayninge and also all the Orchardes gardens closses hemp plottes and backsydes in anywise thereto belonginge and also one meadowe called the Greate Meade being into two partes devided And also six other peeces or parcell of lande called by theis severall name and names followinge or by what other name or names sover (that is to say)
The Barley Crofte barne Feilde and one little crofte thereunto adjoyninge Midlefeilde Moscrofte and the little meade contayninge in the whole by estimacon twenty and five acres Whether more or lesse thereof beshad [beside?] scituate lyeinge and beinge within the Parish of Pensherst aforesaide and also two other percells [parcels] of lande theone called by the name of hookes crofte the other by the name of Hookes Wood together with a barne uppon the same contayninge by estimacon Nyne Acres Whether more or lesse thereof be had and are scituate lyinge and beinge in the parish of Tunbridge aforesaide
To have and to holde the same and every of the same with all and singuler thappurtaynannces [the appurtenances] unto the saide Daniell Waghorne his heires and assignes for ever

And further my will and meaninge is that the said Daniell Waghorne my brother his heires and assignes shall pay or cause to be paide out of the saide landes to Edward Waghorne my brother his executors or assignes tenn poundes of Lawfull money in or uppon the feast of Sainte Michaell tharchangell which shalbe in the yeare of our Lord God one thousand sixe hundreth and eleven at or in the mansion howse aforesaide
which tenn poundes Humfrey Ward my tennannte standeth joyntly and severally bounde with me for the paymente thereof to the saide Edward Waghorne my brother

Item I give and bequeath unto Gyles Waghorne my brother fower peeces or parcells of lande called by theis severall name or names follwyinge (that is to say)
two of them called by the name of the Seers the third by the name of old lande and th fourth by the name of Longe Crofte contayninge by estimacon Nyne Acres whether mor or lesse and are scituate lyinge and beinge in Penshert and Bitborrowe aforesaid To have and to hold the same with all and singuler thappurtaynannces unto the saide Gyles Waghorne his heires and assignes for ever

Item I give and bequeath unto Edward Waghorne my brother one parcell of Lande called by the name of Kidds Crofte contayninge by estimacon two Acres whether more or lesse scituate lyinge and beinge in Pensherst aforesaid To have and to holde the same with thappurtaynannces to the saide Edward Waghorne his heries and assignes forever

In Witness whereof to this my present last Will and testamente I the saide Edmund Waghorne have sett my hand and seale yeven the daie and yeare First above written
