Also I give and devise All that my Messuage or Tenement with the Barn Stable Outhouses Buildings Yards Gardens Orchard and several peices or parcels of Land thereunto belonging and therewith used and enjoyed with the Appurtenances situate lying and being in Gillingham in the said County and now or late in the tenure or occupation of George Packham his Assigns or Undertenants and which I lately purchased to me and my heirs for ever of and from Mr William Day Unto and to the Use of my dear Wife Mary Walter and her Assigns for and during the Term of her natural Life
And from and immediately after her Decease I give and devise the same Unto my good friend William How of the Parish of Saint Margaret next the City of Rochester in the said County Yeoman (one of my Executors hereafter named) his Heirs and Assigns for ever Upon Trust and Confidence nevertheless by me reposed in him and them And to the intent and purpose that he the said William How his Heirs and Assigns shall and do with all convenient Speed after the decease of my said Wife sell and dispose and convey the said Messuage Tenement Lands and Hereditaments before mentioned together or in Parcels to any Person or Persons whomsoever for the best Price or Prices that can or may reasonably be had or gotten for the same
And all the moneys arising by and from Such Sale together with the Rents and Profits of the said Such Sale together with the Rents and Profits of the said Premises until such Sale shall be made shall and do as soon as conveniently may be after such Sale pay deliver and distribute unto and amongst such of my Nephews and Neices (to wit) Joseph Nash, John Nash, Elizabeth Nash, Sarah Nash, Mary Nash (Children of my late Sister Sarah Nash deceased late Wife of John Nash also deceased) Martha Lee, Elizabeth Lee and Lee (Children of my late Sister Ann Lee deceased) as shall be living at the time of the decease of my said Wife equally share and share alike to whom I give and bequeath the same accordingly
And my Will and Mind is and I do direct that the said Messuage or Tenement Lands and Hereditaments or
any part thereof shall not at any time after the Sale thereof or of any part thereof in pursuance of this
my Will be in any wise affected by or charged by reason of any Nonapplication or
Misapplication of the Moneys arising by Such Sale or any part thereof pursuant
to this my Will or the Purchaser or Purchasers of the said Premises or any part
thereof be in any sort obliged to see that the moneys arising by such Sale or any
part thereof be in any sort obliged to see that the money arising by such Sale or
any part thereof be or shall be applied by my said Trustee his Heirs or Assigns
pursuant hereto or to the Trusts hereof or have any thing to do therewith or with
the Application thereof
my Will and Mind further is And I do direct that all Costs
Charges Expences Losses and Damages at Law or in Equity or otherwise which
my said Trustee his Heirs Executors and Administrators shall sustain and lay out
or be put unto touching the said Premises or the Execution of this my Will or the
said Trusts by me in him and then reposed shall be always and in the first place
allowed and paid to and be retained and taken by my said Trustee his Heirs
Executors and Administrators out of the said Moneys and Premises Anything in
this my Will contained to the Contrary thereof in any wise notwithstanding
Also I give and bequeath unto Susan Wife of John Wood of Hartlip in the said County
House Carpenter the Sum of five Pounds of lawfull Money of Great Britain
And unto Ann Glazier Spinster Daughter of Samuel Glazier deceased and my said
Wife�s Brother in Law the like Sum of five Pounds of like Money
Also I give and bequeath unto the said William How the Sum of five pounds and five shillings of
lawfull Money of Great Britain
And unto William How an Infant Son of the said William How the like Sum of five pounds and five
shillings of like Money to be paid to or retained by the said William How the Father for his said Son
Also (from and after payment of my just Debts and funeral Expences the Charges of proving this my Will and other incident Charges relating thereto and to the Executorship hereof) I give and bequeath all and every the rest and residue of my ready money Securities for Money Debts Plate Linen Woollen Pewter Brass Beds Bedding Household Stuff and Implements of Household Goods Chattles and personal Estate whatsoever and wheresoever unto my said Wife Mary for and during the Term of her natural life
And from and immediately after her Decease I give and bequeath the same Unto and amongst such of my said Nephews and Neices the said Joseph Nash, John Nash, Elizabeth Nash, Sarah Nash, Mary Nash, Martha Lee, Elizabeth Lee and ___ Lee as shall be living at the time of the death of my said Wife equally to be divided between them share and share alike
And in order the better to ascertain the true Value and Amount of my Personal Estate whereof I shall die possessed or be intitled at the time of my Decease and the Particulars whereof the same shall or may consist it is my Will and Mind And I do direct that so soon after my Decease as conveniently may be my said Executors hereafter named shall and do cause a true and perfect Inventory and Appraisement to be taken and made thereof in Writing by two honest skilfull and indifferent Men to be by them chosen for that purpose And that such two Men do sign and subscribe the said Inventory and Appraisement at the foot thereof with their Names of their own proper hands writing
And I do hereby make nominate and appoint my said Wife Mary and the said William How the Father Executors of
this my last Will and Testament I do hereby revoke and make void all former
Wills by me at any time heretofore made In Witness whereof I the said Nicholas
Walter have to this my last Will and Testament contained in two Sheets of Paper
to each Sheet thereof set my hand And to the last my Seal Dated the Thirty first
day of October in the twenty seventh Year of the reign of our Sovereign Lord
