In the name of God Amen The eight and twentieth daye of December Anno domini 1644 And in the twentieth yeare of the raigne of our Soveraigne Lord Charles over England, Scotland, France and Ireland Kinge, defender of the faith, etc.
I Gabriell Wastell of the parishe of Snt. Peters in the Isle of Thanett & County of Kent, Fisherman, being sicke in body but of good and perfect mynde and memory (praised be God) doe make and ordaine this my Last will and testament in manner and forme followinge
First and principally I Commend my soule into the hands of Almighty God my maker who gave it me trustinge by and through the pretious death and passion of his sonne and my onely Saviour Jesus Christ to have free pardon & Remission of all my Sinnes; And my body I Committ to the Earth from whence it was taken, there to rest in steadfast hopes of a Joyfull resurrection and to be reuinted againe to my soule at the Comminge of my Lord and Saviour Jesus Christ And as concerninge my temporall goods wch [which] the Lorde in his mercy hath beene pleased to make me Steward of in this transitory life; I give and bequeath in manner & forme followinge (that is to say)

Imprimis I give and bequeath unto my eldest sonne John Wastell All that my Messuage or Tenement, Maulthouse, barne, Stable, outhouses, Lands & appurtenances whatsoever thereunto belonginge, scituate lyeinge and beinge at a place called Upton * in the parishe of Snt. Peters aforesaid and now in the tenure & occupation of William Emptage or his assignes, unto my sonne John Wastell and to his heires for ever,
hee yealdinge and payinge out thereof yearely and every yeare unto my sonne Richard Wastell and to his heires for ever twenty pounds half yearely to be paid by even & equall portions;

And if it shall happen the sayde yearely rent of twenty pounds or any part thereof to be behind that then it shall and may be lawfull to and for my said sonne Richard Wastell to enter uppon the sayd Messuages and Lands and then to deteine & occupy and keepe in his owne hands untill the sayd rent of twenty pounds p. ann. be unto him or his heires satisfied Contented and paid
But if it shall fortune my said sonne Richard to dye wthout heires of his body lawfully begotten then my will and meaninge is that then the sayd some of tweny pounds p. ann. before bequeathed unto him out of my messuage and lands shall cease & remaine unto my sonne John Wastell and to his heires forever

Item I give and bequeath more unto my said sonne John Wastell and to his hieres for ever all that my small Messuage or Tenement outhouses lands & appurtenances thereunto belonginge whatsoever scituate and beinge at Upton aforesaid and now in the occupation of James Russell or his assignes

Item I give and bequeath unto my sonne Richard Wastell and to his heires forever, All that my messuage or Tenement barne Stable outhouses Orchards lands & appurtenances whatsoever wherein I now live
Item I give and bequeath unto my said sonne Richard Wastell and to his heires forever, all that my Messuage or Tenement shoppes outhouses & appurtenances whatsoever thereunto belonginge now in the tenure or occupation of George Witherden the elder or his assignes

Item I give and bequeath unto my said sonne John Wastell my third part wch I have of one Vessell or Fisherboate wth the tackle and appurtenances thereunto belonginge Called or known by the name of the Sarah whereof Thomas Warman is now ...

Item I give and bequeath unto my said sonne John Wastell & to his heires; my third parte I have in one Vesstell or Fisherboate wth he tackle and appurtenances thereunto belonginge Commonly called or knowen by the name of the John whereof Thomas Miles was late Master under God

Item I give and bequeath unto Richard Wastell my sonne my two thirds parts of the good vessell or Fisherboate called the blessinge wth the tackle and appurtenances thereunto belonginge whereof the said Richard is now Master under God

Item I give and bequeath unto Martha my now wife one dole of herringe netts ready sea bound wth roapes & other materialls thereunto belonginge, wch I would request one of my sonnes to carry to sea for her
Item I give and bequeath unto my daughter Sarah Wastell one dole of herringe netts ready sea borne wth roapes & other materialls thereunto belonginge, wch I would request one of my sonnes to carry to sea for her
And all the rest of my Netts & roapes whatsoever & wheresoever; I give and bequeath unto my said sonnes John Wastell and Richard Wastell equally to be devided betweene them

Item I give and bequeath unto Martha my said wife my best bedsteaddle, Featherbedd wthall [withall] the furniture thereunto belonginge as it now
And all the rest of my househould stuffe & Implements Corne Cattle & moveables wch are now belongnge to my dwellinge house; I give and bequeath unto my sayd sonne Richard Wastell and to his heires forever

Item I give and bequeath unto Martha my said wife twenty pounds a yeare quarterly to be payd by my sayd sonnes John & Richard equally betweene them; se longe as shee shall Continewe & remaine a widdowe;
but if shee fortune to Change her life and marry : then my will and meaninge is that shee shall have for & duringe the terme of her naturall life tenne pounds a yeare quarterly to be paid by my sayd two sonnes John and Richard as aforesaid
And if they or either of them shall refuse to pay my said wife the said yearely rent before specified accordinge to this my true will and meaninge; then uppon such refusall it shall and may be lawfull for my sayd wife to enter uppon all or any part of my sayd lands to distrayne & the distress or distresses there found to leade dryve or carry awaye & the same to deteyne and keepe untill the sayd rent due wththe arrearages thereof be unto Martha my said wife fully satisfied Contented & paid

Item I give and bequeath unto Sarah Wastell my daughter and the heires of her body lawfully begotten two hundred pounds of lawfull money of England, to be paid unto her in manner and forme followinge (that is to say)
One hundred pounds thereof when shee shall accomplishe & attayne unto her full age of Twenty yeares to be paid by my sonne John Wastell his heires executrs. or administrators;
And the other hundred pounds pcell thereof when shee shall attayne unto the full age of foure & twenty yeares, to be paid by my sonne Richard Wastell his heires executrs. or administrators

And further my will and meaninge is that my said two sonnes John and Richard shall well & truely pay equally betweene them unto my said daughter Sarah Wastell eight pounds a yeare quarterly to be paid untill she shall attayne unto her said age of twenty yeares and noe longer

But if it shall fortune my said daughter Sarah to dye wthout heires of her body lawfully begotten and before shee shall come to receive her sayd portion before bequeathed then my will and meaninge is, that the moneys soe remayninge in my said sonnes hands or any one of them shall soe Continewe and remaine to them and theire heires forever

All the rest of my goods, Cattells, Chattells, bonds, bills ready money whatsoever not before given and bequeathed my debtes, Legacies and funerall expences beinge first paid and discharged I give and bequeath unto my twoe sonnes John Wastell & Richard Wastell equally to be devided betweene them;
whom I make nominate and appoint my full and sole Executors of this my last will and testament; renouncinge and revokinge all former wills by me heretofore made

In Witnes whereof I have to this last sheete (beinge three in number) sett my hand and seale the day and yeare first above written
