Will of Isaac Witherden

of St Lawrence, Thanet, Kent

This is the last Will and Testament of me Isaac Witherden the Elder of the Parish of Saint Lawrence in the Isle of Thanet in the County of Kent yeoman I being of sound and disposing Mind and Memory

First I give devise and bequeath to my beloved Wife Elizabeth Witherden for and during the term of her natural Life (after payment of my just Debts and Funeral Charges) all my Messuages Lands Tenements and Hereditaments and Real Estate whatsoever and wheresoever with the Appurtenances together with the Custody and reasonable using of all my Monies Securities for Money Stocks in the Publick Funds Plate Linnen Apparell Household Furniture Effects Goods Chattels and Personal Estate whatsoever

and from and immediately after the decease of my said Wife I give devise and bequeath one full equal and undivided fourth or quarter part of and in my said Messuages Lands Tenements Hereditaments and real Estate with the Appurtenances and of and in my said Monies and Securities for Money and other my Effects Goods Chattels and Personal Estate unto my son Isaac Witherden and to his Heirs Executors Administrators and Assigns

And I give devise and bequeath one other full equal and undivided fourth or quarter part of and in my said Real and Personal Estate to my Daughter Elizabeth Wife of Jacob Gisby and to her Heirs Executors Administrators and Assigns
And my Will is that her Receipt alone without her said Husband shall at all times be a good Discharge to my Executors for her said fourth part of my Estate or any part thereof and that the same fourth part herein devised and bequeathed to her shall not be subject or liable to the Demand Controul or Intermeddling of her said Husband or to the Payment of his Debts or Engagements

And I give devise and bequeath one other full equal and undivided fourth or quarter part of all my said Real and Personal Estate to my Daughter Susanna Witherden Spinster and to her Heirs Executors Administrators and Assigns

and I give devise and bequeath the remaining one full equal and undivided fourth or quarter part of all my said Real and Personal Estate to my Daughter Hannah Wife of John Constable and to her Heirs Executors Administrators and Assigns

And I appoint my said son Isaac Witherden and my said Daughter Susanna Witherden Executors of this my last Will and Testament
And I do hereby give unto them and each of them full Power and Authority to deduct and reimburse themselves out of the Monies that shall come to their Hands by virtue of this my Will all such Losses Costs Charges and Expences as they or either of them shall sustain pay or be out to in or about the Execution of this my Will or any way concerning the same
And I do hereby revoke all former Wills by me made

In Witness whereof I have hereunto set my Hand and Seal to each of these two Sheets of Paper (which together contain my Will) this fifteenth day of August in the twenty ninth Year of the Reign of our Sovereign Lord George the Third by the Grace of God of Great Britian France and Ireland King Defender of the Faith and so forth And in the year of our Lord one thousand seven hundred and eighty nine Isaac Witherden
