Item I give and bequeath to the poore people of the parishe of Wormeshill aforesaid twenty shillinges to be payd & distributed to them att the discretion of my Wife att the time of my buriall or within three dayes after.
Item I give to every of my children Salomon, James, Elizabeth and Anne to every of them
one chest of the best I have & alsoe to every of them fower payer of my best sheets to be putt
into the sayd Chests,
And I will & give the writings and conteynance of my landes &
tenements to my sayd two sonnes that is so either of them the conteynance & writings that
concerneth his parte of the lande I shall give unto him by this my will to be also putt into their
sayd chests immediately after my decease there to be safely kept & preserved for my said
sonnes severally att the discretion of my executor untill the severall ages of my sonnes is
xxjty yeares & my sayd daughters chests and sheets for them untill theire severall ages of
xxtie yeares and then to be delivered unto them
Item I give & will unto the sayd James my sonne (when he shall accomplish the age of xxjty yeares and not before) all that my lease and tearme of yeares which I have and are yett to come of and in certeine landes lying in Hedcorne called Tavenden to have & to hould to the said James and his assignes for and during all the tearmes of yeares which are yett to come therein and the said leases and the ------- conveyance thereof to be kept & preserved for his use untill his sayd age in his sayd chest as aforesayd
Item I give unto my said two daughters Elizabeth and Anne one hundred poundes of lawfull money of England to be payd to them on theire severall ages of xxty yeares by my executor equally to be devided betwene them if any of them doe dye before her sayd age and without issue of her bodye the surviver to have her parte soe deceased but if shee have issue of her body then her issue to have her parte att such time as shee should have been xxtie yeares of age if shee had lived.
The Residue of all my goods chattells detts moneys and moveables (my detts legacyes & funerall charges being first allowed and deducted) I give & bequeath unto Joanne my lovinge Wife whome I make and ordaine to be my sole executor of this my last will and testament
& my will is that my sonne James shall suffer my sayd wife to have and inioye all the corne which is or shall be sold ----- before my decease upon the lands now in my occupation and also shall suffer her to inioye & have the house I dwell in and the landes belonging to it untill his age of xxj yeares without paying any thinge therefore, which house and landes I payd for & made him the sole purchaser thereof. And as touching the charging receving of the profitts ordering and disposing of all my landes tenements & hereditaments scituate lying & being in the parrishes of Wormeshill, Witchling, Hollingborne, Harrietsham, Boughton Malhearbe, Hedcorne & Smarden or els where in the sayd County of Kent
First I will and devise unto Joanne my Wife all my messuage or tenement wherein I did lately dwell att Norwood in Wormeshill aforesayd and all my landes lying att or neare Norwood aforesayd and all the proffits of woods growing upon the same or any parte thereof and also all yt my messuage & landes in Harrietshame which I lately purchased of Thomas Smoothing To have and to hould to the sayd Joanne & her assignes for & during the tearme of her naturall life & my meaning is that the sayd Joane shall well & sufficiently maintaine educate & bring upp my sayd daughters att her charges & with the Rentes hereafter given them untill theire severall ages of xxjty yeares or their dayes of marriage And shall alsoe att her charge sustaine & keepe all manner of Reparacions of the sayd houses to her devised and pay all rents, suites & services for the same due to the lord or lords of the fee or fees thereof during the said tearme.
Also I will and give to the sayd Joanne my Wife one annuitye or Yearely rent charge of
seaven poundes of lawfull money of England to the issuing and going out of my messuage &
all my land in (near?) Witchlinge to have & to houlde to her & her assignes for & during the
tearme of her naturall life; To be payd halfe yearely � viz att the feast of the Annunciation of
the blessed virgine Marey and at michael the Archangell by even portions.
And if it happen the sayd annuity or yearely som or any parte thereof to be behind & unpayd
by the space of xiiij dayes after any of the sayd feasts then will frome thenceforth it shall be
lawfull for the sayd Joanne & her assignes to distraine for the some.
Item I will & give unto Salomon my sonne when he shall accomplishe his age of xxjty yeares and not before all those my messuages landes and tenements with thappurtenaunces lying and being in Boughton Malhearbe aforesayd Hedcorne and Smarden and also after my wives decease all the said messuage and land with thappurtenaunces in Harrietshame and the said messuage & landes in Wormshill att or neere Norwood aforesaid, To have and to hold to the sayd Salomon and to his heires for ever.
Item I will and give unto James my sonne when he shall accomplishe his age of xxj yeares (& not before) all those my messuages landes & tenements with thappurtenaunces lying and being in Hollingborne and Witchling and the land in Wormeshill which I purchased of the Wades or aney of them To have & to hold to the sayd James my sonne and to his heires for ever.
But if it happen that both my sayd sonnes Salomon & James doe decease and dye before any
of them shall be of the age of xxj yeares without issue of any of theire bodyes lawfully
begotten then I will that all my sayd landes & tenements shall remayne to the heires males of
my brother William Wood of his body lawfully begotten and for defaulte of such issue the
same to remaine to the Right heires of me the sayd Richard Wood for ever.
Provided allwaies and my will & meaning is that if any my sayd landes & tenements shall remaine or come to
the handes or possession of any of the issues of my sayd brother by reason of the death of my
sayd two sonnes as aforesaid and of this my will; then he or they that shall soe have the same
by vertue of the sayd Remainder shall pay or cause to be paid unto my sayd twoe daughters
att theire severall ages of xxj yeares to each of them fower hundred poundes of lawfull money
of England & if any of them doe decease before her sayd age without issue then her sister to
be her heire thereof (if shee have issue) then her issue to have her parte equally to be devyded
betweene them and if defaulte be mayd in the payment aforesaid or any parte thereof contrary
to the forme aforesayd then the said remainder & limitation (?) aforesayd shall be utterly
voyde & of none effect any thinge aforesaid to the contrary notwithstanding.
Item I will that my sayd wife shall have ye guiding governance & administration of the sayd Salomon and James my sonnes & the letting & disposing of the lands & tenements above to them devised & shee to have the receiving of the profitts thereof & of the leases landes above specified untill ye said Salomon and James shall accomplish theire severall ages of xxj yeares & then shee shall make a iuste & true accompte & payment thereof unto either of them for his parte deducting the Charges for theire maintenance & bringing upp & yt shee shall lay out aboute them & my intent & meaning is that my sayd sonne Salomon with the sayd money (as of will suffice if not then out of his sayd parte of lande) shall pay or cause to be payd unto Elizabeth my daughter her one hundred poundes of lawfull money of England for her avancement in marriage when shee shall attaine to the age of xxj yeares or within one month after & if defaulte be mayd in the payment theireof contrary to the intent of this my will then I will that it shall be lawfull for the sayd Elizabeth her heires & assignes to enter into and shall have and inioye all yt my sayd landes in Hedcorne & Smarden now being in occupation of Richard Wood my brother William Woods sonne to her & her heires as a pledge & pawne untill shee or her heires shall be well & truely payd the sayd some of a hundred poundes as aforesayd.
Item I will & my meaning is also that the sayd James my sonne with the sayd money he shall receive upon my sayd wifes accompte to him & out of his parte of landes above to him willed shall well & truely pay or cause to be payd unto Anne my daughter one hundred poundes of lawfull money of England att her age of one and twenty yeares or within one full month after & if defaulte be mayd in the payment thereof contrary to the intent of this my will then I will it shall be lawfull fot the sayd Anne her heires & assignes to enter into & shall have & inioye my sayd messuage and land in Witchling with thappurtenaunces to her her heires & assignes as a pledge or pawne untill shee the sayd Anne or her heires shall be well & truely payd the sayd sume of C� as is aforesayd & shee to pay the sayd Annutye out of it to her mother (if shee be then livinge) And if any of my sayd daughters shall decease before her sayd portion of C� shall be payd then I will that her sister that shall survive shall be her heires concerning the sayd C� & shall have the same penalty or pledge for the non payment thereof as her sister should have had if shee had lived, any thinge to the contrary notwithstanding.
Item my will & meaninge is that my sayd two daughters shall have out of my sayd lands &tenements willed to my two sonnes either of them the yearely rent of five poundes of lawfull money untill their severall ages of xxj yeares if theire mother shall be soe longe livinge but if shee shall be dead then after her decease untill theire sayd severall ages they shall have either of them the yearely rent of tenn poundes which severall Rents shall be payd quarterly att the usuall quarter dayes & for defaulte of payment it shall be lawfull for either of them to distraine for the same in the sayd landes given to my sayd sonnes parte & partlike?
In wittness whereof I the sayd Richard Wood have hereunto sett my marke & seale &
published & declared the same to be my last will the day & yeare First above written.
