Octavo die February Anno Dom. 1643
In the name of God Amen
I John Wood of Marden in the County of Kent Clerke doe make and ordaine this my last will and testament in manner and forme followinge
First I bequeath my soule into the handes of Allmighty God my Creator beleevinge that in and through the merits of my only and alone Saviour Jesus Christ all my sinnes are freely pardoned and forgiven mee And my body unto the Earth from whence it was taken.
First I give to the pore of the p�ish of Marden Twenty shillinges to be distributed unto them by my Executor and executrix within one moneth after my decease.

Itm I give unto my sonne in law William Hall and unto Elizabeth his wife Fower poundes of English mony to be payd unto him and her within one yeare after my decease.
Itm I give unto John Hall, Janne Halle and Elizabeth Hall Fower shillings a peece to be payd unto them within halfe a yeare after my decease.

Itim I give unto Margaret my wife the rents and profitts of all my landes and houses lyinge in Marden shee makinge no wast of any timber trees pollardes and oken tillowes?
And also I give unto her Forty shillings a yeare to be payd unto her quarterly or every quarter issuinge and comminge and arisinge out of my lands in Chart to be payd unto her the first q�ter next and imediatly after my decease duringe her naturall life by my Executor hereafter named for the Education of my children begotten of her body.
And also I give her Ten poundes of reddy mony if any bee or issuinge out of those bondes or bills which shall be then in her custody found in the house.

And if my Executor neglect or refuse to pay as aforesayd the summe of forty shillinges as beforesayd then I will that my wife or any friend put in trust for and by her shall distraine of and from the sayd land lyinge in Charte and the distresses to with hold untill shee be fully payd and contented of all her costs in law and charges layd out.

Itm I will and give unto my sonne Richard Wood all my landes in Chart which my father gave mee, and also that house and land purchased of the Suttens where Mockett now dwelleth in fee simple for ever
provided notwithstandinge and my minde and will truly is that my sonne Richard Wood shall pay or cause to be payd unto his two sisters Judith Wood one hundred poundes and unto Martha Wood one hundred poundes of English mony issuinge out of the sayd landes and such monies as he hath already received of me for the settinge up of his trade within one whole yeare next after my decease.

And if Judith or Martha Wood happen to die before marriage then my minde and will is that the remaindinge portion and goodes herafter bequeather shall be equally devided amonge all my children then livinge.
And my minde and will is that my sonne Richard Wood shall also pay and quarterly allow them for there maintenance from the time and day of my decease untill the full payment of two hundred poundes be fully payd and discharged Fifteene shillinges a peece to eyther of them.

And if the sayd portions of one hundred poundes payable to Judith and one hundred poundes to be payd to Martha Wood be behinde and not payd as aforesayd upon lawfull demande or within Fifteene dayes as also the Fifteene shillinges a peece to them quarterly to be payd as aforesayd my minde and will is then that they the sayd Judith Wood and Martha Wood or any Friendes of there choosinge shall have full power and authority under them to Enter have and possesse for them and unto them all the sayd house and lands with all Appurtenances aforsayd and shall receave the p�fitts thereof unto them selves untill the forsayd portions with all suits and costs and acreages layd out by them be fully contented payd and satisfied.

Itm I give to my daughter Ellen Wood Forty poundes
And to Mary Wood Forty poundes
And to Anne Wood Forty poundes
And to Jane Wood Forty poundes
To be payd unto them at the age of one and twenty yeares or day of marriage, or within halfe a yeare after the sayd dayes which shall happen first.

And for payment of these summes of monies unto my daughters as aforesayd I will my house and land with all the appurtenances wherein Den dwelleth lyinge and beinge upon wansted Fostall in Marden and the tenement and land wherein John White dwelleth to be sold by my wife if shee be then livinge or by my daughters Ellen, Mary and Anne or those Frindes whome they shall put in trust for them to sell these landes and tenements at the best rate and most advantage.

And if my wife die before any of there ages of one and twenty yeares be accomplished or day of marriage come and finished then I will that the rents and p�fitts of the sayd lands and tenements shall be wholy for the education of those my fower daughters ... above named

And if any of them shall happen to die before the times aforesayd be expired the survivinge daughters of those fower shall have there p�ts and portions equally divided betweene them.
And if all of them die I give then the forsayd lands and tenements unto my sonne John Wood and to his heyres for ever.
And if my sonne John Wood die I will and give it to all my survivinge children to be equally devided amonge them.

Itim I give unto my sonne John Wood and to his heyers for ever (after his mothers decease) all that p�cell of land which is now in the occupation of Edward Lanne and the houses in Marden to were?

As concerninge all my moveables or household stuffe whatsoever within dores or without (only the fire wood and Batts for fire excepted which I give unto my wife) I will and give them equally to be devided betweene my wife and those my children herafter named vizt Judith, Martha, Ellen, Mary, Anne, Jane and John

And also Intreat my two lovinge Brothers Willm Wood and Richard Wood to be my Overseers to councill helpe and assist my wife Margaret Wood in the division of my goodes.
And I make my wife Margaret Wood and my sonne Richard Wood to be Executrix and Executor of this my last Will and Testament
And if my sonne Richard refuse it, I will then my wife to be sole Executrix of this my last Will and Testament

Itm that the said Margaret Woodd (at the time of the said Mr John Woodd his Confirmacon of his Will aforesaid in wrytinge and making publishing or declaracon of the Codicill nuncupative aforesaid w�ch was abowt ___ dayes next before the death of him he said
Mr John Woodd and in the moneth of ___ anno dm 1644 (now current) was well knowne accomplited or esteemed to be with child wherewth she is now verye grete for w�ch no provision at all is made by the said Mr John Woodd in and by his last will in writinge, reference so and we�in testam�t
And that the free? intent and meaning of the said Mr John Wood at the time of setteling and making the codicill aforesaid (as the witnesse then p�sent conceaved) was the better hereby to enable the said Margaret his wife to provide for the said unborne child after his the said Mr John Woods death and to that end undonltebe? he willed money mencell? in the said codicill to his said wife, w�ch said money beinge lister.... unmbrel and told out did amount to the summe of ____ of Current English money and not above ....

Mr John Wood, Vicar of Marden was buried 6 Aug 1644 at Marden

John Wood was probably the eldest son of Richard of Elderden, Chart Sutton [see will 1624] & Mary, baptised at Chart Sutton 30 Jan 1585/6.
He had two brothers William (1588-1654) and Richard (1598/9-1646).
