First I give and devise All That Messuage Tenement or Dwellinghouse and the Barn Grainary Stables Outhouses Buildings and Yard thereunto
belonging And also all the Orchard and several pieces or parcels of Land arable pasture and wood thereunto also belonging containing
together in the whole by estimation Fourty five acres more or less with their and every of their Appurtenances situate lying and being
in the Parish of Northborne aforesaid at or near a certain place there called Minneka
And also All those two several pieces or parcels of Arable Land containing together by estimation five acres more or less with the
Appurtenances lying and being in the Parish of Northborne aforesad (All which said Messuage Lands and premises I sometime since
purchased to me and my Heirs of and from John Ellenden and Richard Makey)
And also All that Barn and the Stable Buildings and Lands therunto belonging containing by estimation Seven Acres more or less with the
Appurtenances situate lying and being in the Parish of Northborne aforesaid (which I purchased of and from Richard Fagg)
And also All That Messuage or Tenement and the Yard Garden and Land thereunto belonging contaning by estimation one rood more or less
with the Appurtenances situate lying and being in the parish of Northborne aforesaid (which I purchased of and from Robert Fagg
and Brothers)
And also All That one piece or parcel of Land containing by estimation three acres more or less lying and being in the Parish of
Northborne aforesaid which I purchased of and from Edmund Terry (All which said Messuages or Tenements Lands Hereditaments and
Premises before mentioned are now in my own occupation)
And also All That Messuage or Tenement and the Barn Yard Ground and Appurtenances thereunto belonging and with the same now used and
enjoyed situate lying and being in the Parish of Northborne aforesaid Together with one piece or parcel of Land containing by estimation
one Rood more or less lying and being also in the said parish of Northborne and now or late in the tenure or occupation of Edward
Ferrier or of his Assigns (being part and parcel of the Premises which I purchased of and from Shadrack Mackney)
Unto my Kinsman Leonard Woodward who now lives with me (Son of my late Kinsman John Woodward deceased by Mercy his wife) and to
his Heirs and Assigns for ever
But in case my said Kinsman Leonard Woodward shall happen to die under the age of one and twenty years and without Issue then from and immediately after his decease I give and devise All the before mentioned Messuages Lands Tenements Hereditaments and Premises unto my Kinsman Leonard Woodward son of Elizabeth Woodward of Sandwich in the said County of Kent widow by Richard Woodward her late husband deceased and John Ellenden Son of Thomas Ellenden of the parish of Little Mongeham in the said County Carpenter equally to be divided between them the said Leonard Woodward (son the the said Elizabeth Woodward) and John Ellenden share and share alike and they to take as Tenants in Common and not as Joint Tenants and to their several and respective Heirs and Assigns for ever
Also I give and devise All that Messuage or Tenement and the Barn Yard Garden and Appurtenances thereunto belonging and with the same now used and enjoyed situate lying and being in the Parish of Northborne aforesaid and now or late in the tenure or occuaption of Stephen Fagg or of his Assigns (being the residue of the Premises which I purchased of and from the said Shadrach Mackney) unto him the said Stephen Fagg and to his Heirs and Assigns for ever
Also I give and devise All That Messuage or Tenement and the Shop Barn Stable Outhouses Buildings Yard Garden Orchard and Lands thereunto belonging and with the same now used and enjoyed with the Appurtenances situate lying and being in the Parish of Little Mongeham in the said County of Kent and now or late in the tenure or occupation of the said Thomas Ellenden or of his Assigns (which said last mentioned Messuage and Premises I purchased of and from John Marsh) Unto him the said Thomas Ellenden and to his Heirs and Assigns for ever
Also I give and devise All that Messuage or Tenement and the Barn Stable Outhouses Buildings Yard Garden Orchard and Lands thereunto belonging and with the same now used and enjoyed with their and every of their Appurtenances situate lying and being in the several Parishes of Northborne and Little Mongeham aforesaid and now or late in the several tenures or occupations of myself and Thomas Amos (which said last mentioned Messuage and Premises I purchased of and from John Horne) unto the said John Ellenden and to his Heirs and Assigns for ever
But in case the said John Ellenden shall happen to die under the age of one and twenty years and without issue them from and immediately after his decease I give and devise All the said last mentioned Messuage and Premises unto the said Thomas Ellenden and to his heirs and Assigns for ever
Also I give and devise All That Messuage or Tenement and the Barn Stable Outhouses buildings Yard Garden Orchard and Lands thereunto belonging with their and every of their Appurtenances situate lying and being in the Parish of Staple in the said County of Kent at or near a certain place there called Somerfield and now or late in the tenure or occupation of Thomas Coats or of his Assigns (which said last mentioned Messuage and Premises were given to my be the will of my late Uncle Leonard Woodward deceased) Unto my said Kinsman Leonard Woodward (Son of the said Elizabeth Woodward) and to his Heirs and Assigns for ever
Also I give and devise All that Messuage or Tenement and the Barn Stable Outhouses Buildings Yard Garden Orchard and Lands thereunto
belonging with their and every of their Appurtenances situate lying and being in the Parish of Staple aforesaid and now or late in the
several tenures or occupations of the Widow Cobus and the Churchwardens and Overseers of the Poor of the said Parish of Staple
or one of them their or one of their Assigns (which said last mentioned Messuage and Premises were also given to me by the will of my
said late Uncle Leonard Woodward deceased) Unto my aforesaid Kinsman Leonard Woodward (Son of the said Elizabeth Woodward) and to his
heirs and Assigns for ever
Provided nevertheless and I do hereby will order and direct that the aforesaid Elizabeth Woodward shall and my have hold occupy
and enjoy all the said last mentioned Messuage and Premises until her said Son Leonard Woodward shall attain to the age of one and
twenty years or in case of his Death under that age until such time as he would if living have attained the said age of one and twenty
years and that the said Elizabeth Woodward shall not during that time be charged or chargeable with or liable to the payment of any rent
for the same (any thing in this my will contained to the contrary thereof notwithstanding)
Also I give and devise All That Messuage or Tenement commonly called the Onion Beds with the Barn Stable Outhouses Buildings Yard Garden
Orchard and Lands thereunto belonging containing by estimation Eight acres more or less with the apppurtenances situate lying and being
in the several Parishes of Woodnesborough otherwise Winsborough and Staple aforesaid or one of them in the said County of Kent and now
or late in the tenure or occupation of Isaac Belsey or his Assigns (which said last mentioned Messuage and premises were given
to me by the said Will of my said late Uncle Leonard Woodward deceased) Unto my Housekeeper Mary Taylor widow and her Assigns
for and during the term of the natural life she keeping the same in good and tenantable repair
And from and immediately ofter her decease I give and devise the said last mentioned Messauge and premises unto my aforesaid Kinsman
Leonard Woodward (Son of the said Elizabeth Woodward) and to his Heirs and Assigns for ever
Also I give and bequeath unto the aforesaid Mary Taylor the sum of Fifty Pounds of lawful money of Great Britain to be paid to her
within three weeks next after my decease
Also I give and bequeath unto Elizabeth Petman Spinster Daughter of William Petman of Stable aforesaid yeoman the sum of Fifty
pounds of lawful money of great Britain to be paid to her when and as soon as she shall have attained to the age of one and twenty years
Together with Inerest thereupon at and after the rate of Four pounds per Centum per Annum to commence one twelve month after my decease
Also I give and bequeath unto Elizabeth Woodward Daughter of the aforesaid Elizabeth Woodward widow the sum of Fifty Pounds of
lawful money of Great Britain to be paid to her when and as soon as she shall have attained to the age of one and twenty years together
with Interest thereupon at and after the rate of Four pounds per Centum per Annum to commence one twelve month after my decease
Also I give and bequeath unto Esther Taylor wife of George Taylor of Northborne aforesaid Labourer the sum of Fifty Pounds of
lawful money of Great Britain to be paid to her within twelve months after my decease
Also I give and bequeath unto the aforesaid Mary Taylor the pair of Drawers in my best Chamber and the several things in them and also the Bed in my best Chamber and furniture to the said Bed belonging
And as to all the rest and residue of my Goods Chattels Effects Stock and Crop Debts due and owing to me money securities for mney and personal Estate whatsoever and wheresoever and of what kind or nature soever the same may be at the time of my decease I give and bequeath the same and every part and parcel thereof (from and after the payment of all my just Debts the Legacies aforesaid my Funeral Expences and the charges of proving and executing this my Will) unto the aforesaid Leonard Woodward (Son of the said John Woodward and Mercy his wife) and to his Executors Administrators and Assigns absolutely to and for his and their own use and benefit
But in case the said last mentioned Leonard Woodward shall happen to die before he shall attain to the age of one and twenty years then and in such case immediately after his decease I give and bequeath all my said residuary personal Estate (which shall not have been applied for the maintenance or bringing up of the said last mentioned Leonard Woodward) unto the said Leonard Woodward (Son of the said Elizabeth Woodward) and John Ellenden equally to be divided between them share and share alike
And whereas my aforesaid two Kinsmen Leonard Woodward Leonard Woodward and the said John Ellenden are at present minors under the age
of one and twenty years Now my will and meaning is and I do hereby authorize impower and direct the said Thomas Ellenden his Executors
and Administrators in the mean time from and after my decease and until my said two Kinsmen Leonard Woodward and Leonard Woodward and
the said John Ellenden shall severally attain to the age of twenty one years to receive the rents issues Interest and produce of all
and singular my said Real and personal Estates by this my will given and bequeathed to them repectively and to give receipts and
discharges to the persons paying the same
And also to manage and improve in all respects whatsoever to and for their repective uses and benefits the respective Estates and
Fortunes given and bequeathed to them by this my will and to lay out all or any part of such rents Interest produce and Improvements
as shall arise from or be made of and produced by their respective Estates and fortunes to and for their respective maintenances
educations uses and benefits
And to account with them respectively for all such rents Interest produce and Improvements as shall arise from or be made of and
produced by their said respective Estates and Fortunes when and as they shall respectively attain to the age of one and twenty years
It being nevertheless my will and meaning that each of them my said Kinsmen Leonard Woodward and Leonard Woodward and the said John
Ellenden may have the full benefit of the Rents Interest and produce of his own respective Estate and Fortune and not one of them derive
any benefit of advantage from the Estate or Fortune of the others or other
And my will and meaning further is and I do hereby expressly declare that the said Thomas Ellenden his Executors or Administrators
shall not be charged or chargeable with or accountable for more of the aforesaid monies and Estates of my said Kinsmen Leonard Woodward
and Leonard Woodward and John Ellenden respectively than he or they shall actually receive or shall come to his or their respective
hands by virtue of this my will nor with or for any loss which shall happen of the said monies and Estates of my said Kinsmen Leonard
Woodward and Leonard Woodward and John Ellenden respectively so as such loss happen without the wilful default of the said Thomas
Ellenden his Executors or Administrators
And also that it shall and may be lawful to and for the said Thomas Ellenden his Executors and Administrators in the first place by and
out of the Promises respectively to deduct and reimburse him and themselves respectively all such loss costs charges expences and
damages as he they or any of them shall sustain expend or be put unto for or by reason of the performance of the Trusts hereby in him
and them reposed or the management and executions thereof or any other thing in anywise relating thereunto
And I make constitute and appoint the said Thomas Ellenden and Leonard Woodward (Son of the said John Woodward) joint Executors of this
my last Will and Testament
And lastly I revoke all former wills by me made
In Witness whereof I the said Leonard Woodward the Testator have to this my last Will and Testament contained in five sheets of Paper
annexed together to the first four sheets thereof set my hand and to this fifth and last sheet thereof my hand and seal the day and
year first aforesaid
