Will of William Woodruff

of Walmer, Kent

I give and bequeath unto my daughter Susanna the Wife of Thomas Austen the sum of One hundred Pounds of lawful money of Great Britain
And I do hereby give and bequeath to my daughter Charlotte the Wife of William Long all sum and sums of money that shall be due and owing by or from the said Wiliam Long to me at the time of my decease

Also I give and bequeath the sum of One hundred Pounds of lawful money aforesaid unto my three Grandchildren Edward Prebble Ann Prebble Spinster and Walter Prebble (the children of my late Daughter Elizabeth Prebble deceased) equally to be divided between or amongst them my said three Grandchildren share and share alike

I give devise and bequeath All and every my Freehold Messuages lands tenements hereditaments and real estate whatsoever and wheresoever and also all my Goods Chattels and effects debts due and owing to me money securities for money money in any of the Public Stocks or Funds of this Kingdom and all other my Personal estate whatsoever and wheresoever unto my two Friends John Holtum the Younger of Walmer aforesaid Builder and James Wise of Deal in the said County of Kent Builder their heirs executors adminstrators and assigns according to the nature and quality therof repectively
Upon Trust that they the said John Holtum and James Wise or the survivor of them or the executors adminstrators or assigns of such Survivor shall and do with all convenient speed after my decease sell dispose of call in compel payment of and convert into money the said Personal estate and effects or such part thereof as shall not consist of money
And upon trust that they the said John Holtum and James Wise or the survivor of them or the heirs or assigns of such survivor shall and do absolutely sell and dispose of my said freehold and real estates either entirely and altogether or in parcels by Public auction or Private contract to any person or persons willing to become the purchaser or Purchasers thereof for such price or prices or sum or sums of money as to my said Trustees or Trustee for the time being shall seem reasonable and shall and do enter into make and execute all such contracts Covenants Agreements Conveyances and Assurances as they or he shall deem expedient for effectuating such sale or sales

And I do hereby declare that the said John Holtum and James Wise their heirs executors administrators and assigns shall stand and be possessed of and interested in the monies to arise by the Sale or Sales of my said Freehold and real estates and of and in the monies to arise by the sale disposition calling in compelling payment of and conversion of my said Personal estate and effects (not consisting of money) and of and in such part of my said Personal estate as shall consist of money subject to and from and after payment of all my just debts funeral and testamentary expenses and the Legacies aforesaid upon the trusts hereinafter mentioned (that is to say)

In trust to pay assign and transfer one full equal fourth part or share of the said Trust monies unto my Son William Woodruff the Younger his executors adminstrators and assigns absolutely.
As to one other full equal fourth part or share therof In trust to pay assign and transfer the same unto my said Daughter Susanna Austen her executors administrators and assigns absolutely
As to one other full equal fourth part or share thereof In trust to pay assign and transfer the same unto my said Daughter Charlotte Long her executors administrators and assigns absolutely
And as to the other or remaining one full equal fourth part or share of and in the said Trust monies In trust to pay assign and transfer the same unto my said three Grandchildren Edward Prebble Ann Prebble and Walter Prebble in equal shares and to their respective executors administrators and assigns

I appoint the said John Holtum and James Wise joint Executors of this my Will
And I declare that the receipt or receipts of the Trustees or Trustee for the time being acting in the Trusts of this my Will for any sum or sums of money payable to them or him under the Trusts aforesaid shall effectually discharge the person or persons to whom the same shall be given from the money therein expressed or acknowledged to be received and that such person or persons shall not be answerable or accountable for the loss misapplication or non application therof

And I declare that my said Executors and Trustees and the Trustees or Trustee for the time being of this my Will shall not be answerable one for another and by no means for involuntary losses And that they shall be allowed and may retain to and reimburse themselves all their Costs Charges Damages and Expences to be occaisioned by the due execution of the Trusts hereby in them reposed

And I hereby revoke all my former Wills
In Witness whereof I the said William Woodruff the Testator have to this my last Will and Testament contained in two sheets of Paper annexed together set my hand the day and year first aforesaid

Signed by the said Testator as and for his last Will and Testament in the presence of us present at the same time who in his presence and in the presence of each other have hereunto subscribed our names as attesting witnesses.

John Holtum of Walmer Builder and James Wise of Deal Builder the Executors named in this Will were duly sworn as usual and that the Goods chattels and Credits do not amount in Value to the Sum of Two hundred pounds
