Deed from Nathan Bowen for Burial Ground Driveway, 5 Dec 1868

This indenture made the fifth day of December in the year of our Lord one thousand eight hundred and sixty-eight between Nathan Bowen and Lurilla B. Bowen of Newport, Herkimer County and State of New York of the first part, and

Dexter of the second part, witnesseth,

that the said parties of the first part, for and in consideration of the sum of two hundred and six dollars ($206) to them in hand paid by the said parties of the second part, the receipt whereof is hereby acknowledged, have granted, bargained, sold, remised, released, aliened, and confirmed, and by these presents do grant, bargain, sell, remise, release, alien, and confirm unto the said parties of the second part, in their actual possession now being, and to their heirs and assigns forever,

All that certain piece or parcel of land situate in the village of Newport, Herkimer County and State of New York, bounded and described as follows viz: Beginning at the side of the highway at the North East corner of Miss Ruth Ann Wilcox's house lot and running thence, Westerly along the north line of said Miss Wilcox's land and the North line of the Burial lots heretofore deeded by Jeremiah Fenner and Nathan Bowen to P.P. Barney, R.D. Kirck, Mrs. L.C. Barry and others 493 1/2 feet from said highway; thence northward at right angles along the line this day deeded by Nathan Bowen & wife to S. Perry 55 ft; thence Easterly on a line parallel with the first mentioned line 86 ft; thence southerly 45 ft to a point within 10 ft of the first mentioned line; thence westerly 10 ft; thence northerly 35 ft to a point within 10 feet of the North line of land hereby intended to be conveyed; thence westerly on a line parallel with said North line sixty-six feet to a point within 10 feet of the land sold to S. Perry; thence southerly 35 feet to a point within 10 feet of the first mentioned line; thence easterly 10 feet north of first mentioned line 483 1/2 feet to the highway, thence southerly along the highway 10 ft to the place of beginning.

Intended as a public drive or carriage way of ten feet width from the highway to the land this day deeded to S. Perry and thence North and thence Easterly & thence southerly around a parcel of land retained by said Bowen to sell for burial lots for the use of the parties of the second part & others to use for the purpose of going to and from the burial ground at all times.

And also the corners of four lots are to be circled so as to measure back on said lots 2 ft from the corner to the circle. Said corners are to be the NE corner of the NE lot, the SW corner of the SW lot, and the NW corner of the NW lot retained by said Bowen, and the SW corner of the land North of the driveway from the road. The parties of the second part are to build and maintain a gate on the highway, said Bowen to build the necessary fence between his land and said highway or driveway and maintain the same.
