Will of Algernon Farr, dated 31 Dec 1909

I Algernon Farr, of Springfield in the County of Sangamon and State of Illinois, being of sound and disposing mind and memory, hereby make, declare and publish this to be my last will and testament.

FIRST, I am not now indebted to any person or persons and do not expect to be so indebted at the time of my death, but it is my desire that my funeral expenses and all other debts, if any, be promptly paid by my executor out of my personal estate.

SECOND, It is my desire and request that my wife, Ardelia B. Farr, in case she shall survive me, shall make provision, either by gift or by bequest in her will, to Martha Maddox to the amount of Three Thousand Dollars. The said Martha Maddox has for many years been the friend and companion of my said wife and has been a member of my family and has endeared herself both to my wife and myself, and I express this desire and request as an evidence of my good will for the said Martha Maddox and to repay her for her kindness to my said wife. The request herein expressed is not imperative but is left to the sound discretion of my said wife, and I doubt not that she will carry out my reasonable wishes in this regard.

THIRD, I give and bequeath to my brother Benjamin Farr, for and during the period of his natural life, the sum of $250 per annum, to be paid to him each year as hereinafter provided.

FOURTH: I give and bequeath to my beloved wife, Ardelia B. Farr, all the rest and residue of my personal estate of every kind to be used, owned and enjoyed by her as her own property.

FIFTH: I give and devise unto my wife, Ardelia B. Farr, all my real estate which I now have or may hereafter acquire however described and wherever situated for and during the period of her natural life.
I give and devise to my brother, Miles Farr, of DeKalb in St. Lawrence County, New York, and his heirs, the undivided four-fifths of the real estate herein before devised to my said wife for her life, subject, however, to her life estate therein, and in case my said brother, Miles Farr, shall depart this life before me, then I give and devise to any child or children of my said brother Miles, in equal parts amongst them, the share of real estate which my said brother Miles would have taken if living.
I give and devise to Melancthon A. Barr, of Detroit, Michigan, son of my deceased sister Mary Barr, and his heirs, the undivided one-fifth of the real estate so devised to my said wife for her life, subject, however, to her life estate therein, and in case my said nephew, Melancthon A. Barr, shall depart this life before me, then and in that case I give and devise to any child or children of the said Melancthon A. Barr, in equal parts amongst them the lands which their said father, Melancthon A. Barr, would have taken if living.

SIXTH: It is my will and desire that the annuity of $250 herein bequeathed to my said brother Benjamin Farr, during the period of his natural life, shall be paid to him annually by my said wife, Ardelia B. Farr, so long as she shall live, and after the death of my said wife, said annuity shall be paid by my brother Miles Farr and said annuity shall be a charge upon the lands herein devised to my said brother Miles Farr.

SEVENTH: My beloved wife, Ardelia B. Farr, has been my companion in life for more than a generation. We have lived together in entire peace and happiness and I make no doubt she will in all respects carry out my reasonable wishes in this will expressed, but in case my said wife, either through change in her own mind or by reason of the influence of designing persons, should decide to renounce this will and take that portion of my estate which would descend to her under the statutes of the state of Illinois and her dower in my real estate, then and in that case it is my desire that all my real estate, lands and lots not descending to my said wife under the said statutes shall go in fee to my said brother Miles Farr and to my said nephew Melancthon Barr in the proportions of four-fifths to my said brother and one-fifth to my said nephew, and in that case it is my wish and desire that the annuity of $250 herein provided to be paid to my said brother Benjamin Farr shall be paid to him by my brother Miles Farr during his lifetime and shall be a charge on the lands devised to my said brother.

EIGHTH: The provisions herein made for my said wife shall be taken and received by her in leiu of dower, widow's award, and all statutory provisions for the benefit of widows.

NINTH: I nominate and appoint my said wife, Ardelia B. Farr, to be the executrix of this my last will and testament and desire that she shall not be required to give any bond for the performance of her duties herein as I have absolute confidence in her integrity.

IN TESTIMONY WHEREOF I have hereunto set my hand and seal this 23 day of November A. D. 1894.
