Hawkins Co. Court Minutes p. 539 Joseph H. Alvis to Henry G.
Wax Trustee for Geo R. Powel Registered the 25th January 1862 at
11 O'Clock A.M. This indenture made & entered into this 24th day
of January in the year 1862 by and between Joseph H. Alvis of
the one part and Henry G. Wax of the other part both of the
County of Hawkins and State of Tennessee, Witnesseth that the
said Joseph H. Alvis for and in consideration of the sum of five
dollars to him in hand paid and the other considerations herein
after mentioned hath and by those presents doth grant bargain &
sell unto the said Henry G. Wax the following real and personal
property to wit all the interest that I have said Joseph H.
Alvis have in and to the lands of which my father Charles D.
Alvis died siezed & possessed being the same lands on which
lived at the time of his death also all the interest that I have
in and to the slaves Bill , Sam & Charlotte which also belongs
to the Estate of my said father Charles D. Alvis. I do also
bargain & sell unto the said H. G. Wax one yoke of steers mostly
red, one with a white face, also one jack of a mouse colour to
have & to hold said land & personal property unto the said H. G.
Wax, his heirs or assigns forever. But this deed is made for
the following use & trust & for no other purpose that is to say
I am indebted to George R. Powel in the sum of Four hundred &
sixty-one dollars & sixty-five cents due by note of this date
now I am desirous of securing the said Powel in the payment of
said note. Now if I should pay said note twelve months from
this date then this deed is to be void & of no effect but if I
should not then & in that case the said H.G. Wax as Trustee
shall sell said property to the highest bidder for currency
which passes in common transactions after having advertized the
same for the space of twenty days and the proceeds of said sale
shall be applied to the payment of the debt & costs and if any
should remain it is to be paid over to said Joseph H. Alvis. It
is understood & agreed that said Alvis is to remain in peaceable
possession of said property until default is made on the payment
of said debt as above stated. Witness my hand & seal this date

State of Tennessee Personally appeared before me James H.
Vance, Hawkins County Clerk of the County Court of said County
the within named Joseph H. Alvis with whom I am personally
acquainted and acknowledged that he executed the foregoing deed
for the purpose therein contained . Witness my hand at office
the 24th day of January 1862.
Hawkins Co. Court Minutes p. 197 Tuesday October 6, 1868 Wilson
Johnson vs Joseph H. Alvis & others
In this case it appearing to the Court that the defendants
George Alvis Jr, Witt Alvis and Rebecca Alvis, are minors and
that the complainant is their general guardian and that this is
a proper case for them to answer by guardian ad litam. It
therefore ordered and decreed by the Court that William H.
Watterson be and he is hereby appointed guardian ad litem to
defend this suit for and on behalf of said minors And it
further appearing to the Court that the defendants, Wm A. Alvis,
Charles Alvis, Sr, Moses Johnson and wife Jane Johnson, the
heirs at law of Jefferson Alvis dec'd whose names and number are
unknown, George Alvis, Sr, Elias Alvis, and William White, are
all properly before the Court by regular summons and
publication, made in a newspaper for non residents and they
having failed to answer or make defence within the time
prescribed by law, It is further ordered and decreed by the
Court .........
Hawkins Co. Court Minutes p. 202 Wednesday October 7th 1868
Wilson Johnson vs Joseph H. Alvis & others This cause coming on
to be heard before the Hon. James P. Swan, Judge on this 7th day
of October 1868. Upon the bill this judgement pro confessio and
answers on file and it appearing to the Court that this is a
proper case for a reference to the Clerk and the parties
assenting thereto, It is ordered adjudged and decreed by the
Court that the Clerk inquire and report to the next special term
of the Court and show whether or not the land mentioned in the
pleadings is so situated that the same may be partitioned to
advantage and without injury to the parties interested therein,
or whether or not the same should be sold for partition. And it
is further ordered by the court that in taking proof for the
purpose of making this report, the Clerk may serve notice only
on the compolainent and the defendant Joseph H. Alvis, and on
William H. Watterson the Guardian of the minor defendants.
Hawkins Co. Circuit Court Record 1868-1871 p. 241, 26 Jan 1869
Wilson Johnson vs Joseph H Alvis & others decree This cause
came on to be futher heard before the Honorable James P. Swan,
Judge & c, this 26th day of January 1869... That about the year
1863, Charles D Alvis died intestate in Hawkins Co leaving a
widow, who has since died, that he then owned in fee, a certain
tract of land of 360 acres, more or less, lying in the 17th
Civil District of Hawkins Co., adjoining the lands of William
Clepper, Russell Courtney, Powell Robinson, E. J. Henard, James
T. Brice, James Brooks and perhaps others, and upon which he
resided for some years before his death: that the said Charles
D. Alvis, had the following children, viz: William A. Alvis,
Joseph H. Alvis, Charles Alvis, Jefferson Alvis, John Alvis,
Mary Alvis, who married Michael Clepper, Jane Alvis, who married
Moses Johnson, George Alvis Sr., Jackson Alvis and Elias Alvis;
that said Jackson Alvis has also died intestate, unmarried and
without issue; that said John Alvis is also dead, leaving eight
children and heirs at law, viz Charles Alvis, Jr. Catharine
Alvis, Jane Alvis, Lucinda Alvis, William Alvis, George Alvis,
Jr, Witt Alvis and Rebecca Alvis ; that said Jefferson Alvis is
dead, Leaving children residing in the State of Texas, whose
names are unknown; that the complainant has purchased the shares
or undivided interests of the said William A. Alvis, Michael
Clepper and his wife Mary Clepper, and the shares of the first
five mentioned heirs of said John Alvis, dec'd in said land,
making his share therein two ninths and five eights of one
ninth, undivided, and that the share of the defendant, Joseph H.
Alvis, has been sold under execution and bid off by the
defendant William White. And it further appearing from the
report of the clerk, which not being excepted to is in all
things confirmed, that said land is so situate that the same
cannot be partitioned to advantage among the parties entitled
thereto, but that the same ought to be sold for partition. It is
therefore ordered, adjudged and decreed by the Court, that the
Clerk of this Court, as Special Commissioner proceed to sell
said land at public sale, to the highest bidder, on the
premises, after advertising the same in writing, for thirty or
more days, at some public place near the premises, at the Court
House door, and at three or more public places in said county,
and sell the same free from the equity of redemption, and it is
further ordered and decreed by the Court that the Clerk may sell
said land in one or more parcels, or in such manner as he may
think best for the interest of the parties, and he will require
one hundred and fifty dollars to be paid down, for the payment
of Costs and Counsel fees, and for residue of purchase money he
will give a credit of two years, and take notes therefor with
good security, bearing interest from date, and a lien will be
retained on the land to secure the same. In making said sale
the Clerk will reserve any wheat crops that may be growing on
the land,for the benefit of tenants, or persons sowing the same,
but giving to the purchaser or purchasers the right to rent out
of the same. The Clerk will make his report of the sale to the
next term.
Hawkins Co. Court Minutes Wednesday February 3, 1869 p. 278
Wilson Johnson vs Joseph H. Alvis & others In this case a decree
having been made at the present time ordering a sale of the land
mentioned in the pleadings and with ordering the Clerk to sell
the same in one or more parcels if he thinks it advisable. It
is therefore further ordered and decreed in this cause that the
Clerk may employ a surveyor to divide the land in proper sized
tracts if he deems it advisable and in this case the cost of the
survey will be taxed in the bill of costs and be made a part of
the costs of the cause.
Monday April 3, 1876, p. 334 Thomas J. Alvis, Benson T. Alvis &
Bud Alvis (ex parte) Order It appearing to the Court that
the above named parties are children of Joseph H. Alvis dec'd
and are minors under fifteen years of age & under the statute in
such cases made & provided the said Joseph H. Alvis leaving no
surviving Widow are entitled to have a years support & the
property exempt from execution set apart for their own use &
benefit. It is therefore ordered that Edward Cobb, John
Klepper, & James Klepper be & they are hereby appointed to lay
off & set apart the same & make report thereof to the next term
of this Court.

You want even more confusion? Since I wrote that, I have
discovered a third Mason family in Stafford--and the matriarch
of that family was a Frances. A Frances Mason (first husband
unknown--may have been Richard) married William Wentworth
Matheny--and in his 1705 will Matheny left 100 acres to William
Mason, his stepson. Wm. was probably born about 1690. He
remained in Stafford. The George Mason of Aquia I mentioned last
time did not--he moved to Prince William Co. ca. 1727 and died
there ca. 1729. His widow, Anaple Wigginton, married William
Butler and continued to live in Prince William. I don't know
that George Mason of Aquia and Anaple had daughters, but I think
their sons were George, William and Benjamin. George and William
were in Prince William Co. Benjamin moved to Loudoun--and so
later, did the children of George (I think Benjamin, William,
Anaple and Susannah).
William Mason's 100 acres was next to the Hope Patent south of
Aquia Creek. He died in 1745. No will, but a property statement
which includes both John Mason and James Jones as debtors. I
suspect this James Jones was the husband of Frances Mason and
that she was the daughter of William Mason (wife unknown--Jane
Mason was his spouse when he died, but...). In 1756, John Mason,
married to Mary Nelson, was living on 100 acres south of Aquia
Creek--looking very much like a son of William Mason. If you're
familiar with the Overwharton Parish records, most of those
Masons are children of John Mason and probably brothers and
sister--Daniel, George, Frances. George married Eliz.
Duwest--they had a daughter Frances--so the name runs in the
family. Later John Mason moved west and north of Aquia Creek,
very close to Daniel Mason who leased land at the juncture of
Aquia Creek and Cannon Run. In the 1780s, their taxes were often
taken the same day--along with a third Mason, Richard, who may
have been a younger brother of John, Daniel, George.
If I were a betting person, I'd put my money on that William
Mason south of Aquia to be the father of Frances Mason Jones,
particularly as the name James Jones shows up in William's
estate settlement!
