"Named in Settlement of the estate of Thomas Graves 1768. The
following information is taken from Louise Graves' wonderful
book about the Graves family: "In the year 1753 or 1754, John
Graves, his wife and 4 children, moved from Spotsylvania County,
Virginia to that sparely settled area of Orange County N. C..
which in 1777 became Caswell County. His sister Eleanor,
husband Thomas Kimbrough and family, moved there about the same
time.
Land was acquired by John Graves in Orange Co: 630 acres by deed
from Hugh Dobbin; early grants of 21 acres on Ready Fork, 394
acres on Country Line Creek, and 457 acres on Country Line
Creek. Later grants in Caswell County were made to him. Mrs.
Charles Iverson Graves, whose husband was a great-grandson of
John Graves stated that his "home was on the eminence quite near
the public road leading from Greensboro to Milton, NC."
Louisa Co, Rec. Deed Book D1/2, p. 133, references "John Graves
of N.C., eldest son and heir at law of Thos. Graves of Spots.
Co., he confirms to Wm. Pettus, who was one of his father's
executors, the sale of a tract of land and a mill lately
belonging to Thomas Graves."
The petition reads: "Novr. 22, 1782, Jno. Graves of North
Carolina, eldest son and heir at law of Thos. Graves of Spots.
Co., Va. to Wm. Pettus of Va. Whereas, sd. Thos. Graves, decd.
by his last Will and Testament, after certain legacies were
paid, directed the remainder of his estate equally divided among
all his children of their heirs, but did not empower his
executors to convey the same, the title so far, therefore,
remains vested in sd. John Graves, as eldest son and heir at
law, etc., and it being found necessary to sell and convey
certain tracts of land in Spots. Co., whereof sd. Thomas Graves
died seized, etc., this indenture witnesseth, the John Graves,
for the sum of L$451, gold or silver, to be paid by the said
Pettus to the Executors of the sd. Thomas Graves, the sd.John
Graves hereby conveys to the sd. Pettus 399 acres in
Spotsylvania Co, etc. ... Witnesses, Joseph Graves, John Graves,
William Graves, Jr., John Arnold, John W. Pettus, April 17,
1783." (Spots. Co. Rec. Deed Bk K , 1782-85, p. 372, Crozier.).
The name of John's first wife is not known. His oldest children
were Thomas, James (died unmarried), Ann (who married Barlett
Yancey, Sr.) and John Herndon Graves.
After John Graves married Isabella Lea, they had the following
children: Mary m. John Kerr; Barzillai; Solomon; Azariah; and
Isabella who m. Thomas Slade. This differentiation as to the
mothers of the children is based on the painstaking study of Dr.
John Goodwin Herndon, which provides inferential but conclusive
proof that Isabella Lea Graves, who m. John Graves, Sr., was not
old enough to have been the mother of his older children. She
was born after 1737 as the birth of her eldest sister, Nancy,
was 1837. Isabella Lea would have been only 8 or 9 years older
than John Herndon Graves, her stepson, who was born in 1746.
Isabella Lea was the daughter of James and Ann Herndon Lea.
John Graves, Sr., has been confused with his son John Herndon
Graves (who is generally shown in official records as John, Jr.,
John and John, Sr. after the death of his father) as being
representative in the House of Commons in the NC General
Assembly, 1788-1791-1792, and a member of the State Conventions
to consider the Federal Constitution in 1788 and 1789 as a
representative from Caswell County....
John Graves died intestate. The exact date of his death is
unknown. Administration Bonds, however, were filed with the
Caswell Co. Court Jan. 18, 1792, appointing Azariah Graves and
Solomon Graves executors of their father's estate, with John
Williams, Esq. and Jesse Carter named as bondsmen.
The March 30, 1792 Caswell Court: "ordered that administration
of the estate of John Graves, decd., be Granted to John & Thomas
Graves Jointly with their Brothers Solomon & Azariah Graves, who
qualified accordingly...."
The inventory of the estate of John Graves is in Caswell Co.
Will Bk. B, p. 459. The originals are in the NC Archives in
Raleigh filed under "Caswell County Estate Papers-John Graves".
They read as follows:
"An Inventory of the Estate of John Graves, Sr. Late of Caswell
County Deceased. Taken at the late dwelling house of said Dec'd
on the 20th day of March 1792- Negroes - 17; Horses - 17 head;
Cattle - 81 head; Hogs- 169 head; 1 wagon, 1 wagon (stage);
sheep 25 head; 1 still; crop of corn, tobacco, hemp, etc. Sundry
Plantation tools, cash in hard money $270. A riding chair and
horse given to the widow by consent of all the legatees
(extraordinary) also one smith's anvil & Bellows given to
Barzillai Graves by consent of the legatees & quantity Cyder."
Legatees listed as: Isbell Graves, Azariah, Thomas, Barzillai,
John & Solomon Graves, John Kerr, Ann Yancy and Thomas Slade.
Also an Inventory of that part of the Estate which was left to
the widow during her life: "4 feather beds & furniture, one
black walnut table, 15 chares, 1 looking glass, 2 sugar boxes, 2
chests, 3 trunks, parcel old books, 1 spice morter, 1 case and
bottles, 6 jugs, 2 batter rolls, 17 earthen plates, 4 bottles, 2
setts cups & saucers, 1 box iron etc., 1 flatt iron, fire tongs
& shovel, 2 glass tumblers, 1 vinegar cruet, 2 washington tubbs,
4 pails, 1 churn, 2 old cotter wheels, 2 flax ditto, 19 pewter
plates, 6 pewter dishes, 15 spoons, 10 basons, 2 cases of knives
& forks, 1 tea kettle, 1 coffee pot, 1 small bowl, 1 pint mug, 1
black jack, 4 potts, 2 skillets.
Also an Inventory of the part of the Estate that has not been
divided: "4 new hogsheads, 18 old ditto, 8 cyder casks, 2 small
ditto, 2 powdering tubs, 3 small barrels, 1 iron riddle, 1 wood
ditto, 7 sacks bags, 5 bee hives, 2 pair steel yards, 2 small
barrels, 2 old shott guns, quantity of salt, 1 grind stone,
small barrel nails, 1 pair money scales, 2 gimbletts,, 1 whip
saw, 2 cross cutt saws, 1 old bearsharo & coulter, parcel reap
hooks, 2 sithes & cradles, parcel old files, 1 steel trapp, 3
iron wedges, 2 foot adds, smiths tongs & hammers, 1 old stone
hammer, 1 smith's vise, 2 small hides leather, 2 raw hides, some
bells."
The inventories above are shown as photocopies in Louise Graves'
book. They bear the signatures of the legatees, all of whom
actually signed their names (as opposed to making their marks),
thereby providing some evidence that they were at least educated
enough to sign their names, something that cannot be assumed for
the majority of people in the rural South at that time.
According to Caswell court minutes dated Jan. 1787, John Graves,
Sr., conveyed 102 acres to John Kerr.
The 1784 tax listing for Caswell Co. lists John Graves as living
in the St. David's district of the county, owning 1690 acres of
land and having 13 black polls [whatever that meant--I suspect
it meant 13 black male slaves over age 21.] The land is listed
as being located on Country Line Creek."
