Dr. Hall says that among the early settlers at Sandy Bluff, on
the Pedee, were the Murfees, Saunders, Gibsons and Crawfords.
They intermarried with each other and owned valuable lands in
this locality. They also married later into other prominent
families and among them the Pegues and Ellerbe families.
Mrs. Lidwin says only Moses was theirs.
The Will of Malachi Murfee dated 7 Sept 1773 recorded Charleston
Will Book 1776-1794, p 291, mentions all the children except
(Hannah). His wife Hannah was deceased. He gives property to all
the children calling them Saunders: "Malachi Saunders, son of my
deceased wife Hannah;" Nathaniel Saunders ditto; James Saunders
ditto; Massey Saunders--also as Marcy and Mercy-ditto and to the
daughter Mercy of the deceased Elizabeth & her husband William
Pegues and to the children of the Rev. N. Bedgegood wife
Mary--all called children of my deceased wife Hannah. He also
gives to Moses Murfee son of my deceased wife Hannah.
Marcia (Marcy, Mercy, Massey) was not married to Claudius
Pegues, Jr. at that time. Evidently all the children were called
Murfee and that is why he named them as Saunders. There are the
Pre Rev. deeds calling them Saunders and James died as a
Saunders as his estate owed some firm (Claudius Pegues , admr)
The Court Records of Marlboro Co explain this deed. Malachi
Murfee (Saunders) owed someone or other and Claudius Pegues, Jr.
went on his bond. When this deed was made Claudius was dead &
Marcy & her children bought the slaves in question & gave them
to Mary Murfee (otherwise Saunders) and her children. Note
Malachi is mentioned as "our kinsman" in the deed.
WILL OF MALACHI MURFEE
In the Name of God Amen Known all men by these Presents that
this being the fifth day of September in the Year of our Lord
one thousand Seven hundred & Seventy three and in the thirteenth
year of his Majesty's reign That I Malachi Murfee of Prince
Fredericks Parish in Craven County in South Carolina planter
Being at present Some what indisposed in Body But of sound
Memory and mind and Good understanding thanks be the Almighty
for the same and Knowing that nothing is more Certain than death
and nothing So uncertain as the Hour thereof I therefore ordain
Constitute and appoint this my last Will & Testament in the Way
Manner and form following that is to say first of all I Commit
My Soul to him that gave it in hopes through the Merits of my
redeemour I shall find Mercy and be admitted into Eternal
Happiness-My Body I Commit to the Earth from Whence it came To
be Decently Interred at the discretion of my Executors hereafter
named in hopes of Joyful and General Resurrection at the Last
day and as to the disposition of those Goods that it has pleased
the Almighty to bless me with in the Transitory Life I shall and
will dispose of them in the way Manner & form following, first
of all I will that all my Lawful Debts be discharged and Paid.
Secondly I Give and Bequeath unto Moses Murfee Son of Hannah my
Deceased Wife the following Negroe Slaves Viz Parian, Ben, Dick,
Sandal, Lucy, Doll, and a Large Mahogany Table and Chestor
draws. The said Moses Murfee to have and to hold the above said
Slaves Parian, Ben, Dick, Sandal, Lucy Doll and their Increase
for ever Together with the said Mahogany Table and Chester draws
to him and the Heirs of his Body or Before he comes of age of
when of Age Should Die Intestate then in such case I do devise
and bequeath the whole said Legacy unto Malachi Sanders Son of
My said deceased Wife
Item I give and bequeath the Remainder of My Household (Except a
feather Bed and furniture and another without its dressing Table
and drawers) and Kitchen furniture unto Moses Murfee and Malachi
Saunders Son of my said Deceased Wife to be divided between them
by equal part and portion and Do Give it and Bequeath it the
same to them and each of them their Respective shares part &
portion to them and each of their Heirs of their Body for ever
and in Case the said Moses Murfee Should dye as aforesaid Before
he comes of age and having no Issue and when of age should dye
Intestate in Such case I do devise the whole Legacy unto Malachi
Sanders Son of my Said deceased Wife But Contrary wise if the
said Malachi Sanders Son of my Said deceased Wife Should dye
Leaving no Issue or any Heirs of his Body or before he comes of
age or of age Should dye Intestate in Such Case I then do devise
and bequeath the said Legacy or his Share unto Moses Murfee Son
as aforesaid and if both Moses Murfee and Malachi Sanders should
dye before they come of age or leaving no Issue & when of ago
Should dye Intestate then i do devise and bequeath the whole
above said Several Legacies or Legacy unto Nathaniel Sanders and
James Sanders Son of my said Wife and to the Heir or Heirs of
their Body for ever.
Thirdly I Give and bequeath unto Mary Sanders daughter of my
Said Wife the following Slaves Viz Motts Sandy Beck & Sam
Together with Ten Cows and Calves a feather Bed and furniture
and another without it a Dressing table and Drawer the same as
was above Excepted and a Horse Bridle and Saddle
Item I Give and Bequeath unto the said Massey Sanders daughter
of my said Wife the Sum of two thousand five Hundred & Eight
four Pounds Current Money of the province aforesaid to be Paid
to her by my Executors hereafter named Twelve months after my
decease The Said Mercey Sanders and the Heirs of her Body To
have and to hold the above named Slaves Molls Sandy Beck and Sam
to together with said Cows and Calves and their Increase feather
Bed and furniture and another without it Horse Bridle and Saddle
dressing table and drawers and the said Sum of Two thousand five
hundred and Eighty four Pounds To her own proper use and behoof
Nevertheless if the said Mercy Sanders should dye Before she
comes of age or be Marryed or when of age she should dye
Intestate then in such case my Will Intent and meaning is that
the said Cattle and their Increase the said two bed and
furniture Horse Saddle and bed a dressing Table and drawers
together with the said Sum of Two thousand five hundred and
Eighty four pounds shall be given and appropriated to Mercy
Pegues Daughter of William Pegues and of Elizabeth his Wife
deceased and to all and every the Sons and Daughters of the
Reverend Nicholas Bedgood and Mary his Wife That shall Be then
alive and in Being to Be divided among them by Equal Share part
and portion they and each of them and the Heirs of their Body To
have and to hold to their own proper use and Behoof forever
Fourthly, I Give and bequeath unto Moses Murfee Son of my
Deceased Wife the Sundry Plantation or Tract of Land hereafter
mentioned Viz all that Plantation or Tract Containing nine
hundred Acres of land Lying and being on the SoWest side of
Pedee River Butting and Bounding on the upper Side By black
Creek and the Lower Side by Kuchers/Pechers Creek also i give
and bequeath unto the said Moses Murfee another Plantation or
Tract Containing two hundred Acres of Land situate lying and
being on the North East Side of the said River Westerly by
Doreedy's Land Easterly on Bentons Land which said Land I did
Purchase of Paul Trapier Esqr. To Together I Give and bequeath
unto the Said Moses Murfee another Plantation or Tract
Containing four Hundred Acres of Land Lying and being on the
north east side of the said River Butting and Bounding Westerly
on Col. Pawley's Land Easterly on James Sanders Land.
Item I give and bequeath unto the said Moses Murfee Son of my
said deceased Wife all that Stock of Cattle Mark'd with a
Swallow fork in one Year[sic], and a Slitt in the other Branded
thus M.
Item I give and bequeath unto the sd Moses Murfee Son of my said
deceased Wife Ten Silver spoons ditto Ten Silver Small ones to
have and to Hold the said Several Plantation or Tract containing
in the whole fifteen hundred Acres of Land with all their
appurtenances thereunto belonging or in any wise appertaining
together with the said Stock of Cattle & their increase, the
said Ten Silver Soup Spoons, Ten ditto Small ones, unto the said
Moses Murfee, and to the Heirs of his body to his, or their own
proper use & behoof forever, provided nevertheless & it is my
Intent & meaning, that if the said Moses Murfee should die,
Leaving no Issue or before he comes of age and when of Age
Should die Intestate then the Sundry Plantation or Tract
Containing in the Whole fifteen hundred Acres of Land together
with the Said Stock of Cattle Ten Silver Soup Spoons Ten Silver
Small ditto, and the Increase of the said Cattle I do devise and
bequeath unto Malachi Saunders son of my Said deceased Wife and
the Heirs of his Body lawfully begotten And if the Said Mal
Sanders should die without any Issue or before he comes of age
and when of age should die Intestate, then In such case i give
and bequeath the aforementioned Plantation or Tract containing
in the whole fifteen hundred Acres of Land together with the
Said Stock of Cattle & their Increase Ten Soup Silver Spoons Ten
Small ditto unto Nathaniel Saunders and James Saunders Sons of
my said deceased Wife & the Heirs of their Body forever.
Fifthly I give and bequeath unto Malachi Sanders Son of my Said
deceased Wife the Sundry Plantation Tract or Tracts of Land Viz
a Plantation or Tract containing three hundred Acres of Land
Lying and being the the S Wt Side of Pedee River at or near the
Head of back Swamp Joining a Plantation or Tract of Land
belonging or appertaining unto the Said Malachi Sanders,
Together I do give and bequeath unto the said Mala Sanders
another Plantation or Tract containing two Hundred Acres of Land
Contiguous or adjoining the said Tract of three Hundred Acres
Item I Give and bequeath unto the said Malachi Sanders all that
Plantation or Tract Containing five Hundred & fifty two Acres of
Land Lying and Being on the SoWt side of the said River bounding
on the---Side of Kuchers Creek & on the Side by Jourdan Gibson
Junr [Hannah's nephew] which tract I did purchase of Jordan
Gibson Senr.
Item I give and bequeath unto the said Malachi Sanders a
Plantation or tract Containing four hundred Acres of Land
Situate Lying & being on the N.E. side of the said River
bounding Westerly on Beadons Land Easterly on James Lingard's
Land called the Little Bluff
Item I give and bequeath unto the said Mal Sanders Son of my
said deceased Wife all that tract or parcel of Land belonging to
the Tract that I now Live on and that is this Side of Kelchers
Creek bounding on the Black land quantity unknown only that the
said Kitchers Creek shall be the Bounds
Item I give & bequeath unto Malachi Sanders Son of my said
deceased Wife all that Stock of Cattle Mark'd with a Smooth Crop
& an under half penny in Ear Ear branded thus E. I give and
bequeath unto the said Malachi Sanders Ten Silver Small Spoons,
to have & to hold the several Plantation or tracts containing in
the whole fourteen hundred & fifty Acres of Land, and that part
& parcel of Land on the other side of Kitchers Creek quantity
unknown together with the said Stock of Cattle & their Increase
And the Ten Silver small spoons unto the said Malachi Sanders,
and the heirs of his body to his or their own proper use and
behoof for ever provided nevertheless that if the said Malachi
Sanders Son of my said deceased Wife should die Leaving no Issue
or before he comes of Age, or when of age Should died Intestate
then in Such Case I do devise give and bequeath the said
Plantation, tract or tracts of Land together with the said Stock
of Cattle and their increase Silver spoons unto Moses Murfee son
of my said deceased Wife and if the said Moses Murfee should die
Leaving no Issue or before He Comes of Age or when of age should
Die Intestate then I give the whole of the said Legacy unto
Nathaniel Sanders and James Sanders Sons of my said deceased
Wife and the Heirs of their Body Lawfully begotten.
Sixthly I give and bequeath the remainder or the residue of my
personal Estate that shall remain intestates not disposed of by
me in this my Last Will and that shall be found at the day of my
decease unto Moses Murfee & Malachi Sanders both my deceased
Wife's Sons, the whole to be divided by my Exors Here after
named by Equal part and portion between both the said Malachi
Sanders & Moses Murfee to have and to hold Each of them their
respective Share Part & portion to them, the Heirs of their body
for ever. but if in Case Either of them should die Leaving no
Issue or before he comes of Age of when of age, should die
intestate then In such case I will that the whole of this said
Legacy shall go by portion and belong to the Survivor of him and
if in case they should both die under age Leaving No Issue or
when of age they should die Intestate, then in such case I
devise give & bequeath the Whole remainder and residue of my
said Estate on the Conditions hereafter mentioned unto Nathaniel
Sanders and James Sanders both Sons of my Deceased Wife and the
Heirs of their Body for ever. And in such case the said
Nathaniel Sanders & James Sanders shall pay one thousand pounds
Currency to Mary Sanders, and a thousand Pounds more, and a
thousand pounds more [?] between them unto Mary the Wife of the
Rev. Nicholas Bedgood daughter aforesaid, And the Heirs of their
Body. And is the said Moses should die Intestate and Leaving
Issue of his Body and Such Issue should he is of age or
Intestate [?] then my Will is that whatever goods and Chattells
Lands & Tenements, and everything appertaining or in Any Wise
belonging to him she or they shall go to Malachi Sanders, Son of
my said deceased Wife, and to the Heirs of her body forever
Contrary wise if the said Malachi Sanders should die intestate
and Leaving Issue or Issues of his body, or if any such die
intestate then i will that everything that shall be belong to
such Heir or Heirs shall go to Nathaniel Sanders and James
Sanders or to the Heirs of their Body forever and that in that
Case the said Nathaniel Sanders & James Sanders shall pay the
said sum Yearly Viz one thousand pounds to Mary Sanders & one
thousand pounds more to Mary the Wife of the Rev. Nicholas
Bedggood and further If the said Mary Sanders should have any
Heirs of her body and her Husband should die Intestate and
Likewise herself should die without will and such Heirs should
die before they come of age and when of age should die intestate
then I Will that whatever shall be found to be the property of
such Heir or Heirs shall go in the same way and manner as I have
already mentioned in the third clause of this my Will where it
is said if the said Mary Sanders should without Issue, or before
she is married or die intestate,
I Malachi Murfee the Testator Hereof do declare this to be my
Last Will and Testament, revoking annulling and making Void by
these presents, all other former Wills Testaments Codicils or
any other deeds, that I might heretofore have made, and done in
case of death, and Will that this my Last Will and Testament and
Every Article therein contained may have its full force & Virtue
desiring my Exors hereafter named that they see the whole
Executed according to the true intent tenor & Meaning of every
clause and article therein contained & for the Execution of this
my Last Will and Testament I do and Have Nominated appointed
ordained and Constituted My beloved Friends Nathaniel Sanders
and James Sanders Sons of my deceased Wife to whom I Leave the
car of the whole in Witness whereof I have hereunto Sett my Hand
& Seal the day & Year first written.

Benjamin specified in his will that "My desire is what part of
my estate falls to my daughter Hannah field's heirs be kept in
the hands of my Executors till the children come of age or
Marries or laid to the best advantage as they may think
proper..." As a result, the estate of Benjamin Roberts, which
included large tracts in various areas of Kentucky, was not
divided until June 10, 1799.
