"The date of John GARNETT's birth is confusing. Allyne Pearce
says that John GARNETT was born in 1713 and died in 1772, while
other sources put his birth at 1702 or 1715. [It appears that
perhaps Alyne Pearce got the year 1713 as John Garnett's birth
date from the document prepared by George Harrison Sanford King
who quotes the same birth date. The birth date of 1713 is given
in Charles W. H. Warner's "Hoskins of Virginia and Related
Families", 1971]."
---In 1758, John GARNETT was appointed as administrator in the
estate of his brother Thomas GARNETT, with Mark Andrews and
Richard Noel as securities.
Thomas Garnett, deceased, seems to have died intestate . [Will
Book #11, page 115 records a bond dated June 20, 1758 in which
John Garnett is appointed administrator]. The same will book
[page 315] provides an inventory of the estate of Thomas Garnett
valued at L396-8s-5d. This was not a triffling estate for that
era, and the residual property included eight negro slaves.
Court Order Book #22, pages 199-100 dated June 20, 1758 says :
"Richard Noell is appointed guardian to Thomas and Elizabeth
GARNETT, orphans of Thomas GARNETT, deceased, and thereupon the
said Richard together with John GARNETT Jr., his security
entered into bond for the same which is admitted to record.
"On the motion of John Garnett, administration of the estate of
Thomas Garnett, deceased, is granted him and thereupon the said
John together with Mark Andrew and Richard Noel his securities
entered into bond for the said John his due administration of
the said estate and acknowledged the said Bond to be their act
and deed which is admitted to record."
The fact that the Court appointed guardians for the two orphaned
children of Thomas GARNETT indicates that they were under the
age of 14 at the time of their father's death.
It seems that John Garnett, the administrator of his brother's
estate, failed to undertake his responsibilities during the
following three years. In 1764, Mark Andrews and Richard Noel
entered the motion that John GARNETT be summoned to appear at
the next Court to show cause, if any, he can why he out not to
give counter security for his administration on the Estate of
Thomas Garnett, deceased." [COB #25, page 125, Court sitting of
March 20, 1764].
On May 21, 1764, John Garnett having been summoned to Court
failed to appear. Thomas Garnett's orphaned son was by then
approaching legal age and a full accounting of the estate was
overdue. It was becoming uncertain if John Garnett would make
good on his responsibilities as the administrator.
Little by little, John Garnett started selling off his land. On
February 27, 1762, joined by Mary his wife, John Garnett sold
land to Francis Graves [DB #29, page 83]. On Febuary 6, 1763, he
made a further sale [DB #29, pages 173, 207] and on January 4,
1764 John Garnett and Mary his wife deeded 92 acres of land to
their son Leonard Garnett [DB #29, page 254].
As the Spring of 1764 approached, Mark Andrews appeared in Essex
with his ears open to hear the news of the neighborhood. He soon
fell in with Richard Noel who informed him of his uneasiness
concerning their securityship for John Garnett on his
administration bond of his brother Thomas Garnett,
deceased---now dead six years.
In May 1764, the court ordered that John Garnett be dispossess
of the estate of Thomas Garnett. He now had to do something.
What he did was to turn over to Richard Noel of St. Ann's
Parish, Essex County, and to Mark Andrews of Cumberland County,
two negro slaves. [Deed Book #29, page 351 dated July 13, 1764].
This seems to have satisfied Andrews and Noel and the suit that
they had brought to court quietly disappeared from the docket.
John GARNETT and his wife, nee Mary FOGG, were apparently
anxious to vest all their estate in their son Reuben GARNETT
[1749-1820].
