In the name of God, Amen, I Nicholas N. Perkins, being sick and weak of body, but sound in mind, perfect sense and understanding, thanks be unto Almighty God for the same. Therefore have thought it fit and proper to make, ordain and constitute this last will and Testament in manner and form as follows:


First, I give and bequeath my Soul unto the merciful hands of Almighty God, who gave it, and my body to the earth, to be decently buried according to directions of my Executor, hereinafter named, and as for worldly goods, as it hath pleased Almighty God to bestow upon me, I have thought fit to bestow as follows:


I give and bequeath unto my son, Phil Perkins, all of my land between Spring branch and Abram Childers, to him and his heirs forever and my will is that he is to pay unto my granddaughter, Eliza Perkins, daughter of my son, Nicholas Perkins, deceased, fifteen pounds of current money, being in consideration of part of land designated for her father, whereon he once dwelt before his death.


I give and bequeath to my son, Richard Perkins, the plantation whereon I now live, to him and his heirs forever, also one feather bed and furniture, two breeding sows, one iron pot, one gun, one chest and two pewter dippers.


I give to my son, Abram Perkins that plantation I bought of John Pledgo, by estimation one hundred acres; also that piece of land I have lying between first plantation I bought of said Pledgo and Spring branch, by estimation fifty acres; one feather bed and furniture, two breeding sows, one iron pot, one chest and two pewter dippers.


I give unto my daughter, Sarah Perkins, one feather bed and furniture; also two pewter dippers.


I give unto my daughter, Elizabeth Perkins, one feather bed and furniture and two pewter dippers.


I give unto my daughter, Mary Seal, wife of Amos Seal, two ewes, one brass kettle and two pewter dippers.


I give and will my son, Constantine, five pounds current money of Virginia.


My will and pleasure is that all of my cattle be equally divided between my wife and my sons, Richard and Abram, and my daughter, Elizabeth.


My will is that each of my children shall have their share when they arrive at legal age, or on day of marriage.


All of the remainder of my estate I will to my beloved wife, whom I make, ordain, constitute and appoint my whole and sole Executor, of this my last will and testament, hereby revoking all others.


In witness whereof I have given my hand and affixed my Seal, this June 13th day, 1711.

Father: William Waller, spouse unknown.


Her ancestors are not definitively known but it is surmised that she descends from Sir William Waller (born in 1527), a celebrated Parliamentary General two of whose descendants, Edmund and John Waller, came to the Colonies. (Biography of William Waller, 1890). She is supposed to have been the daughter of John Waller III of Westmoreland County, son of John Waller II and wife, Dorothy King, who was the son of John Waller I, the immigrant. (Virginia Genealogies, 1891, William & Mary Quarterly, Volume 5 Number 3, pp176-8).


Thomas H. Pope, a descendant of William B. Calmes of Newberry, South Carolina, and a person who has done much research, writes that Winnifred Waller was the daughter of William Waller, Jr., and that land owned by William Waller, Sr., was adjacent to land granted to Marquis Calmes by Lord Fairfax. Mr. Pope also writes, "Proceedings resulting in the grant of 400 acres to William Waller were commenced after the deaths father, William Waller, Sr., and of one Gerrard Master, an alien, to whome had been granted 800 acres on July 2, 1699. (Patent Book 5, page 237, Cavliers and Pioneers, Nell Marion Nugent, Volume 2, 1666-1695, page 60).


William Waller, Sr., died before the land could be divided. When Masters died, title to the entire tract was in him. As an alien, his land would ascheat to the Colongy. William Waller, Jr., and Richard Fassaker therefore petitioned and were granted 400 acres each." (Northern Neck Land Grants, 1694-1742, page 6, page 237, Grant Book 2, page 67).


[Calmes Notes, Vol. IV, Issue I, January 1995]
The Old Chapel [picture] in Millwood, Clark County, VA, where the gravestone of Winnifred Waller Calmes is located. The stone was moved from "The Vineyard" Plantation in 1859. The inscription of the graveston no longer is readable. From early records, however, we know it reads:


Here lies the body of Winnifred, the wife of Major Marquis Calmes.
They were joined in wedlock 26 years and had six children.
She was a loving, virtuous and industrious wife, a tender mother, and kind mistress.
She departed this life October 6, 1751 Anno Domini.


Some resources suggest that Winnifred Waller's father was was William Waller, son of William Waller, son of John Waller I. However, no confirmation of this assumption is available.


The Old Chapel Cemetery (Burwell Cemetery) is located on Va. Rt. 340 & Rt. 255. This is a couple of miles north of the intersection of Rt. 340 & Rt. 50 in Clarke County. A ledger still exists (although in bad shape) for Winifred Waller Calmes; it reads 1709-1751 wife of Maj. Marquis Calmes II & mother of 6 children, relocated from Vineyard Hill and Clarke County, Va. - Marquis died in 1755, Shenandoah River floods made his ledger unrecoverable.


Marquis Calmes & his wife were buried beside the Shenandoah River near Tilthammer Mill which bordered the Vineyard plantation. In 1859 Winnifred's tombstone was removed from what is long been said to have been a burying ground on the plantation and placed in the Old Chapel cemetery for preservation by Dr. Robert C. Randolph. He states that they dug down 5 feet but found no remains. The gravestone of Marquis Calmes was shattered beyond repair, but did state that he died in 1755, aged 50. Winnifred's tombstone stated they were married 26 years and she had 6 children. She died 10/6/1751, aged 42.
