This indenture made and entered
into this 2nd day of August Eighteen hundred and Sixty Eight between G.
W. Garman and
Mary Ann his wife both of
Metcalfe County Kentucky of the first part and James B. Garman of the County
and State
aforesaid of the second
part. Witnesseth that whereas the said G W & James B Garman by joint
purchase of John M Garman
have become the owners of
a certain tract of land lying upon the waters of the East Fork of Little
Barren River in County and
State aforesaid and more
particularly described in a deed from the said John M. Garman & wife
to the said G W & James B
Garman as being in four
tracts containing severally 156 acres, 150 acres, 100 acres and 33 acres
and whereas in
consideration of the said
J B Garman having paid his agreed part of the purchase price (to wit) seven
hundred and fifty dollars
to the said John M Garman
and for the further consideration the the said parties having agreed to
divide the aforesaid tract of
land and the said J B Garman
having this day by deed of conveyance si(g?)ned as to this made a transfer
of title and
ownership as therein expressed
Now in consideration of the foregoing premises Witnesseth that the said
G W Garman & wife
have this day granted bargained
and sold and by these presents do grant bargain sell and convey unto the
said J B Garman his
heirs and assigns forever
their entire interest in that portion of the aforesaid tract or tracts
of land particularly described as
follows. Viz Beginning at
a Hickory and Elm in the Westardly line of the aforesaid 156 acre survey
and is near to the said G
W Garman Thence with the
division line of same N 63 1/2 East 110 poles to a Stone Thence North 30
1/2 West 26 poles to
Black walnut Hickory &
Elm on bluff of branch Thence up branch North 113 East 24 1/2 poles to
an Elm Thence North 60
East 185 poles to a large
and small Chestnut Oak in a line of aforesaid 150 acres survery Thence
with the line of same North
41 E 76 poles to three Poplars
(two dead) corner to same. Thence with a line of E. L. Wisdom South 59
West 14 poles to a
chestnut oak and hickory
corner to same. Thence another line of same W 110 poles to a sugar tree
on a hill-side call sugar
tree beech and elm thence
South 73 West 62 poles to a white oak and Elm Thence South 10 East with
James Lasleys old line
46 poles to two white oaks
his corner thence with another line of his South 80 West 80 poles to a
Whit Oak and corner of
one hundred acre survey
White oak and Black ash on west bank of creek in line of 156 acre survey
at 98 poles and with line
of same to the beginning
containing 209 1/2 acres be the same

to hold the same with all the appertainances thereunto belonging unto the
said grantee his heirs and
assigns forever the grantors
coveting that they will forever warrant and defend the title of the property
hereby conveyed to be
free from their own and
all other claims whatever in testimony whereof the said grantors have hereunto
set their hands, and
