Jonathan Wood's Will

I Johnathan Wood of the county of Cumberland and the state of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existance do make and declare this my last will and testament in maner and form that is to say:

First that my executor hereinafter named shall provide for my body a decent burial suitable to the wishes of my relations and friends and pay all funeral expenses together with my just debts havesoever and whomsoever owing out of the moneys that may first come into his hands or a part or pacel of my estate.

Item.  I give or devise to my beloved son Whitfield Wood one hundred acres of land lying in county of Johnson state of North Carolina on the south side of Mill Creek adjoining Allen Johnson and others one bed and furniture one cow and calf.

I give and devise to my son William Wood one hundred and six acres of land in the county of Cumberland and the state aforesaid and laying Henry Pope and others one feather bed and furniture and one cow and calf.

I give and devise to my son Larry Wood one hundred and ten acres of land lying in the county of Cumberland and Harnett and the state aforesaid on the east side of Black River and laying Thomas Robertson and others one bed and furniture and one cow and calf.

I give and devise to my son Garry Wood one hundred and ten acres land lying in the county of Cumberland and the state aforesaid and laying Fargar Smith and others one bed and furniture and one cow and calf.

I give and devise to my daughter Elizabeth wife of Hinton Barnes forty acres of land lying in the county of Cumberland and aforesaid adjoining Henry Pope and others one bed and furniture and one cow and calf.

I give and devise to my daughter Mary wife of Gorden Smith one bed and furniture and one cow and calf and forty acres land in county of Cumberland and state aforesaid adjoining Henry Pope and others.

I give and devise to my daughter Rebecca E. Wood forty acres of land in the county of Cumberland and the state aforesaid adjoining Mary Smith and one bed and furniture and one cow and calf.

I give devise to my daughter Aley Wood forty acres of land in the county of Cumberland and the state aforesaid joining Rebecca E. Wood one bed and furniture and one cow and calf.

I give and devise to my daughter Nancy Wood forty acres of land in the county of Cumberland and the state aforesaid joining Aley Wood and one bed and furniture and one cow and calf.

I give and devise to my daughter Pharaby Wood forty acres land in the county of Cumberland and the state aforesaid joining Nancy Wood and one bed and furniture and one cow and calf also the growing crop for the use of the family.

I give and devise to my daughter Penelopy A. wife of A. Gainey forty acres of land more or less commencing in Smiths line at Black River Bridge in the road running the road to Larry Woods line one bed and furniture and one cow and calf.

Item.  My will and desire is that all the residue of my estate if any after taking devides and legacies above mentioned shall be sold and the debt owing to me collected and if then shared be any surplus over and above the payment debits, expenses and legacies that such surplus shall be equally devided amongst my children in equal proportions share and share a like to them and each and every of them XXXX their executory administrators and XXXXX absolutely for ever.

And lastly I do hereby constitute and appoint by trusty friends, Whitfield Wood, and A. Gainey my lawfully executors to all intents and purposes to execute this will and testament according to the true intent and meaning of the same and every part and clause thereof hereby revoking or declaring utterly void all other wills and testaments by me heretofore made in witness whereof I the said Johathan Wood do hereunto set my hand and seal this June the 22nd 1859.
