Nathan Tarte's Will

State of N. Carolina Bertie County Know all men by these presents that I Nathan Tarte in the state and county aforesaide being now sick and weak in body but of perfect sound mind and memory and knowing that is appointed for all men once to die do make and ordain this my last will and testament and such worldly estate as it hath pleased God to bless me with I give and bequeath in the following manner and form.

I give and bequeath to all my children one dollar apeice to them and their heirs for ever named Thomas Tarte Pheby Spivey Nathan Tarte James Tarte and Martha Overton to be raised oute of my estate when they call for it.

Item  I give and bequeath to my wife Mary Tarte and hir daughter Livina Early all the rest of my estate after paying all my just debts and if my wife Mary Tarte should die before the saide Livina Early then all hir parte I give to the saide Livina Early to she and hir heirs for ever revoking all other wills heretofore maide by me.  Lastly I constitute and appoint my friend Richard Williford my executor to this my last will and testament in witness where of I the saide Nathan Tarte hath here unto set my hand and seal this nineteenth day day of September 1822.

This last will and testament of Nathan Tart dead was proved in open Court by the oath of Mary Mitchell one of the subscribing witnesses thereto -- ordered that the same be recorded.
