Codicil to the Will of Thomas Cozen |
A Codicil to be annexed to and taken as part of the last Will and Testament of me Thomas Cozen of Shouldham in the County of Norfolk Farmer made this Eleventh Day of September One thousand eight hundred and eleven Whereas I have in and by my said Will given and bequeathed unto my Son John Cozen The Lease of the Farm in my Occupation which I hire of Thomas Hare Esquire and all the Stock Crops growing and other Effects thereon as in my said Will is mentioned. Now I do hereby declare that the Bequest made to him is upon Condition That he my said Son shall not marry Mary Terrington of Shouldham aforesaid Singlewoman nor permit or suffer her to cohabit and live with him in my said Farm House not to officiate as his Housekeeper therein And I do hereby order and direct That up0n my decease my said Son John shall enter into a Bond to my Son George Cozen his Executors and Administrators in the penal sum of four thousand pounds for securing the payment of Two thousand pounds to my said Son George his Executors and Administrators in case he my said Son John shall at any time after my Decease Marry the said Mary Terrington or permit her to cohabit and live with him in my said Farm House or to officiate as his Housekeeper therein And in case my said Son John shall after my Decease marry the said Mary Terrington or shall refuse to make and execute a Bond to my said Son George his Executors and Administrators as hereinbefore directed Then I do give and bequeath unto my said Son George All That I have given and bequeathed in and by my said Will to my said Son John. And whereas I have in and by my said last Will and Testament devised unto my said Sons John and George All and every my Messuages Lands tenements and Hereditaments being Freehold or Leasehold except the aforesaid Lease upon Trust to sell the same And I have also directed my said Sons to sell and dispose of All my Copyhold Messuages Lands Tenements and Hereditaments for the best price and most money that can be had or gotten for the same Now I do hereby will order and direct my said Sons to offer to my Son in Law John Aylmer the Sale to him of all my Messuages Lands Tenements and Hereditaments in the Occupation of the said |
John Aylmer at such price or Sum of Money as the same shall be valued at by two indifferent persons one to be nominated by my said Sons John and George and the other by the said John Aylmer Or in case such two persons cannot agree in the value thereof Then the same to be valued by a third person to be nominated by such two Persons Approbation of my said Sons and Son in Law And is case my said Son in Law John Aylmer shall agree to purchase the same upon such valuation as aforesaid Then I do will and direct That the price or Sum at which the same shall be valued shall be paid by the said John Aylmer unto my said Sons John and George within two years after my decease together with lawful Interest for the same from the time of my decease Upon the Trusts and for the intents and purposes mentioned and expressed in and by my said Will as to the Monies arising by sale of all my real Estates as therein mentioned And Lastly I do hereby ratify and confirm my said last Will and Testament in all respects, save and except as to such Gifts Devises Codicil thereto, reworked altered or directed to be otherwise performed.
