Before a Genl Court Marshal [sic] of which Capt. John B Morris 2nd Regt. D. C. Vols is President Convened at Alexandria Va on Monday December 19th [?] 1864. By Virtue of Paragraph IV of Genl. Order No 119. dated Hd Qrs, Military Governor Alexandria Va December 19th 1864, were arraigned & tried

Charge - Desertion
[He was originally charged with absence without leave.]
Specification In this: that the Said John Garrity Compy "E" 91st Pa. Vols., having been duly Enlisted in the Military Service of the U.S. did without proper authority absent himself from his hospital and so remained until apprehended at or near Philadelphia or or about the 29th of October 1864. This at or near Philadelphia Pa on or about the 14th day of July 1864.
To which Charge & Specification the prisoner John Garrity Co "E" 91st Regt Pa Vols pleaded
To the Specification Guilty
Of the Charge. Not Guilty
Findings. The court having maturely Considered the Evidence finds the Prisoner John Garrity Co "E" 91st Pa Vols as follows
of the Specification Guilty

Sentence.
The Court does therefore Sentence him John Garrity Co E 91st Pa Vols to be assigned to duty with such regiment as the Gen Commanding may direct with loss of all pay & allowances now due him, to forfeit ten (10) Dollars per month of his monthly pay for the period of his term of Service And make good all time lost by absence.
The proceedings findings & Sentence in the Case of
John Garrity Co "E" 91st Pa. Vols
are approved they will be delivered to the Provost Marshal [sic] Gen. A of P. for assignment to duty with such regiment as he may designate and this Sentence will be Executed
