Joseph; in 1696 he was servant to Capt. John Pickering, and signed as witn. for him in 1699. In 1710 fisherman. He app. d. soon aft. ack. the covt. at his home 5 Dec. 1718; had he liv. longer he would have had a Barrington right. App. his wid. Rebecca m. 21 Jan. 1723 Thomas Muzeet of Kit. The only kn. ch. are those named in the So. Ch. records: Benjamin, b. 1693, recd. into covt. 1 Mar. 1718-9, cordwainer. He m. Elizabeth Ham of Dover and settled there. She joined the church 16 Oct. 1763. He d. 3 Aug. 1781, ag. 88, she 17 Aug. 1788, ag. 84. 4 ch. Joseph. He and Joshua were bap. 18 Sept. 1720, the same day their mo. was recd. into covt., their fa. not named. He m. 29 Dec. 1726 Elizabeth Meserve (Daniel). Sailor and fisherman, except two or three yrs. 1731-1733 attempting a farm in Rochester. Both last ment. Nov. 1739. Two ch. bp. Joshua, bp. 18 Sept. 1720, shipmaster. W. Elizabeth. adm. to creditors 1 Aug. 1736, his wid. decl. to act. app. it was she that joined the So. Ch. in 1742. They had 3 ch. bap. 1729-34. Sarah, 'dau. of Joseph & Rebecca,' recd. into covt. and bap. 3 Oct. 1725. The three foll. are listed here because poss. their ch., and other parentage less likely: Mehitable, m. in Portsm. 5 Jan. 1732-3 Jeffrey Wells. Hannah, int. in Kit. 22 Oct. 173_ 'both of Kittery,' m. in Portsm. 30 Jan. 1734-5, 'both of Portsm.,' Benjamin Welch. Nathaniel, m. in East Kingston 7 Aug. 1740 Deborah Ladd. In 1742 was a 'potter' of Portsm., in 1743 bot in Exeter. Adm. Jan, 1752 to Josiah Thing; inv. shows a stock of pottery and general mdsc. He wrote an elegant hand. If this Nathaniel was childless, he could have been s. of James and his bro. John could have been fa. of Nathaniel, ancestor of the So. Car. Libbys, who night have learned the mastmaker's trade from his uncle John Marden. In 1761 Nathaniel of Portsm., mariner, was sued. [ref 22]

JOSEPH LIBBY, born in Scarborough, probably as early as 1670; m. REBECCA ___. He lived in Portsmouth thirty-five years or more, but whether he died there, or moved away, does not appear. Children*, doubtless all born in Portsmouth: Benjamin, Joseph, Joshua, Sarah, Nathaniel. [ref 25:35]

The Deposition of Joshua Peirce aged about twenty six years, who testifieing saith That yesterday being ye twenty fifth day of this Instant Novemr I being in company with Coll Packer going up to his farme wee met with Tho: Perkins and two of Capt Pickrens servants namely Tho: Pumery and Joseph Leby a driveing away a certain parcel of neat cattle of from ye land of ye sd Coll Packer; ye cattle being reputed his owne namely Coll Packers; he required them to forbear driving away his cattle; and he turned ye cattle back through ye woods homeward afterward ye same day I being helping of mr Packer to drive ye same parcel of cattle down to his own house att ye banke was met by Capt Pickren him selfe and Tho: Perkins att ye further end of Sherbuns Lane who forcibly took from us ye cattle, ye sd Pickren did also say yt he would detain ye cattle and did also abuse ye sd Coll Packer in words and threatnd to strike him of his horse and to breake his bones farther sayth not: I farther testifie yt ye cattle above mentioned I saw ym in ye pound and knew them to be cattle belonging to ye sd Coll Packers farme this 26 Novemr 1696 Sworne in open Court Decembr 2d 1696
