Willis says he was "the first lawyer who ever resided in the State of Maine," but several were admitted to the bar before him. He was "King's Attorney" for the Province of Maine and also captain in the militia. He died 9 Dec. 1761. NOAH4 EMERY, son of Daniel and Margaret (Gowen) Emery; b. Dec. 11, 1699; married, first, Jan. 22, 1722, Elizabeth Chick, daughter of Richard Chick (died Jan. 15, 1739-40); second, Oct. 30, 1740, Sarah Cooper, daughter of John and Sarah Cooper, resided in the northern part of Eliot, Me. He was bred to the trade of a cooper, but as he grew to maturity turned his attention to the law. In 1725 he was admitted to the bar by taking the required oath. In a certain deed of record he styles himself "a practitioner in the courts." He thus attained the distinction of being, says Willis, "the first lawyer who ever resided in the state of Maine." The subsequent career of Noah proved that he had not mistaken his calling. The writer already cited characterized him as a lawyer "possessed [ref 48:316] of much legal acumen and accuracy; a ready draftsman, of quick perceptions and considerable ability, which gave him an extensive practice. He was repeatedly commissioned as "King's Attorney" for the Province of Maine, Attorney General of the state, as he would now be described. A man of bookish tastes, he had an interest in the Portsmouth Social Library and also had a library of his own. To his sons he bequeathed his "books of law, physic, divinity and history." One of these old law books was a copy of the earliest extant edition of the Laws of the Colony of Massachusetts, the edition of 1660. It now belongs to the Massachusetts State Library where it is carefully kept under lock and key, being "worth its weight in gold," says the librarian, since there are only two or three others in existence. His autograph and the date of its purchase are on the title page. Mr. Emery was also a military man of local consequence, being captain of the "upper foot" company, in Kittery, in which there were nine other Emerys. This office brought him into personal relations with Sir William Pepperrell then in chief command of the military forces of the state. A note from Sir William directing Captain Emery to have a detail of his command at Boston by a certain time discloses this fact. He died Dec. 9, 1761.
