Samuel Fernald married Hannah, dau. of Thomas and Margery Spinney. He was a shipwright. He died 1 Dec. 1698. [ref 33:376]

Samuel2 Fernald (Renald1) was probably born about 1644 as he was old enough to sign the petition addressed by the adherents of the etablished church at Portsmouth to the Royal Commissioners for New England Affairs in London in July, 1665, saying that they were, by the Massachusetts authorities, "denied Common prayer, Sacraments and decent buriall of the dead contrary to the Laws of England." He married about 1674 Hannah Spinney of Kittery, who survived him when he died on December 1, 1698. She was still living in 1702. Like his elder brother Thomas, Samuel was a shipwright by trade. Portsmouth granted him land in 1666, including fifty acres which had originally been granted to his father and thirteen acres formerly granted to his brother-in-law John Partridge. In 1670/1 he subscribed to the support of the Portsmouth minister. Although, as is evidenced by his will and a deed of his son Nathaniel, he inherited one of his father's collection of islands on the New Hampshire side of the river, he possibly never occupied it as almost immediatley after his marriage he settled in Kittery, buying from John Cutt a house and six acres on the river, formerly the property of Andrew Newcomb, in 1674. He added various small parcels to his holdings in 1679, 1681 and 1696 by purchases from his Spinney in-laws and others, and by a town grant of thirty acres in 1699. Samuel served on a York County trial jury in 1696/7, and on grandjuries in 1697 and 1698. The will of Samuel Fernald of Kittery, shipwright, was made on November 24, 1698. To his wife Hannah he left "my now Dwelling house . . . with the Neck of Land belonging to me on which sd house Stands . . . and what Land I have on ye Eastern Side of a Creek commonly called Spinneyes Crick Dureing her Widowhood. Alsoe all My household Goods and Moveable Estate." To his son Nathaniel, when twenty-one years of age, "my Iland that is in Piscataqua River," and the lands given to his mother, upon her death or remarriage. To his daughter Sarah Fernald, twenty-five acres of land on Portsmouth plains, and another twenty-five acres there to his daughter Hannah Fernald. To his daughter Martha Fernald, �10 to be paid to her by her brother Nathaniel Fernald when she is eighteen years of age. Executrix: wife Hannah, "my brother John Spinney to be Assistant to her in any business in wch she desires his help." Witnesses: William ffernald, Elizabeth ffernald, John Newmarch. The will was proved January 3, 1698/9, and an inventory of �281:18:00 returned by Samuel Spinney and William Godsoe on December 22, 1698. The executrix and her son Nathaniel sold the homestead, including seven acres of land, "at the entrance of Pulpit Reach at Kittery Point" to Thomas Spinney on June 25, 1701. In the name of God Amen the twenty fourth day of Novembr in ye year of our Lord God one thousand Six hundred & Ninety & Eight I Samuel ffernald of Kittery in ye County of york in ye Prouince of ye Massachusets Bay in New England shipwright, being very sick & weak in body but of perfect mind & Memory thanks be giuen to God therefore Calling unto mind ye Mortallity of my body doe make and ordaine this my last Will and Testament/ That is to Say principlely and first of all I giue and recomend my Soul into ye hands of God that gave it and for my body I commend it to ye earth to be buried in a Christian like & Decent manner at ye Discretion of my Executrix Nothing Doubting but at ye generall Resurrection I shall receiue ye Same again by the mighty power of God

And as touching Such Worldly Estate wherewith it hath pleased God to Bless me in this life, I giue Devise and dispose of the Same in ye following manner & form.

Imprs I giue and bequeath unto Hannah my Dearly beloued wife my now Dwelling house and out houses with the Neck of Land belonging to me upon which sd house Stands Dureing her Naturall life And what Land I haue on ye Eastern Side of a Creek comonly called Spinneyes Crick Dureing her Widowhood Alsoe all My houshold Goods and Moveable Estate for ever She paying all my Just and Legall Debts.

Item I giue unto my welbeloved Son Nathaniel ffernald when he is twenty one years of Age my Island that is in Piscataqua Riuer in ye Province of New Hampshier he paying to his Sister Martha ffernald when she is Eighteen years of age ten pounds in Money Currt in New England Alsoe I giue to him after my wiues Decease my now dwelling house, out houses, wth the Neck of Land on which my house now Stands And all ye land yt I have on ye Eastern Side of a Crick comonly called Spinneys Crick Lying and being in ye Township of Kittery/ which Land on ye Eastern Side of ye aboue sd Crick he shall haue possession of Soe Soon as he comes of twenty one years of Age in case my wife Should Marry after my Decease/ All which tracts of Lands aboue Specified I giue to my abouesd Son Nathaniel ffernald his heires Executrs Administratrs or Assignes for ever

Item I giue unto my welbeloued Martha ffernald ten pounds in Currant Money of New England to be paid to her her heires Executrs Administratrs or Assignes by my Son Nathaniel ffernald when she is Eighteen years of Age

Item I doe Constitute make And ordain my Dear and Louing wife to be my Sole and onely Executrix of this my last Will & Testament Desiring my brother John Spinney to be Assistant to her in any business in wch she desires his help.

And I hereby utterly disallow revoak and disannull all & euery other former Testaments and Wills by me in any ways before this time made, Ratifying and confirming this to be my last Will and Testament.
