JOSIAH, Wethersfield, br. of John of Hartford, first heard of 1651, d. 1 Sept. 1688; by w. Elizabeth wh. d. 17 Oct. 1682, had Benjamin, Elizabeth, Lydia, Josiah, Sarah, Ebenezer, Moses, Caleb, Mary, Amy; beside John, wh. is record. only at div. of est. in Prob. and was the youngest of the eleven. His sec. w. was Mary Ward. [ref 20]

GILBERT, Josiah, first heard of, as Savage says, in 1651, and a bro. of John of Htfd., and poss. s. of William of Windsor; he m. Elizabeth ___, who d. 17 Oct., 1682, ae. 50; he m. (2) wid. Mary Ward; was a lister in Weth., 1665, or earlier; also, constable; surveyor of highways, 1667; drew lds. in allotments of 1670 and 1694; bo't ld. of Mr. Willard, Dec., 1668, and of Gershom Bulkely, 1671. Josias Gilbert, witness in controversy Hollister vs. Bulkely, testified, Oct. 14, 1684, that he was 56 yrs. old and that in 1651 he entered upon Lt. Hollister's farm at Nayaug, as his tenant and held it 12 yrs.; had frequent disturbance fm. Mr. John Latimer, who complained of trespass. Josias' bros. Jonathan and John were on the place. Mch. 2, 1695-6. -- Jacob Williams, who had m. Josiah Gilbert's dau. Sarah and Simon Willard, the husband of his dau. Mary, make complaint (doc. in Prob. Ct. office) that the est. of Josiah Gilbert "hath now of long time been undivided, as to an absolute settlement, and is suffering thereby," and call upon "our respected Uncle Francis Whitmore," of Midd., to petition the County Court, at its next session, to order an equal distribution of the same. Josiah Gilbert d. in 1684, and in Mch., 1696-7, acc. to Court Rec., John Chester having orig. been spp. distributor to the est. with others, but having declined to act, the duty was given to Capt. Joseph Wadsworth and Mr. Joseph Mygatt. Children: Benjamin, Elizabeth Lydia, Josiah, Sarah, Eleazer, Moses, Caleb, Mary, Amy, John. [ref 24:353]

GILBERT, Josiah, s. of Thomas. Born abt. 1628, d. at Wethersfield, abt. Sept. 1688. He testified, Oct. 1684, ae. 56, and stated that he became in 1651 tenant farmer for Lt. Hollister, holding the farm twelve years. He m. (1) abt. 1651, Elizabeth Belcher, b. abt. 1632, d. at Wethersfield, 17 Oct. 1682 ae. 50; m. (2) Jan 1687/8, Mary, widow of John Ward and dau. of William Harris. The ante-nuptial agreement with Mary was dated 18 Oct. 1687 [always read as 1681, which is impossible, as her first husband was then living, and it is stated in probate records that the marriage took place Jan. 1687/8]. On 2 Mar. 1695/6, Jonathan Deming, Sr., John Riley, Jacob Williams, and Simon Willard, in right of their wives, who were all daus. of Josiah Gilbert, complained that no action had been taken on his estate, and appointed their uncle Francis Whitmore of Middletown to represent them. The Inv. appraised the presonal estate as of value on 29 Sept. 1688, which was prob. the date of Josiah's death; taken 17 Mar. 1695/6. Children named: Benjamin, Josiah, Eleazer, Moses, Caleb, John, Elizabeth Deming, Lydia Riley, Sarah Williams, Mary Willard, Amy Gilbert. A charge was allowed for bringing up John, son of Josiah, from last week of Mar. 1689 to Apr. 1697. [ref 55:2-219]

Josiah Gilbert, brother of Jonathan, John and probably of William and Obediah, all pioneers of Connecticut, died October 17, 1682, aged fifty; his first wife was Elizabeth, his second, Mary Ward; Josiah was constable, assessor, surveyor of highways of Wethersfield; children: Benjamin, Josiah, Ebenezer, Moses, Caleb and John. The Contract for marriage is as follows:

In the year of our lord 1681 The condishens hearof that whear the within bounders JOSIAH GILBERT shall by the grace of god marry and take to wife one MARY WARD widow, if the said Josiah after the said maridge had and solomised hepen to dey [die] before the said Mary that then the said Jos. shall leave the said Mary tow romes in the west end of the dwelling house now in being with one third part of his barn and out houseing told yards and with all freedom and convenience therein as also one third part of his orchard on the South side and foure akers of land tow akers of it abounding one the great river east and a deviding fince north and the orchard west and the other tow akers one the South side of Divident brook whare the said Mary shall make Choyce with convenient ways for transportation and forty shillings yearly in Corent pay of this contory to be paid att the said house by the asins of the said Josiah G: to the said M: or his asins after the deth of Jo: to be employed and Disposed to the proper use of the said Mary W: During her life and if after hir widowhod to Return the housing unto the eares [heirs] or asins of the said Jo: It is further granted that the said Mary W: shall after mared Solomised bring the improvement of his premises according to Law now unto the free use of the said Josiah G. with thirty tow pounds of her joynter portion and the other thirty tow is for hir att time before hir deth to Declare and make hir will devise and give att hir plesur to what parson or parsons and unto whet use or parpos as shee will att hir plasure and allso do permet hir executors to prove, declare and proforme hir will without interruption in Conformation hear of we set to our hands, October ye 18

Elizabeth2, m. Thomas* Gilbert, who was in Braintree in 1646 (MA Col records 111:67). Evidently he was the "goodman Gilbert" mentioned in Suffolk co deeds 5:527, who owned land in Braintree in 1668, adjoining land of Thomas Gatlive, whose widow, Prudence, was a witness to the will of widow Catherine1 Belcher. [ref 72:6]
