Estate of Phillip Taber 25 Jan. 1714/5, "Whereas our honoured father Phillip Taber of Dartmouth deceased being suddenly surprised by Death" . . . Settlement among following chil., viz: Philip Taber, Thomas Earl & wf Mary, Thomas Brownell & wf Ester, Thomas Cory & wf Sarah, Joseph Mosher & wf Lidia, John Macumber & wf Bithiah, John Taber and Abigail Taber (15:226-31; Bristol deed 17:210). On 4 March, 1692/3, an inventory of the estate of "Plilipe Taber Late of Dartmoth . . . Dec:d" was taken by Thomas Taber and Joseph Tripp. It was sworn to, "this last of agust 1693" by Thoman Taber, Mary Davis and Philip Taber, "all of Dartmoth" The only mention of real estate was: "all the houseing and lands" �120. The total amount of the inventory was �231, 14s., 6d. "we Thomas Taber Jonathan Delano Joseph Tripp Joseph Taber and George Cadman : all of the town of Dartmouth . . . being Chossen . . . to make a Just and Equall Divission of the Goods Chattles and Estate of Philip Taber Late of Dartmouth Decd Unto the Relect & Children of the said Philip Taber, Have joyntly Agreed & Divided the aforesaid Estate in mannr & form following that is to say, we have in the first place alowed & set out unto his Relect aforesaid one third part of the said Estate both Reall & personall and for her part of Houseing we have alowed her the lower Room in ye New house and the Celler And for her part of upland & meadow we have alowed & Set out unto her the South End of the said land and meadow with the orchard Upon it, to Divide from the other land by a little Creek being a little westward from the orchard aforesaid and from the head of said Creek by a straight line North East & by North to a Red oak Bush marked Standing by a great Rock and so upon the same line quite across the said land, and it is Bounded on the Southerly Side by the lands of Mary Timberleg, and att the Head by Undivided land, with four accers of meadow Lyeing Upon the horss Neck in Dartmouth aforsd And also we have allowed unto his Eldest Son Philip Taber all the Upland to the northward of the aforesaid Creek and line to a white oak tree standing about Thirty Rods to the northward of ye Usuall palce of the going over the River marked for the Northwest Corner Bound & from said white oak tree Upon a straight line across said land to a Red oak tree marked for the North East Corner Bound of said Philip Taber his part of land with one half of all the Marsh Lyeing before said part of land Bounded from the aforesaid Creek Northerly by the Upland to a little withe oak bush marked standing on the East Side of said marsh and from thence upon a straight line south west ward to a Stone sett up by the River side, With one halfe of all the Undivided lands formerly belonging to Phillip Taber aforesaid Decd We have also alowed the daid Philip Taber the other two thirds of the Houseing, which said Land & Houseing amounting to fifty pounds we order him the said Phillip Taber to pay to his Sister Hester Taber fourteen pounds Seaven shilings & four pence when she Comes to the age of Eighteen years or at the Day of her mariage if it Happen before" "And also we have alowed Unto his Son John Taber all the Remaining part of the Divided land belonging formerly to the aforesd Phillip Taber Decd adjoyneing and lying on the North End of the aforesaid land Bounded as Upon Record in the Purchasser Book of Records for the Township of Dartmouth Doth appear, with all the other halfe of the marsh Lying at the north End of his Brother Phillips his marsh and also the other halfe of the Undivided land formerly belonging to the above said Philip Taber Decd the which said lands amounting to thirty pounds we order him the said John Taber to pay to his Sister Bethiah Taber twelve pounds three shillings & Eight pence when she Coms to the age of Eighteen years or all the Day of her marriage if it Happen before" "Also we have agreed & ordered that the aforesd Philip Taber shall have a Conveinient way over the Land belonging to his Brother John Taber to the Undivided land for Cutting of wood; to him & his & Assignes for Ever, And also that the aforesaid John Taber his heirs & assignes for Ever : Shall have a Conveinent Cart way over his Brother Philip Tabers land to his the said John Tabers marsh" "And also we have alowed Unto his five Daughters Vizt Sarah Lidiah Abigail Easter and Bethiah Each of them Seaventeen pounds Sisteen shillings and four pence it being their Equall part of the aforesaid Estate" "And also And also[sic] we have alowed to his Daughter Mary Earle Seaven pounds Sixteen shillings and four pence, to make Up her portion Equall to the Rest, In Testimony whereof we have hereunto sett our hands this" 27 November 1693. On 13 September, 1694, Thomas Taber, Jonathan Delano, Joseph Tripp, George Cadman and Joseph Taber made oath to the division and it was apporved by John Saffin, Judge of Probate. Mary Cooke, b. 12 Jan., 1657; d. at Dartmouth in 1694; m. before 17 July, 1673 (on this date John Cooke conveyed to his son-in-law, Philip Taber, and Mary, his wife, certain lands in Dartmouth), Phillip Taber, son of Philip and Lydia (Masters) Taber. He d. in 1693 and she m. 2d, ___ Davis. The division of the estate of Philip Taber, Jr., 13 Sept., 1694, names children Mary, wofe of Thomas Earle, Philip, Sarah, Lydia, Abigail, Hester, John and Beriah. [ref 87:3-622]

"Whereas our honoured father Philip Taber of Dartmouth deceased being suddenly surprised by Death so that he had not oppertunity to make & ordain his last will . . . his Estate was therefore set out and Divided according to law both Real & personall by five men appointed by the Judge of Probate may more fully appear upon Record . . . first of all being set out for our honoured Mother or relick of our honoured father Phillip Taber one third part of the Real Estate being measured of and set out by those men appointed . . . being at ye [ * ] of the farm with four acres of salt meadow lying at the horseneck having reference to the Records abovesaid for a more plain demonstration of the Bounds thereof our honoured mother being now deceased the Real Estate being devidable according to the Law of this Province we ye subscribers being the heirs of our father deceased unto whom the abovesd Estate doth now belong have agreed in manner and form as followeth first of all considering the Damage of Dividing the abovesd Estate or Land have therefore unanamosly agreed that our Brother Phillip Taber for" �46, 13s., 4d., "equally to be divided among the six sisters and his Brother John viz" �6, 13s., 4d., "apeice which sd sum of Six pounds thirteen & four pence and to Each I the sd Phillip Taber do hereby bind my self . . . to pay at their or either of their Demand in Consideration of the sum of money as abovesaid to us and each of us paid and secured to be paid we the subscribers that have hereunto set our hands and seals viz Thomas Earl and Mary my wife Thomas Brownell and Ester my wife all of Portmouth in the Colony of Road island and providence plantations Thomas Cory and Sarah my Wife of Tiverton Joseph Mosher and Lidia my wife John Macumber & Bithiah my wife John Taber and Abigail Taber all of Dartmouth . . . do . . . make over . . . unto him our said Brother Phillip Taber . . . all our whole Right Title and Interest in the Land Meadows housing orchards fences . . . belonging to the above mentioned Land and premises" The deed was dated 26 January, 1714/15, and was signed by all the grantors.
