John Tomson3 (Mary Cooke, Francis), of Middleborough, Mass.; second of the name, born 24 November, 1649; married about 1680 Mary Tinkham2 (Mary Brown, Peter) and had twelve children, all recorded in Middleborough: Mary, John, Ephraim, Shubael, Thomas, Martha, Sarah, Peter, Isaac, Ebenezer, Francis, Jacob. John Tomson3 made his will, 19 October, 1724, and died at Middleborough, 25 November, 1725. [ref 93:20-159; 30-51]

On 19 October, 1724, "John Tomson . . . of Middleborough", made his will. Bequests were: To "my Eldest Son John Thomson all that my Seventy acres of land lying Joyning together whereon he now dwelleth : in the township of plimton : together with three Quarters of my meadow lying at the foot of Said land : and also my lot of land on assawamset neck : being in number the : 67th : lot on Said neck:" To "my two Sons Ephraim Thomson and Jacob Tomson : all my homested where I now dwell : that is to say : all my lands : meadows : and Swamps which lye there Joyning together : with all the buildings thereon : to be Equaly divided between them : onely Reserving unto my Loving Wife mary Thomson the whole use and Improbement of my now dwelling house During her Widdowhood: Reserving the liberty and priviledge for my three daughters mary Thomson : martha Thomson : and Sarah Thomson also To dwell in said dwelling house : if they see cause : so long as they Shall live unmarrie : and . . . my aforesaid two Sons Ephraim and Jacob : Shall find firewood cut : and brought to the door for their mother : and their three Sisters aforenamed while they shall live in said dwelling house : Respectively as aforesaid : and . . . my said two Sons Ephraim and Sacob shall provide for their mother ment : and corn : Suteable : and Sufficient for her during her Widdowhood:" To "my Son Shubaal Tomson my twenty acre lot of land where he how dwelleth : and all my meadow : in the meadows called the upper meadows in middleborough : and also my two lots of land in the third allotment in the : 16 Shilling purchase : being in number the : 32nd : and 33d : lots and also my one half of two other lots of land in said third allotment in said purchase being in number the : 158th : and the 172 nd : lots :" To "my Son Thomas Thomson my lot of land in the purchase called Snipetuet purchase : being in number the ninteenth lot : and also my lot of Cedar Swamp in the great cedar Swamp in Said Snipetuet purchase : and also the one half of my : 96 : acres of land in Said purchase Joyning unto the Saouth purchase : and also the half of my meadow : lying on the South Side of the brook Called Colchester brook in ;limton : together with the one half of my two acres of land lying Joyning to the South Side of Said meadow : alwayes provided that he shall let his mother have grass upon Said half of Said meaow to make one load hay yearly during her Widdow hood :" To "my Son Peter Thomson the other half of the aforesaid meadow Lying on the South Side of Colchester brook with the other half of Said two acres of land Joyning thereunto and that he also shall let his mother have grass upon Said half of Said meadow to make one load of hay yearly during her Widdowhood : also my three lots of land in the first allotment in the 16 : shilling purchase being in number the first lot : the fourth lot and the forty Eighth lot :" To "my Son Ebenezer Thomson : my hundred acre lot of land butting upon Namasket River in the : 26 mens purchase with the two acres of meadow on Said River at the foot of Said lot : and also my lot of land in the Second allotment in the : 16 : shilling purchase : being in number the thirty ninth lot :" To "my Son Frances Thomson my two lots of land on Snipetuet neck : in Snipeuet purchase being in number the Second lot and the third lot : land also all that my lot of Cedar Swamt which Lyeth Joyning unto the north East Side of Snipetuet pond in the aforesaid purchase : and also the one half of my : 96 acres of land in Said purchase Joyning unto the South purchase :" To "my aforesaid two Sons Ephraim and Jacob : my two lots on assawamset neck : being in number the Seventeenth and eightenth lots : to be Equaly divided between them :" To "my Said Son Ephraim : one quarter part of my meadow lying at the foot of the land whereon my Son John dwelleth : also . . . my two Shares in the fourth allotment in the Sixteen Shilling purchase : Commonly Called the little Shares :" To "my aforesaid Son John my five and twenty acre lot of land in the 26 mens purchase being in number the Twenty Sixth lot and also all my right and Interest in the lands in the purchase called the five mens purchase in middleborough :" To "my aforesaid three daughters mary : martha : and Sarah : all my Share of land : in the purchase Commonly called Lothrops & Tomsons purchase to be Equaly divided among them" To "my Six Sons John : Ephraim : Thomas : Peter : Ebenezer : and Jacob all my Share of Cedar Swamp in the Second lot in the gread Cedar Swamp In the majors purchase : To be Equaly divided among them :" To "all my Eleven Children both Sons and Daughters all my Shares of land in that tract of land lying on the East Side of namasket River : belonging to the proprietors or the Sixteen Shilling purchase : the land to be Equaly divided among them all" To "Wife Mary Thomson two cows : and my will is that my two Sons ephraim and Jacob Shall Keep the Said two Cows for their mother both winter and Sumer : and to provide hay for them : of the grass Reserved in their brothers medow before mentioned and if these two loads of hay be not Sufficient : then they to probide the rest from their own meadow : and they to fodder Said cows for their mother in the Season thereof during her widdowhood : and they to have the Increase of Said Cows : and they to make good the Stock if any mishap befall So as that She may constantly from time to time be provided with two Cows : and at the time of her decease : or marriage : then the Said Ephraim : and Jacob Shall have the two cows for their own :" To "my aforesaid wife the one half of all the Rest of my moveable Estate Whatsoever : with the one half of the money : or Bills of Credit Which I Shall have at the time of my decease and the one half of the debts due unto me : (my Just debts and funeral Charges being first paid out of my sd moveable Estate) . . . and the other half of my Said moveable Estate : money : and Bills of Credit : and debts due to me : (my Just debts and funeral Charges being first paid as aforesaid) Shall be Equaly divided among all my Eleven Children : both Sons and daughters :" His wife Mary and sons Ephraim and Thomas were appointed executors. The witnesses were Jacob Tomson, Barnabas Tomson and Lydia Tomson. All three made oath to the will, on 23 December, 1725, before Isaac Winslow, Judge of Probate. On 19, 1725 (30 January, 1726 New Style), the will was probated, and administration granted to the three executors named. An inventory of the personal estate was taken at Middleborough, 21 February, 1725/5, by Jacob Tomson, David Bozworth and James Soul. (Plym. co probate 5:269) [ref 93:20-160]
