28 Aug 1796 whilst becalmed off Cape Henry, a squadron including the Bermuda, Captain Thomas Maxtone, sighted 3 French frigates : once able to make sail the Topaze brought the sternmost of the enemy's ships to action. This ship, the French frigate Elizabet, fired a broadside and hauled down her colours, the other 2 frigates escaping in the approaching night.

Sep 1796 foundered in the Florida gulf: crew perished. Capt. Thomas Maxtone.
